COWARD DU JOUR<\/p>\n<p>It&#8217;s has just been confirmed to us that after<br \/>\nbeing asked why he cannot work towards<br \/>\ngetting rid of the back end<br \/>\nPresident John Acosta was quoted as saying:<br \/>\n&#8220;I can&#8217;t, the RMA would have my head.&#8221;<\/p>\n<p>Coward indeed.<\/p>\n<p>=========================<\/p>\n<p>II. MEMBER COMMENTARY<\/p>\n<p>&nbsp;<\/p>\n<p>Someone recommended I write to the blog when I<br \/>\nsaw your latest post. Rick B told me to do non-union<br \/>\ngigs over the phone. He said: &#8220;Let me put on my<br \/>\ntrumpet hat for you &#8211; I get that you need to do non-<br \/>\nunion gigs in order to make a living so just do it but<br \/>\ndon&#8217;t publicize it.&#8221; He told me several times it<br \/>\nwas OK to do non-union gig but I shouldn&#8217;t post<br \/>\nabout it on Facebook or social media.<\/p>\n<p>Several people can confirm that he said this to<br \/>\nother people as well.<\/p>\n<p>Total Hypocrites<\/p>\n<p>I was also harassed by Gordon which is why<br \/>\nI went to Rick.<\/p>\n<p>They would not direct me to the proper channels<br \/>\nin order to go fi-core. Gordon harassed me over<br \/>\nthe phone and kept asking, &#8220;Why do you want<br \/>\nto go fi-core? You&#8217;re the reason why the union<br \/>\nin hurting.&#8221;<\/p>\n<p>Anyways, I&#8217;m really glad what the blog is doing<br \/>\n&#8211; exposing those criminals. Something has to change.<br \/>\nI&#8217;m tired of selected harassment and I know who that<br \/>\nperson was who was falsely accused and I hope<br \/>\nthey&#8217;ll be getting all of that $$$ back that they spent.<\/p>\n<p>name withheld.<\/p>\n<p>[EC: We have reports, and some reports posted<br \/>\npublicly on facebook, of Pres. I&#8217;m the guy that file<br \/>\ncharges against you. I just spoke to your attorney.<\/p>\n<p>#####: I don&#8217;t think we can discuss that until<br \/>\nfurther proceedings, at this moment. We have<br \/>\nnot had this properly negotiated so we are not<br \/>\nwilling to make a statement.<\/p>\n<p>Grayson: Who are you by the way?<\/p>\n<p>#####: I don&#8217;t have to identify myself.<\/p>\n<p>Grayson: No, you don&#8217;t. I&#8217;m just curious.<\/p>\n<p>#####: I am looking out for the safety of<br \/>\n@@@@<\/p>\n<p>Grayson: Well, I have some information<br \/>\nthat you could find important.<br \/>\n#####1: We can&#8217;t speak on it but, we are<br \/>\nwelcome to listen if you want to tell us<br \/>\nyour standpoint.<\/p>\n<p>Grayson: I just spoke with your lawyer, ********,<br \/>\nand I assured her that there has been a<br \/>\nmisidentification. It&#8217;s unfortunate that<br \/>\nyou even had to incur the cost of an<br \/>\nattorney. You know that this process<br \/>\nis not a legal process, it&#8217;s an internal<br \/>\nunion process by which we are able<br \/>\nto be sure in certain instances or<br \/>\ncircumstances, uh, where musicians<br \/>\nmay or may not have been in violation<br \/>\nof our bylaws.<\/p>\n<p>So, it&#8217;s really an investigative process<br \/>\nnot necessarily disciplinary. So the idea<br \/>\nwas to get a positive identification of<br \/>\nmusicians who are in violation of the rules,<br \/>\nuh, if our identification was incorrect, we<br \/>\nwant to know that too. So obviously the<br \/>\ninterest is not to misidentify people or<br \/>\naccuse people of things that are not<br \/>\nnecessarily true. So, I have received<br \/>\ninformation from some people who<br \/>\nwere there (at the bridge) who confirmed<br \/>\nthat you were not and that is satisfactory<br \/>\nto me so, our intent is to put that in writing<br \/>\nto let you know and also, to let the<br \/>\nFederation know that this is a misidentification,<br \/>\nuh, and that those charges will be withdrawn,<br \/>\num, and for all of that I apologize.