SMALL PETTY PEOPLE<br \/>\nA (REGRETFULLY LONG w\/apologies) MESSAGE FROM CHARLES FERNANDEZ<\/p>\n<p>When I was illegally charged by Local 47 for my<br \/>\nconducting and attending an educational demo<br \/>\nsession I knew it wasn&#8217;t about the session, it<br \/>\nwasn&#8217;t even about the CMG (Collective Media<br \/>\nGuild) it was about the Blog, the one you&#8217;re<br \/>\nreading now.<\/p>\n<p>Since 2005 the AFM and Local have been<br \/>\ndesperate to shut it down.<br \/>\nTHANK YOU 1st amendment.<\/p>\n<p>So I ultimately paid their illegal, unethical fine,<br \/>\nand went fi-core.<\/p>\n<p>According to the rules, you cannot use<br \/>\nUnion facilities if you&#8217;re fi-core. That&#8217;s fine,<br \/>\nHowever, if an outside organization<br \/>\nuses a room at the union, that organization<br \/>\ncan have anyone at the meeting they want.<br \/>\nIf they can have non-union people at<br \/>\ntheir meeting they can have fi-core people<br \/>\nas well, as long as the fi-core musician<br \/>\ndoesn&#8217;t play, EXCEPT in the case of a<br \/>\npaid rehearsal, in such a case the union<br \/>\nmust allow the Fi-Core musician in under<br \/>\na CBA.<br \/>\n.<br \/>\nThose running the Local thought when I went<br \/>\nfi-core the blog would disappear, but the<br \/>\nmembership has made sure that hasn&#8217;t happened.<br \/>\nWe&#8217;ve been getting some explosive stuff<br \/>\n(MAKE SURE YOU READ &#8216;BLUE BOY&#8217; BELOW<br \/>\n&#8211; it&#8217;s important).<\/p>\n<p>WHAT&#8217;S A LOCAL TO DO?<\/p>\n<p>So what&#8217;s an RMA controlled Local to do?<br \/>\nGo scorched earth, and abuse the power of the<br \/>\nLocal they control through a complicit officer<br \/>\nto destroy one member they have a personal<br \/>\ngrudge against, as well as try to destroy their<br \/>\nrelationship with any musical organization they<br \/>\nare affiliated with, in this case ASMAC (American<br \/>\nSociety of Music Arrangers and Composers<br \/>\n&#8211; ASMAC.org).<\/p>\n<p>For the past 15+ years I have been a<br \/>\nboard member, sometimes secretary,<br \/>\nsometimes vice-president of this 80<br \/>\nyear old proud and important organization.<br \/>\nAs long as I have been a member,<br \/>\nit has met at the union.<\/p>\n<p>Now however, they will no longer allow<br \/>\nour group at the union if I am there.<br \/>\nAgain, an officer abusing their authority<br \/>\nagainst one individual member for personal<br \/>\nreasons. There are other non union<br \/>\nmembers on the ASAMC board, but<br \/>\nthis is directly solely at me as an<br \/>\nindividual.<\/p>\n<p>Why? The excuse is I &#8220;made a scene&#8221; when<br \/>\nI went Fi-core, but again this an excuse.<br \/>\nIt&#8217;s all about the blog. They&#8217;re willing to sacrifice<br \/>\na decades long relationship with a storied<br \/>\nmusical organization through countless AFM<br \/>\nadministrations because of their petty<br \/>\npersonal vendetta against one person.<br \/>\nUtterly pathetic and small.<\/p>\n<p>If this were any other business the offending<br \/>\npersons would be fired and likely sued, but not<br \/>\nat Local 47.<br \/>\n.<br \/>\nSO WHAT HAPPENED?<br \/>\nDOUBLE CHARGING.<\/p>\n<p>When I went to go fi-core I had already paid the full<br \/>\nyearly membership dues for 2018 ($210). I was told<br \/>\nthat didn&#8217;t matter and had to pay an ADDITIONAL<br \/>\n$175 fi-core fee. As would be the case with anyone,<br \/>\nthis upset me.