Greetings Colleagues,

There’s much to report this time to keep you informed!

1) EXTERNAL IMPOSTER EMAIL INVESTIGATION

As you all know, Local 47 member Charles Fernandez filed a lawsuit in the County of Los Angeles to obtain the imposter account creator’s information. The investigation entailed the hiring of Lawyers in both Los Angeles and Georgia to serve a subpoena to the mail server, Mail Chimp.

We now have the information as the result of the subpoena and will be turning it over to the internal Local 47 investigation. It will be reported to the membership, along with the internal Local 47 investigation at the general membership meeting on July 24th. Please try to be there.

Mr. Fernandez had requested an independent investigation of the matter to guarantee impartiality. In June 6th’s Board meeting, according to the minutes on the Local 47 website, the Board decided NOT to honor that request.

Why were Mr. Fernandez and the COMMITTEE concerned that the officers were too close to the matter to be considered, wrongly or not, impartial?

Come to the General Membership meeting on July 24th and find out! You won’t be happy either, we suspect.

II) THE PRESIDENT IS SAD A FELON IS GONE?

Have you read President Espinosa’s contribution in this months’ Overture?

He still refuses to use the name of the General Manager (Doug Caine) when explaining he was fired.

In fact, he refuses to even ADMIT that he was fired because of felonies! He just says he’s sad that the former General Antagonizer is gone. Imagine that, someone the President hired and gave (knowingly or not) carte blanche to terrorize our employees, and knowing all that this President is STILL sad he’s gone?

Someone’s priorities need a tweak.

We also hear once again the age old argument that with a Quorum of 50 only 33 decide the FATE of the local. Before the April 24th meeting only eight board members could decide everything non-salary related.

As was related at the April 24th meeting, historically whenever the quorum for this Local has risen above 50, like it or not, consistent meetings do not take place. While it may be the WISH of the Local that a higher quorum will work, the REALITY is that it does not.

Bravo again to the members who brought us back to reality!

We wish to thank the President for apparently giving credit for the meetings’ attendance to the COMMITTEE! The truth is, however, that while our activism certainly played a big role in the attendance, equal credit should also be given to the FMA and their members for sharing the task of alerting and getting members to that meeting!

III) A CORRECTION OF THE LAST MAILING

Today we have corrected information on the statement released by President Espinosa re: the firing of the General Manager.

A credible and highly placed source at Local 47 has informed us that President Espinosa did indeed read and edit the statement prepared by our Local #47 lawyer Lewis Levy before it was posted on the website.

We sincerely apologize to Lewis for any appearance of misinformation. We worked from what we were told in conversation with President Espinosa.

While Lewis was not at the Board Meeting when the evidence was presented, he was immediately notified and given copies of the documents. His statement was prepared using this information.

President Espinosa, NOT LEWIS, chose not to mention the major felonies (The only ones mentioned in the meeting), in order to spare the fired employee embarrassment, according to our source.

Lewis is actually doing some very good things for our members. It was Lewis (working with David Schubach and other officers) who drafted our current SELA agreement. Other benefits to our members are in the works.