<\/p>\n<p>As far as public disclosure the&#8230;..a&#8230;.list of<br \/>\nmusicians that was sent to each musician<br \/>\ncontained every other musician&#8217;s name but,<br \/>\nthat is the extent of the distribution. I sent<br \/>\nthat to the Federation I am sure most<br \/>\nmusicians on that list have a bedded<br \/>\ninterest so other people don&#8217;t know that<br \/>\ndon&#8217;t know that they were on it. So I<br \/>\ndoubt very seriously that the list is<br \/>\nbeing distributed but I can&#8217;t say for<br \/>\ncertain. Uh, it was not my intent to<br \/>\ndistribute that list to every musician.<\/p>\n<p>I sent that to the Federation, the Federation<br \/>\nsent that to every musician so they<br \/>\ncould have redacted it. And in the<br \/>\nfuture, I would try to convince them<br \/>\nto do that. If there ever arose a situation<br \/>\nlike this again, it&#8217;s pretty rare and it&#8217;s<br \/>\npretty new to me to deal with such a<br \/>\nlarge scale so there are things I could<br \/>\nhave done better and I will next time.<\/p>\n<p>So I will put something in writing to you<br \/>\nand your lawyer, I will put something in<br \/>\nwriting to the Federation and then as far<br \/>\nas do not hire list, there is no such list<br \/>\nas of now because these charges are<br \/>\nstill outstanding. There&#8217;s no list out there<br \/>\nthat says don&#8217;t hire<\/p>\n<p>@@@@@, but there are some people<br \/>\nthat might not want to hear from Mark<br \/>\nRobertson but, (awkward laugh) our<br \/>\nunion is not telling anyone not to hire<br \/>\nanybody. You know I would not stand<br \/>\nin the way of any of those musicians<br \/>\nfrom getting union employment because<br \/>\nthat&#8217;s what we come here every day for,<br \/>\nto try to help people look out for themselves<br \/>\nand for their interests. I want to extend an<br \/>\napology; you know it was certainly not<br \/>\nintended. We come here to help musicians.<br \/>\nAnd that&#8217;s the intent here is to keep our<br \/>\ncontracts going and protect the musicians<br \/>\nwho do say no to non-union work. So it&#8217;s<br \/>\nunfortunate that you got caught up in that<br \/>\nand I appreciate how upset you are and<br \/>\nI understand that we didn&#8217;t do it on<br \/>\npurpose we will do everything we can to<br \/>\nnot let that happen again.<\/p>\n<p>[EC: So where&#8217;s his reimbursement<br \/>\nof legal fees? ($15,000) An apology in<br \/>\nno way is enough.,&#8230; no where near.]<\/p>\n<p>================================<\/p>\n<p>IV. Vice President&#8217;s<br \/>\nOffice, 323.993.3172<br \/>\nmerchandise@afm47.org, 3220 Wiwona Ave.<br \/>\nBurbank, CA 91504, to receive instructions on<br \/>\nreturning your product(s)<\/p>\n<p>&nbsp;<\/p>\n<p>COLLEAGUES,<\/p>\n<p>So, we&#8217;ve established that dues are non-refundable,<br \/>\nbut it does not say membership dues cannot be<br \/>\ntransferred for use as fi-core dues.<br \/>\n(In fact we now have proof that they do, more<br \/>\ninfo next week)<\/p>\n<p>While the secretary said an additional packet of<br \/>\ninformation was sent, Mr. Fernandez has not as<br \/>\nof yet received it and has requested another.<\/p>\n<p>THE BYLAWS<\/p>\n<p>Checking the AFM BYLAWS<br \/>\nARTICLE 5\u2013LOCALS\u2019 RIGHTS &amp; DUTIES<br \/>\nLocal Dues and Fees Authorities &#8211; Page 28<\/p>\n<p>It says nothing.<\/p>\n<p>The words Fi-Core, Financial Core<br \/>\nand Beck Status do not appear in the<br \/>\nAFM Bylaws we have.<\/p>\n<p>Therefore, the Local cannot pretend<br \/>\nto have a policy preventing the transfer<br \/>\nof membership dues paid to be applied<br \/>\nto FI-Core dues if a member chooses<br \/>\nto go fi-core.<\/p>\n<p>To be fair, it can also be said that there<br \/>\nis no policy ALLOWING the transfer of<br \/>\nfunds for fi-core membership.