<\/p>\n<p>I asked why it couldn&#8217;t be deducted from the dues I<br \/>\nalready paid and was told it was policy. I had a<br \/>\ndiscussion with Secretary Gary Lasley and left<br \/>\n(we&#8217;ve since communicated by email, where I<br \/>\napologized for getting upset, he wrote back and<br \/>\nwe&#8217;re fine, according to both of us.)<\/p>\n<p>Last Wednesday, March 6TH, I wrote to the secretary<br \/>\nand formally requested the chapter and verse that<br \/>\nallows the local to double charge those who choose<br \/>\nfi-core status if they&#8217;ve paid their reg member dues.<br \/>\nAs of this writing, I have not heard from him. I will<br \/>\ncertainly keep writing until I do. If, as I suspect, I am<br \/>\ntold that as a non-member I am not entitled to that<br \/>\ninformation, perhaps one of you fine upstanding<br \/>\nLocal 47 members out there can make the same<br \/>\nrequest and send us the reply.<\/p>\n<p>But again, this isn&#8217;t about my conduct going fi-core,<br \/>\nit&#8217;s about the blog not shutting down, it&#8217;s about<br \/>\nhurting me and anyone associated with me in<br \/>\nany way they can to get me to stop the blog<br \/>\nand further damage my career and relationships<br \/>\nin the business.<\/p>\n<p>Petty and small indeed.<\/p>\n<p>SHUTTING DOWN THE BLOG<\/p>\n<p>It&#8217;s not going to happen.<\/p>\n<p>I don&#8217;t believe the secretary is behind this, since<br \/>\nwe&#8217;ve talked, I don&#8217;t believe VP Rick Baptist is<br \/>\nbehind it, he worked for me for many years in<br \/>\nthe studios. A consummate professional, No<br \/>\none gives waa&#8217;s and wop&#8217;s like Rick. That leaves<br \/>\nonly one officer and the group that he is beholden to.<\/p>\n<p>This is how small, how petty, how subservient<br \/>\nthe Executive Board of Local 47 is to the people<br \/>\nwho really run the union. No backbone, No shame.<\/p>\n<p>The one I am most disappointed in is Vice President Rick<br \/>\nBaptist, who I&#8217;ve known for decades as a stellar musician<br \/>\nand person but who has seemingly become subservient to<br \/>\nJohn Acosta and his handlers. I expected he would stand<br \/>\nup for what is right and in defense of the rank and file. It pains<br \/>\nme to learn otherwise. He been doing Acosta&#8217;s dirty work<br \/>\nin sending letters and busting sessions. Why can&#8217;t John<br \/>\ndo it himself? Won&#8217;t look good in pictures or documentation<br \/>\nI suppose.<\/p>\n<p>No organization or member deserves this treatment by<br \/>\nsuch a small petty group of people. If this upsets you<br \/>\nand you have the conviction to actually speak up (I&#8217;m<br \/>\nlooking at you Local 47 board members) it&#8217;s about<br \/>\ntime you did so. How long will you allow the<br \/>\nrank abuse of the officer&#8217;s power against individual<br \/>\nmusicians to go on? Again, make sure to<br \/>\nread BLUE BOY below. This goes for the rank and<br \/>\nfile as well. What will it take to get more musicians<br \/>\nto stand up and say &#8220;I&#8217;m mad as Hell and I&#8221;m not<br \/>\ngoing to take it any more&#8221;.<\/p>\n<p>The abuse and selective enforcement this Local<br \/>\nand it&#8217;s handlers have engaged in without<br \/>\nconscience and without precedent is deplorable.<\/p>\n<p>In my learned opinion. This Local is no longer a<br \/>\nsolution for the rank and file, it is the problem.