POPS ROPA RESOLUTION\/VIDEO GAME INFO\/CONCERTS\/COMMENTS"},"content":{"rendered":"<p>I.\tROPA RESOLUTION RE: PASADENA POPS<br \/>\nII.\tFREE CONCERT BY MEMBERS OF THE  PASADENA POPS THIS SUNDAY!<br \/>\nIII.\tMORE VIDEO GAME INFO<br \/>\nIV.\tUPCOMING MEMBER CONCERTS AND NEWS<br \/>\nV.\tREADER COMMENTS<\/p>\n<p>Greetings Local 47 Colleagues!<\/p>\n<p>We\u2019ve received copies of the ROPA resolution concerning the Pasadena<br \/>\nPops from many directions in the last few days: the Local, members<br \/>\nof the Pasadena Pops themselves and even the RMA.<\/p>\n<p>The Local stated in their mailing a couple of days ago that they support<br \/>\nthe ROPA resolution. Well, who wouldn\u2019t? The fact is the Local 47<br \/>\nadministration did little until members started making waves and going<br \/>\nto the press.<\/p>\n<p><!--more--><\/p>\n<p>At the recent AFM convention President Espinosa told Local 47 member<br \/>\nCharles Fernandez that he had been called by orchestra management and<br \/>\nasked if the Local would have a problem with \u201cmerging\u201d the orchestras.<br \/>\nAccording to President Espinosa, he told them, \u201cIt\u2019s your organization,<br \/>\nyou can do what you like\u201d. President Espinosa then said he called Local 47<br \/>\nlegal counsel Louis Levy, who he said had the same opinion.<br \/>\nMr. Fernandez took the time to confirm what the President said, repeating<br \/>\nhis statement back to him.<\/p>\n<p>Later that day, President Espinosa confronted Mr. Fernandez, asking<br \/>\nif he\u2019d been misrepresenting what had been relayed to him. Again<br \/>\nMr. Fernandez repeated back what had been told to him by the President<br \/>\nand Mr. Espinosa admitted that he had quoted him correctly.<\/p>\n<p>Though it was originally presented to President Espinosa as a merger,<br \/>\na term he used at the convention, he is now saying, just today in<br \/>\na \u201cclarification\u201d email from the Local that it\u2019s not a merger but a<br \/>\ndissolution. Did Mr. Espinosa know it was a dissolution then? <\/p>\n<p>Here is the resolution passed by the ROPA Convention.<\/p>\n<p>I. RESOLUTION PASSED AT THE ROPA CONVENTION ON BEHALF OF PASADENA POPS MUSICIANS<\/p>\n<p>ROPA Executive Board<br \/>\nRecommendation No. 4<br \/>\nto the  ROPA Conference of 2007<br \/>\nPasadena Pops Orchestra <\/p>\n<p>Whereas, Solidarity with our fellow Union orchestral musicians is<br \/>\ncritical to all our livelihoods; and <\/p>\n<p>Whereas, The Pops Orchestra is an orchestra of the highest caliber;<br \/>\nand Whereas, The Boards and Managements of the Pasadena<br \/>\nSymphony and Pasadena Pops Orchestra have decided to merge<br \/>\ntheir orchestras into the Pasadena Symphony;<br \/>\nand <\/p>\n<p>Whereas, The proposed merger will result in the unfair layoff of<br \/>\nall of the Pasadena Pops Musicians;<br \/>\nand  <\/p>\n<p>Whereas Union musicians should not allow orchestra managements<br \/>\nto take unfair advantage of the underemployment in our field by<br \/>\noffering new work to musicians in such a manner as to deprive<br \/>\nanother group of their right to the work historically due them; <\/p>\n<p>therefore, be it  <\/p>\n<p>Resolved, That the ROPA Conference of 2007 of the American<br \/>\nFederation of Musicians calls on the Pasadena Symphony and\/or<br \/>\nany successor organization &#8211; in the strongest terms possible &#8211;<br \/>\nto continue to hire the musicians of the Pasadena Pops Orchestra<br \/>\nand to grant them tenure; and be it <\/p>\n<p>Resolved, That the ROPA Conference of 2007 of the American<br \/>\nFederation of Musicians calls on the Pasadena Symphony and\/or<br \/>\nany successor organization to immediately begin to bargain in<br \/>\ngood faith with the Professional Musicians Local 47, of the American<br \/>\nFederation of Musicians to use the Pasadena Pops Musicians for<br \/>\nthe work that