<\/p>\n<p>This would seem to leave it up to the ethics<br \/>\nand consideration of the administration.<\/p>\n<p>If you&#8217;re an ethical Local, you&#8217;ll allow the<br \/>\ntransfer of membership dues to fi-core<br \/>\ndues, save musicians money and<br \/>\nrefund anyone double charged.<\/p>\n<p>Will they do the right thing and refund<br \/>\nMr. Fernandez&#8217; double charging?<\/p>\n<p>If they are ethical they will,<br \/>\nif they aren&#8217;t they won&#8217;t. If they<br \/>\ndon&#8217;t, to our thinking this means<br \/>\nthey are guilty of defrauding<br \/>\neach member they do this to.<\/p>\n<p>Let&#8217;s just say we won&#8217;t hold our<br \/>\ncollective breaths.<\/p>\n<p>Any thoughts? (read<br \/>\nthem here)\u00a0These documents reveal<br \/>\nthat the pension trustees have been<br \/>\nplanning cuts to our pension benefits<br \/>\ngoing all the way back to August of 2015.<br \/>\nAccording to those documents the<br \/>\ntrustees are targeting a 25-30% cut<br \/>\nto existing benefits.<\/p>\n<p>\u2022 \u00a0 \u00a0On January 4, 2018, in a letter to<br \/>\nCongressional leaders, our trustees<br \/>\ndeclared that our pension plan \u201cis on<br \/>\nthe brink of entering critical and declining<br \/>\nstatus in the near future.\u201d (Read the<br \/>\nJanuary 4 letter here.) MPS believes<br \/>\nthe trustees could set a MPRA<br \/>\napplication into motion as early as<br \/>\nJune 2018, which starts the process<br \/>\nthat allows the trustees to cut our<br \/>\nbenefits.<\/p>\n<p>\u2022 \u00a0 \u00a0MPS hired Tom Lowman, a<br \/>\nnationally recognized pension actuary,<br \/>\nto review the situation. At the March 21<br \/>\nmeeting, Tom will show how our trustees<br \/>\nare proceeding upon questionable<br \/>\nassumptions that we would like to<br \/>\nchange and will explain why. Tom<br \/>\nLowman thinks that delaying cuts<br \/>\nand working on improving the funding<br \/>\nis the way to go. COMMENTS<\/p>\n<p>Well&#8230;well&#8230;so they could not even credit Fernandez with<br \/>\nthe dues he already paid? \u00a0They did have a published<br \/>\npolicy on how monies received would be applied&#8230;e.g.<br \/>\nAnnual dues, work dues (past) or (present)&#8230;etc. \u00a0I<br \/>\ndon&#8217;t recall seeing anything about fi-core funds&#8230;<br \/>\nand btw I would say paying twice for the same time<br \/>\nperiod is providing the union with unjust enrichment&#8230;<br \/>\nthey get almost twice as much while you get less than<br \/>\nhalf as much&#8230;hmmm.<\/p>\n<p>They should be able to confirm when such a policy<br \/>\nwas initiated and where was it first posted?<\/p>\n<p>Does the local actually have a policy regarding dual<br \/>\npayments that explains how and why they should<br \/>\nbe able to keep two payments for the same period?<\/p>\n<p>I would argue that if they want to keep the regular<br \/>\nannual dues then you should be able to use their<br \/>\nfacilities for the year.<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>At least keeping both payments for the whole<br \/>\nyear should not be a policy&#8230;perhaps some kind<br \/>\nof pro-rate? \u00a0Do you think that they do this to<br \/>\nincentivize people from going if-core during any<br \/>\ngiven year&#8230;having to pay more to a union that<br \/>\ndoes everything it can to keep union work<br \/>\nconfined to a few?<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>Kinda reminds me of the current white house s\u2022\u2022\u2022 show &#8211;<br \/>\nMarc Sazer suing because he&#8217;s not getting hired &#8211; good god &#8211;<br \/>\nwhat entitlement -the RMALA is going to drive every last<br \/>\nsession out of town except for the few that they&#8217;ll do at<br \/>\nthe one major studio left &#8211; what reasons do we have to<br \/>\nbe union anymore &#8211; my work dues were ZERO last month &#8211;<br \/>\nI&#8217;m not going to help them in upcoming negotiations as<br \/>\nthey were requesting input from rank and file recording peeps &#8211;<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>WOW&#8230;.