{"id":829,"date":"2019-05-15T15:37:46","date_gmt":"2019-05-15T22:37:46","guid":{"rendered":"http:\/\/www.responsible47.com\/?p=829"},"modified":"2019-05-15T15:37:46","modified_gmt":"2019-05-15T22:37:46","slug":"817-nlrb-afm-question","status":"publish","type":"post","link":"http:\/\/www.responsible47.com\/?p=829","title":{"rendered":"817 \/ NLRB \/ AFM \/ QUESTION"},"content":{"rendered":"\n<p>5\/15\/19<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>WELL, AT LEAST IT\u2019S STILL IN THE INDUSTRY<\/li><li>LOOK AT WHO\u2019S HAD TO CHANGE THEIR BYLAWS<\/li><li>CLARIFYING THE UNCLEAR \u2013 WHICH IS DOESN\u2019T<\/li><li>A QUESTION<\/li><\/ol>\n\n\n\n<p>&#8230;Absolutely guaranteed anonymity &#8211; Former Musician&#8217;s Union\nofficer\u2028<\/p>\n\n\n\n<p>&#8216;<\/p>\n\n\n\n<p>&#8230;The one voice of reason in a sea of insanity &#8211; Nashville &#8216;first\ncall&#8217;\u2028scoring\nmusician\u2028\u2028<\/p>\n\n\n\n<p>&#8230;Allows us to speak our minds without fear of reprisal &#8211; L.A.\nSymphonic musician<\/p>\n\n\n\n<p>&#8230;Reporting issues the Musicians Union doesn&#8217;t dare to mention &#8211;\nNational touring musician\u2028<\/p>\n\n\n\n<p>================================<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>WELL, AT LEAST IT\u2019S STILL IN THE INDUSTRY<\/li><\/ol>\n\n\n\n<p><strong>Netflix to\nexpand again in Hollywood with two more office leases<\/strong><\/p>\n\n\n\n<p>By Roger Vincent<\/p>\n\n\n\n<p><a href=\"https:\/\/www.latimes.com\/business\/la-fi-netflix-hollywood-leases-20190429-story.html\">https:\/\/www.latimes.com\/business\/la-fi-netflix-hollywood-leases-20190429-story.html<\/a><\/p>\n\n\n\n<p>Video-streaming giant Netflix continues to rapidly expand its presence in\nHollywood, signing two more leases in the neighborhood and furthering its\nposition as one of the biggest office tenants in Los Angeles.<\/p>\n\n\n\n<p>Netflix recently agreed to lease a total of nearly 170,000 square feet in\ntwo locations, according to people with knowledge of the deals who were not\nauthorized to discuss them.<\/p>\n\n\n\n<p>Although the company is based in the Silicon Valley city of Los Gatos, its\nLos Angeles footprint of offices and production space is growing immense.\nNetflix occupies, or has agreed to move into, about 1.6 million square feet of\nspace in the area.<\/p>\n\n\n\n<p>The media company that distributes movies, television shows and\ndocumentaries will rent 100,000 square feet of offices on a campus being built\non property formerly owned by the Musician\u2019s Union of Hollywood at 817 Vine St.<\/p>\n\n\n\n<p>It has also sublet nearly 70,000 square feet in a 1990s office building at\n1350 N. Western Ave. The address is north of the 101 Freeway, which has\ncommonly been regarded as the northern boundary of Hollywood\u2019s business\ndistrict.<\/p>\n\n\n\n<p>Netflix is a sub-tenant there of ZestFinance, which previously occupied the\nbuilding owned by LaTerra Development and Gemdale USA. Nextflix is expected to\nmove in within two months.<\/p>\n\n\n\n<p>The campus on Vine Street at Waring Avenue is being developed by LPC West, a\ndivision of Lincoln Property Co. The complex catering to the entertainment\nindustry includes a new building and a renovated two-story structure built in\n1950 to serve as a clubhouse and organization headquarters for the union now\nknown as the American Federation of Musicians Local 47. It is set to be\ncompleted this year.<\/p>\n\n\n\n<p>The company and its office landlords declined to comment on the latest\nleases, which were first reported by the Real Deal real estate news website.<\/p>\n\n\n\n<p>The leases follow other large real estate deals by Netflix.<\/p>\n\n\n\n<p>Landlord Kilroy Realty said in November that <a rel=\"noreferrer noopener\" href=\"https:\/\/www.latimes.com\/business\/la-fi-netflix-academy-20181113-story.html\" target=\"_blank\">Netflix will occupy<\/a> 355,000 square feet of offices in a\nmixed-use complex called Academy on Vine that Kilroy is building on Vine Street\njust south of the ArcLight Cinemas complex that is home to the famous Cinerama\nDome movie theater. It is set to open in 2020.<\/p>\n\n\n\n<p>In October, another Hollywood landlord, Hudson Pacific Properties Inc.,\nannounced that <a rel=\"noreferrer noopener\" href=\"https:\/\/www.latimes.com\/business\/la-fi-netflix-epic-20181004-story.html\" target=\"_blank\">Netflix would lease <\/a>all of a 13-story tower it is building\non Sunset Boulevard across from Sunset Bronson Studios. That lease for 328,000\nsquare feet is also set to begin in 2020, when the tower, called Epic, will be\ncompleted.<\/p>\n\n\n\n<p>Netflix already occupies offices and studios on the Sunset Bronson Studios\nlot owned by Hudson Pacific.<\/p>\n\n\n\n<p>Netflix, which once relied on streaming licensed movies and television shows\nmade by other studios, is on a growth streak as it aggressively remakes itself\ninto a Hollywood player by creating a torrent of original content. The company\nis expected to spend $15 billion on content this year.