will be produced as part of their \u201cPops\u201d services;<br \/>\nand be it <\/p>\n<p>Resolved, That ROPA shall present a copy of this Resolution to<br \/>\nthe Pasadena Symphony Musicians and its Players\u2019 Committee,<br \/>\nand to the Executive Board of Professional Musicians Local 47,<br \/>\nand urges those bodies to provide their unconditional support of<br \/>\nthe Pasadena Pops Musicians; and be it further <\/p>\n<p>Resolved, That the ROPA leadership present this Resolution to<br \/>\nthe 2007 ICSOM Conference and urge the adoption of similar<br \/>\nlegislation in support of the Pasadena Pops Musicians.<\/p>\n<p>============<\/p>\n<p>II. FREE CONCERT BY MEMBERS OF THE  PASADENA POPS!<\/p>\n<p>This Sunday, September 2nd, 2007 at 7pm, members of the<br \/>\nPasadena Pops will present a free concert at the Pasadena<br \/>\nPresbyterian Church. The church is located at 585 E. Colorado.<br \/>\n(Colorado Blvd. at Madison).<\/p>\n<p>The concert is being called an \u201cinformance\u201d concert (We thought<br \/>\n\u201cinformance performance\u201d would have been more catchy).<\/p>\n<p>The concert will be conducted by members Barry Socher and Ray<br \/>\nBurkhart and will feature piano soloists Susan Svrcek and Delores<br \/>\nStevens. The program will include Vivaldi, Sibelius, Carnival of the<br \/>\nAnimals and Peter and the Wolf with new texts by Peter Schickele<br \/>\nnarrated by special guest Rich Capparela. <\/p>\n<p>Please come out and support these wonderful musicians whose jobs<br \/>\nare at risk and find out how you can help!<\/p>\n<p>Donations will be accepted.<\/p>\n<p>============<\/p>\n<p>III. MORE RECENT INFO ABOUT VIDEO GAMES<\/p>\n<p>Recently the RMA sent out a \u201cVideo Game Alert\u201d saying members<br \/>\nshould call the AFM and ask for the specifics of the sessions when<br \/>\nthey\u2019re called. The fact is, it\u2019s the CONTRACTORS\u2019 responsibility to<br \/>\nknow these details and anyone called for those sessions should call<br \/>\nthe contractor first. The RMALA leadership is simply trying to make<br \/>\nit more difficult to do that business here and basically whine because<br \/>\nthey\u2019re not controlling it.<\/p>\n<p>We recently spoke with someone from the Eastwood Stage at Warner<br \/>\nBrothers. He informed us that, though things have been OK, within a<br \/>\nweek of the introduction of the new AFM Video Game agreement they<br \/>\nhad six new calls to book Video Game sessions! The action by the AFM has<br \/>\nmade a measurable difference here. If we can keep the RMALA leadership<br \/>\nfrom trying to undermine that work things will continue to improve.<\/p>\n<p>In the interest of full disclosure, we will now include the RMA\u2019s mailing<br \/>\nand a response from an active and experienced contractor in the San<br \/>\nFrancisco area.<\/p>\n<p>&#8212;&#8212;<\/p>\n<p>RMA VIDEO GAME ALERT<\/p>\n<p>The AFM is putting together multiple individual contracts to cover<br \/>\nvideogame scoring. It seems that each videogame scoring call that<br \/>\ngoes out has different wages, terms and conditions. This practice is<br \/>\ncausing endless confusion for musicians, contractors and composers<br \/>\n\u2013 even the answering services.<\/p>\n<p>Musicians don\u2019t know what they are going to be paid when they are<br \/>\noffered these calls. The AFM has withheld information from Local 47<br \/>\nas well. John Acosta is our Electronic Media Administrator at Local 47;<br \/>\nhe can\u2019t answer your questions when the AFM hides the ball. These<br \/>\ndeals are being arranged by the AFM, not Local 47 (or the contractor).<br \/>\nLegally, the AFM is obligated to tell you the wages and terms and<br \/>\nconditions of your employment. Logically, since the AFM is creating<br \/>\nthese deals in secrecy, they are the only ones who actually know the<br \/>\ndetails of each contract. Only the AFM can give you answers.