Symphonic musician<\/p>\n\n\n\n<p>&#8230;Reporting issues the Musicians Union doesn&#8217;t dare to\nmention &#8211; National touring musician\u2028<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">================================================<\/h1>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>AB5 Carrots and Sticks&nbsp;<\/strong><\/li><\/ol>\n\n\n\n<p>Hello All,<\/p>\n\n\n\n<p><br>\nThe author of AB5, California\u2019s new gig-work law, said Thursday that she\u2019ll\nseek amendments that remove some restrictions on freelance journalists and\nphotographers, and is eyeing further changes for musicians, small businesses\nand others, as well as an assistance fund to help small nonprofit arts groups\ncomply.<\/p>\n\n\n\n<p>Gonzalez said she\u2019s calling for $20 million in the state budget to\nsupply grants to small community nonprofit arts organizations \u201cthat make a\ngood-faith effort to comply\u201d with the new law. Many small theater, dance and\nmusic companies have said&nbsp;<a href=\"https:\/\/www.sfchronicle.com\/entertainment\/article\/Musicians-and-actors-invented-the-gig-A-new-law-14924567.php\">they operate on shoestring\nbudgets<\/a>&nbsp;and\nsimply could not afford to hire all their performers and backstage crews as\nemployees.<\/p>\n\n\n\n<p>&#8212;&#8212;&#8212;&#8212;-<\/p>\n\n\n\n<p>In a decision issued on Monday, (2\/10\/20) Judge Dolly Gee of the\nCentral Court of California wrote that that the court &#8220;cannot second guess\nthe Legislature\u2019s choice to enact a law that seeks to uplift the conditions of\nthe majority of non-exempt low-income workers rather than preserve the status\nquo for the smaller subset of workers who enjoy independent contractor\nstatus,&#8221; adding that &#8220;the balance of equities and the public interest\nweight in favor of permitting the State to enforce this legislation.&#8221;<\/p>\n\n\n\n<p>&#8212;&#8212;&#8212;&#8212;-<\/p>\n\n\n\n<p>Comment<\/p>\n\n\n\n<p>The above does not change the fact that AB5 is the government\ntelling citizens just under what terms they will be allowed to earn a living.<\/p>\n\n\n\n<p>Gavin Newsom has included 20 million dollars in the budget for\nenforcement of AB5. Lorena Gonzalez now wants to add another 20 million to\nentice compliance. Lots of taxpayer dollars going toward a deeply flawed\nlaw.&nbsp;<\/p>\n\n\n\n<p>The ability to earn a legitimate living under one&#8217;s own terms should be protected as a fundamental civil right. Too bad Judge Dolly Gee doesn&#8217;t agree. <\/p>\n\n\n\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n\n\n\n<p>2. COMMENTS<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>As\nsupervising manager and\/or conductor of Opera San Luis Obispo and the Lompoc\nPops Orchestra, and, as Principal Conductor for State Street Ballet Santa\nBarbara and Civic Ballet San Luis Obispo, and, as Principal Guest Conductor of\nseveral other entities, every year, I am responsible for the hiring of more\nthan 400 instrumental musicians, 200 choral singers, 60 vocal soloist\npositions, 40 dancer roles, and lastly, 40 non-performing roles; such as\ndirectors, choreographers, stage managers, costume designers, stage assistants,\ncostume assistants, assistant conductors, assistant directors, etc.<\/p>\n\n\n\n<p>ALL\nOF THESE POSITIONS ARE INDEPENDENT CONTRACTORS!!! They take my jobs then move\non to the next. Approximately 9% of those jobs are filled by union instrumental\nmusicians \u2013 ALL OTHER POSITIONS are held by non-union member HUMAN BEINGS! <\/p>\n\n\n\n<p>This\ninformation illustrates several important facts:<\/p>\n\n\n\n<p>1.\nUnion musicians take non-union work all the time.<br>\n2. The vast majority of work in classical performing non-profit world is\nproduced by non-union people.<br>\n3. Union member musicians MUST take non-union work to survive.<\/p>\n\n\n\n<p>Local\n47 has never spoken for musicians. Local 47 is 100% ONLY concerned about\ncollecting dues to fill the pockets of its executive leadership. AB5 will be\noverthrown and this entire negative experience suffered by artists throughout\nCalifornia will be remembered, recanted, and used to inspire individual union\ncessation, encouragement for companies to cut union ties, and finally to inform\nboard members, patrons, and donors all around California how critical it is\nthat they understand how utterly useless musical unionism is in today\u2019s\nclassical performing arts business model. AB5 will forever justify how\nUNNECESSARY it\u2019s is for an orchestra to consider union membership or ANY\ncollective bargaining negotiation.<\/p>\n\n\n\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n\n\n\n<p>Thank you for taking the time to post this! If you haven\u2019t\nalready done so, please consider posting this (in it\u2019s entirety) on all of the\nAB5 Facebook groups such as California Independent Music Professionals United,\nFreelancers Against AB5, etc. You are in a unique position to effectively\nillustrate how many different freelance positions are filled by both union and\nnonunion INDEPENDENT CONTRACTORS. AB5 will destroy these peoples\u2019 livelihoods.<\/p>\n\n\n\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n\n\n\n<p>It\nreally is all hands on deck to get this earnings killer repealed! It doesn\u2019t\nmatter your political bent if your government is responsible for you not being\nable to make a legitimate living.