<\/p>\n<p>CHARLES FERNANDEZ<\/p>\n<p>============================<\/p>\n<p>II. \u00a0 BLUEBOY SPEAKS<br \/>\nNoticed that your recent leaks have generated quite<br \/>\nthe reaction from the RMA cronies. I am also wondering<br \/>\nif you have any IP address of the user which tried to<br \/>\nhack your blog. I am nearly sure that the SMIRK tried<br \/>\nto hack a few of us&#8230;I have IP addresses to share.<br \/>\nI am sending you screenshots from a video that<br \/>\nwas sent to me by a friend of the musician who<br \/>\nwas falsely accused at the &#8220;busted bridge session&#8221;.<\/p>\n<p>[EC: We have an IP address or two to share as well.]<\/p>\n<p>I have been authorized to allow you to post these.<br \/>\nThe video in its entirety will be posted very soon.<\/p>\n<p>The musician has been harassed because of a<br \/>\n&#8220;union error&#8221; (which is more or less an RMA-<br \/>\nsponsored targeting operation) has incurred<br \/>\nmore than $15,000 in legal defense fees to<br \/>\nfight the union to restore their good name.<\/p>\n<p>The local sent around the name of this person<br \/>\nwith their name, address and phone number<br \/>\nattached to a photo of A DIFFERENT PERSON.<br \/>\nThis musician was not even present at the<br \/>\nalleged &#8220;bridge session&#8221;. All our bosses got<br \/>\nthis list through &#8220;back channels&#8221;.\u00a0 Erick Cruz<br \/>\nwas, in fact, the official who made the false<br \/>\nidentification. It would later be Gordon who<br \/>\ntook the fall.<\/p>\n<p>Gordon and Erick followed this member into<br \/>\nthe parking lot after a business visit and,<br \/>\nessentially tried to intimidate and discourage<br \/>\nthem. The member said nothing and Gordon<br \/>\nwent on a wild rant, made snide comments<br \/>\nabout a fellow member\/contractor and gave a<br \/>\nsoftball &#8220;apology&#8221; all while scolding the member<br \/>\nfor retaining a lawyer. The local still refuses to<br \/>\nrectify the distribution of fraudulent charges.<\/p>\n<p>The member was also bullied in an attempt for<br \/>\nthem to sign an unlawful NDA (non-disclosure<br \/>\nagreement) in exchange for an apology and a<br \/>\ntiny sum of taxable reimbursement.<\/p>\n<p>The member is in the process of filing a civil complaint.<\/p>\n<p>The member wants a proper apology but, John<br \/>\nAcosta refuses to print or post it all while hiding<br \/>\nbehind the &#8220;decisions&#8221; made by his &#8220;executive<br \/>\nboard&#8221;.<\/p>\n<p>We can post it for them: I can&#8217;t say the union<br \/>\nwas not warned multiple times&#8230;&#8230;..Gordon<br \/>\nlost his job because of this&#8230;..who else thinks<br \/>\nits time for Acosta to lose his job over this?<\/p>\n<p>PS: The RMA sent out a freakin love letter<br \/>\nthanking Gordon for his service after he got<br \/>\nthe boot. Why else would the RMA thank<br \/>\nhim unless he had been doing their dirty<br \/>\nwork?! A staunch labor advocate,<br \/>\nGordon had previously worked at the Writers<br \/>\nGuild of America West. As he moves on, we<br \/>\nwould like to express our gratitude for his<br \/>\nyears of dedicated, straight-shooting service<br \/>\nto our Local, and to our musicians working in<br \/>\nrecording. Charles Fernandez as well incurred<br \/>\nover $15,000 in legal fees fighting bogus<br \/>\ncharges instituted by Gordon Grayson but all<br \/>\nassisted by John Acosta.