<\/p>\n<p>The AFM is handling this industry in a way that causes confusion and<br \/>\ndenies us straightforward rights. We are concerned about the many<br \/>\nreports we are receiving from musicians who feel they are not being<br \/>\nprotected by the AFM. The RMA is both pursuing this issue within the<br \/>\nunion and looking at potential external legal remedies.<\/p>\n<p>While working together as a community is our greatest strength, RMA<br \/>\nfully recognizes and respects each member\u2019s right to handle business<br \/>\nin their own way, and has no desire to dictate anybody\u2019s decisions. With<br \/>\nthat in mind, we suggest that you please consider the following course of<br \/>\naction:<\/p>\n<p>When you get a call for a videogame session, please<\/p>\n<p>-Explain to the service or the contractor that you need to put the call<br \/>\non hold briefly.<\/p>\n<p>-Then, both place a phone call and send an email to the American<br \/>\nFederation of Musicians and request a copy of the contract covering<br \/>\nthe work you have been offered . The person to contact is Savina<br \/>\nCiaramella. Her email is sciaramella@afm.org (you may copy the RMA<br \/>\nat webmaster@rmala.org). and her phone number is (213) 251-4510<br \/>\next. 202.<\/p>\n<p>-Please let her know by both phone and email that you need an<br \/>\nimmediate  response, as hanging up a contractor is inconvenient to<br \/>\nall and potentially threatening to future employment.<\/p>\n<p>It is our hope that the AFM will provide real information to members<br \/>\nabout their employment. It is also our hope that they will stop making<br \/>\nsecret sweetheart deals, and allow the musicians who do the work to<br \/>\nparticipate in their own livelihoods. In the meantime, following the<br \/>\nprocedure outlined above will help us protect ourselves<\/p>\n<p>&#8212;&#8212;-<\/p>\n<p>CONTRACTOR RESPONSE TO THE RMA<\/p>\n<p>Dear Committee: I have a response to the RMALA article re: video game<br \/>\nscoring sessions. Please feel free to disseminate and \/or print this response.<\/p>\n<p>It&#8217;s up to the contractor of the video game session to notify the musicians<br \/>\nabout the rates and terms of the video game scoring sessions that they&#8217;re<br \/>\ncontracting. Every contractor knows this information and it&#8217;s their<br \/>\nresponsibility to notify the players when offering work and to give the players<br \/>\nthe option of playing or not. I do this by email which makes it incredibly easy.<br \/>\nMy players are fully aware of what they&#8217;re being engaged for and, incidentally,<br \/>\nnot one musician has refused work due to terms or wages. The order of<br \/>\ncommand for disseminating information to the musicians is thus:<\/p>\n<p>1. The contractor<br \/>\n2. Your local union<br \/>\n3. AFM<\/p>\n<p>If John Acosta doesn&#8217;t have the information, he can call the AFM or the<br \/>\ncontractor and find out. Or better yet, the contractor should have an<br \/>\nopen dialog with your Local. I, personally, prefer to have Savina Ciaramella<br \/>\nat the AFM continue to pursue work by cementing relationships with the<br \/>\nvideo game industry and composers&#8230;. as she has been doing very effectively&#8230;,<br \/>\nrather than answer your phone calls which should be directed to your<br \/>\ncontractor or local union. It difficult to imagine that RMALA wouldn&#8217;t see this<br \/>\nas the obvious solution. READER COMMENTS<\/p>\n<p>The views expressed here are those of the participating readers and not<br \/>\nnecessarily those of the COMMITTEE.