<\/p>\n<p>Great public record&#8230;maybe should ask John Acosta what he<br \/>\nthinks of the Sazer suit? LOL!<\/p>\n<p>&nbsp;<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>&nbsp;<\/p>\n<p>freelance players are not subject to tenure unless there is a<br \/>\nprovision for it in the collective bargaining agreement.<br \/>\nTo my knowledge there are no more &#8220;studio orchestras&#8221;<br \/>\nas was in the &#8220;golden age&#8221; of studio cinema&#8230;the players<br \/>\nshowed up and worked an essentially 9-5 job.<\/p>\n<p>The RMA has (by design and from the beginning tried<br \/>\nand very much) succeeded in creating a de facto tenure<br \/>\nfor themselves where there was none.<br \/>\nYou are either IN or OUT of their &#8220;club&#8221;.<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>&nbsp;<\/p>\n<p>IF the DOL had the will, they could see what the RMA<br \/>\nhas done to disenfranchise the majority of the membership.<br \/>\nThey kicked out Bernie Fleischer because he wouldn&#8217;t<br \/>\ngo along. \u00a0 Only need to show that SDC was installed<br \/>\nin the Local by the RMA&#8230;the secretary to the deceased<br \/>\nmusic contractor at Universal&#8230;.a few people made<br \/>\nboatloads of $$$.<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>Another colleague says&#8230;.<\/p>\n<p>Not happy to consider a dead union&#8230;.because it is<br \/>\nthe people in charge of THIS local that are the<br \/>\nproblem&#8230;unionism via the union movement<br \/>\nhas helped a great many people in many industries.<\/p>\n<p>[The committee has been and always will<br \/>\nbe pro-union. But we&#8217;re pro &#8220;ethical&#8221; union,<br \/>\nnot a corrupt one.]<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>JA has his eyes on achieving big labor union leader<br \/>\nstatus (not necessarily with AFM)&#8230;the EB spends<br \/>\nthe local dues flying him all over to &#8220;promote&#8221;<br \/>\nthe Local&#8230;in reality he is using those resources<br \/>\nto promote himself&#8230;there is no political<br \/>\nphoto-op he won&#8217;t chase. \u00a0Really&#8230;what kind<br \/>\nof return did LA get by handing out CD&#8217;s to<br \/>\nthe Chinese? \u00a0What did be actually do in<br \/>\nHavana besides giving out priestly handshakes?<\/p>\n<p>Does anyone know if JA has ever worked<br \/>\nunder a collective bargaining agreement<br \/>\nas a playing musician?<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<p>&#8230;.. The 2018 festival on Saturday, July 21st<br \/>\nat the Barnsdall Gallery Theatre is presented by<br \/>\nHelix Collective\u00a0in collaboration with the<br \/>\nAcademy of Scoring Arts. Films for the 2018 festival<br \/>\nare curated by the faculty at the New York Film<br \/>\nAcademy, Columbia College, Hollywood, and<br \/>\nthe L.A. Film School.<\/p>\n<p>Selected film composers are paired with a winning<br \/>\nfilmmaker to create an original score for the festival.<br \/>\nThe film is screened with the score performed live<br \/>\nby the renowned performance and recording ensemble,<br \/>\nHelix Collective. The screening includes an interview<br \/>\nwith the filmmakers and composers. Awards for Best<br \/>\nPicture and Best Musical Score are presented at the<br \/>\nclose of the festival.<\/p>\n<p>Now in it\u2019s fifth season, LALSFF\u2019s goal is to highlight<br \/>\nthe role of collaboration between composers and<br \/>\nfilmmakers. Acting like a talent agent, the festival<br \/>\nbrings experts in the two disciplines together.