<\/p>\n\n\n\n<p>To deepen its ties to filmmakers, Netflix has been <a rel=\"noreferrer noopener\" href=\"https:\/\/www.latimes.com\/business\/hollywood\/la-fi-ct-netflix-egyptian-theatre-hollywood-20190409-story.html\" target=\"_blank\">in talks to buy the storied Egyptian Theatre <\/a>from American\nCinematheque, the L.A. nonprofit that owns the venue known for hosting special\nscreenings and events on Hollywood Boulevard.<\/p>\n\n\n\n<p>NOTICE TO EMPLOYEES AND MEMBERS<\/p>\n\n\n\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n\n\n\n<p>II. LOOK AT WHO\u2019S HAD TO CHANGE THEIR BYLAWS<\/p>\n\n\n\n<p>From the NLRB:<\/p>\n\n\n\n<p>Posted pursuant to a settlement agreement approved by a regional director of\nthe National Labor Relations Board.<\/p>\n\n\n\n<p>An agency of the United States Government.<\/p>\n\n\n\n<p>\u2022 Form, join or assist a union;<\/p>\n\n\n\n<p>SECTION 7 of the NATIONAL LABOR RELATIONS ACT, A FEDERAL LAW, GIVES YOU THE\nRIGHT TO:<\/p>\n\n\n\n<p>\u2022 Choose a representative to bargain with your employer on your behalf;<\/p>\n\n\n\n<p>\u2022 Act together with other employees for your benefit and protection;<\/p>\n\n\n\n<p>\u2022 Choose not to engage in any of these protected activities.<\/p>\n\n\n\n<p>WE WILL NOT do anything to prevent you from exercising the above rights.<\/p>\n\n\n\n<p>WE WILL NOT maintain overly broad language in our bylaws that interferes\nwith your right to engage in Section 7 activity, contained in Article 8,\nSection 3, which provides, in relevant part: \u201cMembers shall not render musical\nservices\u2026. With or for people who have been employed by\u2026 or are otherwise\nassociated with organizations or establishments that are listed on the\nInternational Unfair List.<\/p>\n\n\n\n<p>WE WILL NOT in any like or related manner restrain or coerce you in the\nexercise of your rights under Section 7 of the Act.<\/p>\n\n\n\n<p>WE WILL rescind and remove the overly broad language, described above, from\nArticle 8, Section 3 of our bylaws.<\/p>\n\n\n\n<p>AFM and it\u2019s locals 66, 542, 148-462 and 285-403<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p>III. CLARIFYING THE UNCLEAR \u2013 WHICH IS DOESN\u2019T<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n\n\n\n<p>FROM THE AFM<\/p>\n\n\n\n<p>Dear Members:<\/p>\n\n\n\n<p>In further clarification to our notice dated May 2, 2019,\nreferenced above, please be advised that our International Unfair List remains\nfully intact and absolutely enforceable against employers and their allied\ncontractors and subcontractors whose unfair actions result in the existence of\na primary labor dispute with the Federation and\/or its Locals.<\/p>\n\n\n\n<p>You received the above-referenced notice in connection with our\nplacement of a national contractor on the International Unfair List, who\nreacted to that by filing with the National Labor Relations Board a series of\nunfair labor practice charges against AFM and numerous Locals.&nbsp; All of the\ncontractor&#8217;s charges were dismissed as lacking in merit, and all subsequent\nappeals were denied.&nbsp; The NLRB, however, did find that the wording of a\nportion of AFM bylaw Article 8, Section 3, was overly broad, and as such,\nhypothetically could extend inappropriately to neutral parties who have no\nstake in a primary labor dispute.&nbsp; At the same time, the NLRB expressly\nnoted that there is no evidence that AFM ever actually applied the bylaw in an\nunlawful manner.&nbsp; Nevertheless, the NLRB required us to revise the wording\nof the bylaw as a precaution.<\/p>\n\n\n\n<p>&nbsp;Unfortunately, the confusing text of the email blast that\nwas sent to members was determined by the NLRB.&nbsp; I apologize for any\nconfusion it has caused.<\/p>\n\n\n\n<p>Thank you,<\/p>\n\n\n\n<p>&#8212;&#8212;&#8212;&#8212;<\/p>\n\n\n\n<p><br> American Federation of Musicians<br> of the United States and Canada<br> 1501 Broadway, 9th Floor<br> New York, NY 10036<\/p>\n\n\n\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n\n\n\n<p>IV. A QUESTION<\/p>\n\n\n\n<p><br><\/p>\n\n\n\n<p>There have been several interpretations of the above by\ndifferent musicians and members.<\/p>\n\n\n\n<p>Some have interpreted the initial NLRB statement to say the\nunion cannot go after musicians for any work they might do.<\/p>\n\n\n\n<p>Others have interpreted the above to say that as long as the\nemployer is NOT on the international unfair list it\u2019s fine to work for them,\nunion of not.<\/p>\n\n\n\n<p>What is your interpretation, dear reader?<\/p>\n\n\n\n<p>If the material presented above means the union cannot come\nafter players for non-union sessions, this allows the perceived top tier (and\neveryone else) to dodge the present bylaws. <\/p>\n\n\n\n<p>How?<\/p>\n\n\n\n<p>Some weeks ago a large (non-union) recording session took place\nfeaturing a large number of the perceived A-listers, including some on the AFM Local\n47 board.