<\/p>\n<p>12 or more years ago  when Seattle reared it&#8217;s ugly head and decided to offer<br \/>\nrecordings for cash and carry, It was then that the AFM and local 47 had to<br \/>\naddress the reasons why Seattle would become successful, and it was then that<br \/>\nwe had to look for ways to KEEP employers &#038; composers in LA recording. But<br \/>\nthat didn&#8217;t happen because a small but mighty group (RMALA-elite) decided it<br \/>\nwas THEIR way or the highway &#8211; and that small but mighty group owned the local<br \/>\n47 elected officials who were on the International Executive Board of the AFM. <\/p>\n<p>Things have recently changed AFM wise. The AFM is now at a crossroads but<br \/>\nunfortunately it may be too late. Now, we are in complete chaos and turmoil<br \/>\nbecause the recording scene has the rich getting richer and the poor getting poorer.<br \/>\nThe fact that the AFM and local 47 did not listen to employers needs and preferences<br \/>\ngoes against ALL reality business techniques and practices. Globalization is a<br \/>\nhorrible reality, but it does need to be reckoned with one way or another.<br \/>\nTechnology never reverses itself&#8230;when you can drive to a guys studio in Santa<br \/>\nMonica and watch the Prague Orchestra record your score for about 2 grand an<br \/>\nhour&#8230;..the old way of doing business is OVER. Adapt or die is what needs to<br \/>\nhappen and from what I hear the AFM is NOW ready to do that. Move over RMALA<br \/>\nelite and let the work come back to town with front end benefits &#8211; period&#8230;.(and<br \/>\nsince when is PENSION not considered a form of BACK END)?  You do not have to<br \/>\ndo it and if you stand in the way of those choosing to do it be prepared for the<br \/>\nconsequences. You had a good run from 1966 (when special payments fund was<br \/>\nestablished) till about ten years ago, so don&#8217;t complain. Things have changed and<br \/>\nhopefully it&#8217;s not too late for LA recording community to regain the title of Recording<br \/>\ncapitol of the world. Sad that we are even in a &#8220;place&#8221; like we are right now.<\/p>\n<p>In the words of recently deceased local 47 member HARVEY COHEN<br \/>\n&#8220;Last one left in LA&#8217;s studio scene turn the lights out&#8221;<\/p>\n<p>boy was he ever right&#8230;&#8230;..<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>Comments concerning the Local\u2019s support of the ROPA resolution<br \/>\nand the Pasadena Pops\u2026.<\/p>\n<p>It is very interesting that Local 47 is happy to endorse other groups&#8217;<br \/>\nsupport for the Pasadena Pops musicians. Why hasn&#8217;t Local 47 written<br \/>\na strong statement in behalf of their own members at any point? And<br \/>\nwhy did they not sound the alarm and take action the moment they<br \/>\nknew jobs were in jeopardy? In fact they gave approval of the merger<br \/>\nuntil a frustrated musician was interviewed by the press, and miraculously<br \/>\nLocal 47 immediately filed two Unfair Labor Practices with the Department<br \/>\nof Labor. (One of the ULPs has already been dropped.) <\/p>\n<p>It all started when the Pasadena Pops Orchestra announced that, even though<br \/>\nthey were doing just fine, they were going out of business and selling all<br \/>\nassets to the Pasadena Symphony \u201cfor the good of the community\u201d. It was<br \/>\nmuch more about the Pops conductor getting rid of a bunch of musicians<br \/>\nthat she didn&#8217;t particularly care for, which is against labor law. (And she is<br \/>\nalready lobbying to get a large chunk of the Pasadena Symphony conductor&#8217;s<br \/>\ngig.) Musical organizations are now jumping on the bandwagon to support<br \/>\nsaving the Pops musicians&#8217; jobs. It is probably too little too late already,<br \/>\nand what is going on is just posturing. The Pasadena Pops musicians<br \/>\nthemselves have organized a &#8220;consciousness-raising&#8221; concert this Sunday<br \/>\nevening. Many of these fine musicians have performed with the Pops for<br \/>\nmore than 20 years. The sincere hope is that the concert is not just a musical<br \/>\nfarewell, and that some action can be generated. Local 47 officers have stated<br \/>\nthat there is nothing more to be done until management responds to an<br \/>\ninformation request made in the ULP, which undoubtedly will not happen<br \/>\nuntil after the last Pops concert. Fait accompli, done deal, 65 jobs vanish.