<\/p>\n<p>In Mr. Fernandez&#8217;s Hearing, though Grayson<br \/>\nwas asked the questions, he didn&#8217;t seem to<br \/>\nknow any of the details and had to be assisted<br \/>\nin answering most questions by consulting<br \/>\nJohn Acosta. (Picture Cheney having to be in<br \/>\nthe room when Bush Jr. was interviewed)<br \/>\nThough Grayson filed the charges,<br \/>\nAcosta was the force behind them.<\/p>\n<p>You can find the transcript online and<br \/>\nread it for yourself.<\/p>\n<p>Regarding the session where Mr. Fernandez<br \/>\nwas targeted, there were two musicians<br \/>\nseen in pictures playing the entirety of the<br \/>\nnonunion session . The cellist who signed a<br \/>\nletter stating they saw Mr Fernandez conducting<br \/>\n(NOT against the bylaws) was STEVE VELEZ,<br \/>\nwho then escaped any fine, and led directly<br \/>\nto Mr. Fernandez&#8217;s $15,000+ in legal costs.<br \/>\nThe violist who refused to fraudulently target<br \/>\nMr. Fernandez was fined initially $400.<\/p>\n<p>Mr. Fernandez, though no bylaw was broken<br \/>\nwas fined $2,500 for simply being at the session<br \/>\nas an educator.<\/p>\n<p>This conduct shows NO ethics, NO morals<br \/>\nand NO conscience.Such behavior cannot<br \/>\nbe tolerated in any legitimate organization.<\/p>\n<p>We want to know your story of abuse by<br \/>\nthis Local and the National AFM. UPDATE ON NATIONAL MPS MEETING<br \/>\nLocation Confirmed<\/p>\n<p>Save the date:<br \/>\nNationwide Meeting for all AFM Musicians<br \/>\nMarch 21, 2018 at 5pm<br \/>\nSt. Malachy&#8217;s Church<br \/>\n239 W 49th St, New York, NY<br \/>\nLIVE STREAMING ON FACEBOOK<\/p>\n<p>BREAKING AFM PENSION NEWS!<\/p>\n<p>\u2022\u00a0\u00a0 \u00a0Musicians for Pension Security recently<br \/>\nobtained the AFM-EPF trustees\u2019 own<br \/>\ndocuments\u00a0made public by law. (read them<br \/>\nhere)\u00a0These documents reveal that the<br \/>\npension trustees have been planning cuts<br \/>\nto our pension benefits going all the way<br \/>\nback to August of 2015. According to those<br \/>\ndocuments the trustees are targeting a<br \/>\n25-30% cut to existing benefits. *MPS<br \/>\nnow believes the trustees could set a<br \/>\nMPRA application into motion as early as<br \/>\nJune 2018, which starts the process that<br \/>\nallows the trustees to cut our benefits.<\/p>\n<p>\u2022\u00a0\u00a0 \u00a0MPS hired Tom Lowman, a nationally<br \/>\nrecognized pension actuary, to review the<br \/>\nsituation. At the March 21 meeting, Tom<br \/>\nwill show how our trustees are proceeding<br \/>\nupon questionable assumptions that we<br \/>\nwould like to change and will explain why.<br \/>\nHe will present a plan to stabilize our<br \/>\npension in the near term and will recommend<br \/>\nmeasures to assure the long-term stability<br \/>\nof the plan.<\/p>\n<p>\u2022\u00a0\u00a0 \u00a0Tom Lowman thinks that delaying cuts<br \/>\nand working on improving the funding is<br \/>\nthe way to go. Cutting benefits now may<br \/>\nresult in larger cuts than needed. Also,<br \/>\ncutting now while hoping to restore some<br \/>\nof those cuts later would be difficult.<br \/>\nHe will explain why at the March 21 meeting.<\/p>\n<p>\u2022 \u00a0 \u00a0You will also hear from Jonathan<br \/>\nKantor, our legal counsel, who will<br \/>\nexplain the process that our trustees<br \/>\nare following to obtain the cuts, together<br \/>\nwith legal options that they &#8212; and we &#8212;<br \/>\nhave.<\/p>\n<p>It is critical that all AFM members make<br \/>\nevery effort to attend\u00a0this meeting.
