On Friday, Jan. 10 Gonzalez <a href=\"https:\/\/californiaglobe.com\/section-2\/assemblywoman-gonzalez-says-there-is-no-data-proving-thousands-of-freelancers-are-losing-work-due-to-ab-5\/\">appeared on KUSI<\/a> in San Diego and made numerous\nfalse claims about workers in the gig economy not paying taxes or having\nbenefits. The same day,&nbsp; Gov. Gavin Newsom allocated $20-million to target\nand investigate contractors, not in compliance with the law that took effect\nNew Year\u2019s Day. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">California\nis estimated to have nearly two million residents who choose to work as an\nindependent contractor, according to the&nbsp; 2018 U.S. Bureau of Labor\nStatistics Economic Release. Two million however is a conservative estimate\nbecause the report did not include the number of individuals who supplement\ntheir income with online platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gonzalez\nhas angered not just thousands but possibly millions of voters. Self-proclaimed\nhard core Democrats have said this is the straw that broke the camels back. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A\ngroup of contractors met with Assemblyman David Chui (D) in San Francisco on\nMonday. Chui told contractor Emily Price and others that a repeal of AB-5 is\nunlikely but he is keeping a binder of people\u2019s stories on how the bill is\naffecting them. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Meanwhile,\nrally\u2019s are being planned up and down the state, freelancers and independent\ncontractors are writing letters, and making phone calls to state\nrepresentatives. Gonzalez however remains firm AB 5 and says the new law is\nbest for the state. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">AB\n5 stems from the&nbsp; The <em>Dynamex Operations West, Inc. v. Superior Court<\/em>\ndecision by the California Supreme Court in April 2018 that <a href=\"https:\/\/californiaglobe.com\/section-2\/california-legislature-attempting-to-unionize-ride-share-companies\/\">overturned three decades<\/a> of California employment\nlaw that allowed individuals to work as independent contractors. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/lookaside.fbsbx.com\/file\/Im-Independent-Fact-Sheet-2.5.19v2.pdf?token=AWzkWCHDYAVeR7u9Dm04XvvVcKzjG1yl_90Jb5ZC8aNPBSbI3k3BSMxHap4dhXFHA8CUSUdoE2UOUmxviEXPfhf5HsKRJ75uRa9EoWia801_1su_PKmsApvToNDbtp6NFaAkQK0V6sZDAH7vXu2hB_bOYEFCQtE8hmkuAus2bbhRqicSsOjo_7QKqfUevWqMEmuGZLWYh0kp_N4eBt6YhXQLftpxFJW9qHE-TaOo1eLqnLzxt7EKyu-cr2V1CUAw_sLUjX\">According<\/a> to Imindependent.com, \u201cThis decision\ncould upend how millions of Californians earn a living and nearly every\nindustry due to its new restrictive ABC test. The ABC test is the first time in\nU.S. history that such a test has been imposed by a court, without legislative\napproval, with three independently disqualifying factors.\u201c<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Newsom\nwho is pro-union like Gonzalez, said he will use part of the $20 million for\ntraining staff to allocate the ABC test and to allocate funding to investigate\nand hold hearings on compliance.