<br \/>\nPops musicians have filed many grievances over the years, and with good<br \/>\nreason. There are those who believe that Local 47 officers may also want<br \/>\nthe Pops to go away. How else can you explain such a dismal response<br \/>\nfrom our local. For years there have been rumors about a cozy relationship<br \/>\nwith the orchestra next door in San Gabriel. Makes you wonder if our president<br \/>\nis still playing golf with influential members of the Pasadena Pops Board. The<br \/>\nonly leverage that our union has at this late date is to call a strike on the last<br \/>\nPops concerts of the season on the second weekend of September. Let&#8217;s see<br \/>\n if just this once our union officials will be leaders, even if we have to<br \/>\nembarrass them into it.<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;<\/p>\n<p>Seems very simple to me.  The season didn&#8217;t go away&#8230;.the venue didn&#8217;t<br \/>\ngo away&#8230;.the playing positions didn&#8217;t go away&#8230;in lay terms,  the factory<br \/>\ndid not close or  relocate, nor did the manufacturer re-tool.  The only<br \/>\nchange, is that the same Pops positions will be filled by another group of<br \/>\nworkers.  Still trying to understand why the Union has not insisted that<br \/>\nthe current Pops  (tenured) workforce be given the right of first refusal<br \/>\nfor their summer Pops positions under the &#8220;merger&#8221; agreement.  While<br \/>\nthe Union cannot stop the business transaction between the two<br \/>\norchestras, it surely has the power to negotiate for the players involved.<br \/>\nDoesn&#8217;t it?<\/p>\n<p>I tend to agree with many of the musicians not involved with this directly.<br \/>\nThe Union has known about this since before the current season started<br \/>\nand has only now, only one week prior to the end of the summer season,<br \/>\nmade some kind of &#8220;look what we are doing for those musicians&#8221; effort.<br \/>\nQuite frankly, if any of those Pops musicians find themselves working<br \/>\nnext summer, they will not have their Union to thank.  Wonder who they<br \/>\nwill be?<br \/>\n&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>Dear Committee:<\/p>\n<p>I receive your emails both at the office and at home, and always read<br \/>\nthem.  While I don&#8217;t agree with many of the comments, and while I dislike<br \/>\nthe way in which (what I may consider) opinion, misinformation or downright<br \/>\nlies are sometimes put forward as TRUTH, I do respect the right of free<br \/>\nspeech and the email forum the committee provides.  I have spoken to &#8212;<br \/>\n&#8212;&#8212;- and others, criticizing what I find to be a lack of journalistic due<br \/>\ndiligence in researching and confirming information before it&#8217;s published as<br \/>\nfact. In our litigious land, such scrutiny is not only courteous, but prudent.<\/p>\n<p>This is my first email to the Committee.  I expected at some point to be<br \/>\nreferred to by name (or expletives!) in your emails, and that just occurred<br \/>\nin the August 23, 2007 Blast\/Issue\/Transmission.  What should I call your<br \/>\nemail enterprise? Why &#8220;Committee Communication&#8221;, of course, &#8217;cause I&#8217;m<br \/>\nalways into alliteration.  Anyway, you posted a &#8220;Forward of a letter sent to<br \/>\nthe appointed Secretary, Leslie Lashinsky&#8221;, and since that&#8217;s me, I&#8217;ll respond.<br \/>\nI don&#8217;t remember receiving it, so I&#8217;ll look through the letters on file from those<br \/>\nmusicians resigning and asserting their &#8220;Beck&#8221; rights, or other folders\/piles<br \/>\nwhere it may be sleeping or breeding.  It&#8217;s a good letter &#8211; straight and to the<br \/>\npoint.  I don&#8217;t agree with some of its assumptions, but understand its sense of<br \/>\nurgency and frustration.  I am committed to communication and dialogue.<br \/>\nLet&#8217;s problem solve.  Talk to me. Factual news which directly or indirectly concerns our Local&#8217;s membership,<br \/>\n2.) Informed editorial content,<br \/>\n3.) Uncensored reaction from our readers, and<br \/>\n4.) Reader-submitted announcements.   <\/p>\n<p>They fulfill four different functions, and are subject to four different levels and<br \/>\nstandards of handling.  <\/p>\n<p>The first is factual, the second is reasonable, and the other two are referred content<br \/>\nfrom readers as a public service, and for which we always publicly decline<br \/>\nresponsibility. To fulfill our vision of providing a forum for union musicians to<br \/>\nexercise their right to speak their conscience, free of retribution (but subject o the<br \/>\nbounds of taste and prudence,) we don&#8217;t censor our readers.  <\/p>\n<p>It is absolutely critical that you keep this in mind as you become a subject of<br \/>\npublic interest in your acting position as a Local officer.  <\/p>\n<p>The unprecedented, wide-ranging, and ever-growing interest and support of our<br \/>\nefforts is only due to our readers&#8217; recognition that what we report and comment<br \/>\non is factual, reasonable and, foremost, of vital interest.  We sprang into being,<br \/>\nunpaid and in good faith, when our Local experienced several historic failures in<br \/>\nits duty to serve and protect its members.  Our credibility is our only asset, and it<br \/>\nserves us and our Local not at all to jeopardize it by frivolously trafficking in<br \/>\n\u201cdownright lies\u201d as you put it. That&#8217;s why it has always been our policy, within the<br \/>\ntime limits available to us as volunteers, to verify what we report and promptly<br \/>\ncorrect any inadvertent errors that may be reported to us.  <\/p>\n<p>For the sake of your own credibility, if you want to accuse anyone of spreading<br \/>\n\u201cdownright lies,\u201d you would do well to specify WHAT lies and then make the case<br \/>\nfor WHY they are lies. To date, despite making the request many times, we have<br \/>\nyet to receive substantive challenges to what we have reported.  <\/p>\n<p>Your name only became an issue as part of a letter submitted by a reader &#8211; not<br \/>\nas part of a Committee-generated editorial.   <\/p>\n<p>Also, please note, Ms. Lashinsky, that regardless of your attack on the Committee,<br \/>\nwe printed the advertisement for your upcoming concert &#8211; free of charge, as is<br \/>\nour custom.  <\/p>\n<p>Additionally, there&#8217;s a rumor going around that the COMMITTEE is not removing<br \/>\nnames when requested.  Buffalo bagels.  Every mailing includes an unsubscribe<br \/>\nlink. The process usually unfolds in one of three ways:<\/p>\n<p>1) Most of the time the process is totally automatic. We simply receive the notice<br \/>\nthat a name has been removed.<br \/>\n2) Occasionally, the process doesn&#8217;t work, so the reader informs us that they were<br \/>\nunsuccessful.  In those cases we go in manually and unsubscribe the reader.<br \/>\nBarring notice from a reader, we cannot know of the malfunction, but perhaps it<br \/>\nwill work on the next mailing.<br \/>\n3) In rare cases (Two so far,) the reader will inform us that the remove link does<br \/>\nnot work. We must then go into the system to remove the name, but when we attempt<br \/>\nto do so the system reports that the name cannot be found. In such cases, we need to<br \/>\nlook at the entire list and find the name, which we are willing to do.<\/p>\n<p>If you hear any such rumors, please let us know so we can address them.
