We<br \/>\nonly want to report the facts.]<\/p>\n<p>Please post this.<br \/>\nWho will sue the Federation? How dare they<br \/>\ngive someone tenure, especially for political<br \/>\nreasons. I know Sazer is turning in people.<br \/>\nGood people. Did others?<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>&nbsp;<\/p>\n<p>DEMAND LETTER SENT TO GINA ZIMMITTI<br \/>\nThis is a public record.<\/p>\n<p>[EC: We contacted the member who sent this to us asking<br \/>\nfor verification of it&#8217;s origin. This is the reply we got:<\/p>\n<p>To the Committee: &#8220;this document was made public<br \/>\nto me and my use of it was approved by a party<br \/>\nthat had permission to circulate. Not stolen or<br \/>\nlifted.<\/p>\n<p>Further, here is a link to the NLRB page of this matter:<br \/>\nhttps:\/\/www.nlrb.gov\/case\/31-CA-179630]<\/p>\n<p>&#8212;&#8212;&#8211;<\/p>\n<p>The American Federation of Musicians (&#8220;AFM&#8221;) and Gina<br \/>\nZimmitti Music Contracting (&#8220;GZMC), agree to resolve<br \/>\na charge made by the AFM to the National Labor Relations<br \/>\nBoard (&#8220;NLRB&#8221;) on July 1, 2015, (Case No. 31-CA-179630)<br \/>\nregarding Marc Sazer (&#8220;Sazer&#8221;) as follows:<\/p>\n<p>1. Music scoring work is intermittent. With that reality,<br \/>\nit is the intent of the AFM and GZMC to return Sazer&#8217;s<br \/>\nemployment on music scoring projects contracted by GZMC<br \/>\nto the level that existed before 2015 (approximately<br \/>\n85% of days contracted by GZMC on major motion picture<br \/>\nprojects and about 65% of days contracted by it on<br \/>\nall projects.<\/p>\n<p>2. To achieve that, from the date this Agreement is<br \/>\nexecuted, GZMC will cause Sazer to be hired for music<br \/>\nscoring projects it contracts with the same frequency<br \/>\nas it caused him to be hired prior to 2015. Specifically,<br \/>\nGZMC will cause Sazer to be hired on substantially<br \/>\nall music music scoring projects requiring a string<br \/>\nsection and an orchestra of 30 or more musicians,<br \/>\nin addition to some music scoring projects requiring<br \/>\nfewer than 30 musicians (as it did prior to 2015).<\/p>\n<p>3. As soon as practicable, but in no event later than<br \/>\n14 days of the execution of this Agreement, the AFM<br \/>\nwill withdraw the charge in Case No. 31-CA-179630.<br \/>\nBut the AFM can reinstate the charge, or file a new<br \/>\nNLRB charge, in the event it determines that GZMC<br \/>\nhas failed to comply with the obligations of<br \/>\nParagraph 2.<\/p>\n<p>4. By entering into this Agreement, GZMC admits no<br \/>\nliability or fault and specifically does not admit<br \/>\nthat it engaged in the conduct described in the<br \/>\ncharge. Similarly, the AFM reserves its position<br \/>\nthat GZMC engaged in the conduct alleged in the<br \/>\ncharge.<\/p>\n<p>5. GZMC and the AFM agree that the terms of this<br \/>\nAgreement shall remain strictly confidential, except<br \/>\nthat they also agree that they may be disclosed to<br \/>\nSazer, and may be disclosed to others for the limited<br \/>\npurpose of carrying out the parties&#8217; rights and<br \/>\nobligations under this Agreement.<\/p>\n<p>[Colleagues, you can see the case page for the above at<br \/>\nhttps:\/\/www.nlrb.gov\/case\/31-CA-179630] So for anyone<br \/>\nnot believing in the gross level of control the RMA<br \/>\ncontinues to have over the AFM, this should be all the<br \/>\nproof you need.<\/p>\n<p>Only someone high up in in the RMA could get the<br \/>\nAFM\/IEB to write a letter trying to force a contractor<br \/>\nto use a player they no longer wanted to use.<br \/>\nIt&#8217;s freelancing, unless you&#8217;re an RMA officer,<br \/>\nin which case they MUST be used, right?<\/p>\n<p>As was told to us. POTENTIAL BENEFIT CUTS &#8211; MPS<\/p>\n<p>DOCUMENTS SHOW TRUSTEES KNOW MORE<br \/>\nTHAN THEY REVEAL ABOUT POTENTIAL FOR BENEFIT CUTS<\/p>\n<p>AFM President Ray Hair hosted a \u201cWebinar\u201d for<br \/>\npension plan participants on January 29. When<br \/>\nasked, President Hair and the other participants<br \/>\nwould not shed any light on the extent of the<br \/>\npossible benefit cuts: \u201cAt this time, we just don\u2019t<br \/>\nknow,\u201d they said. Hair and the other trustees may<br \/>\nnot know exactly how extensive or when the cuts<br \/>\nwill happen, but according to their own documents<br \/>\nrecently obtained by MPS (linked below), it seems<br \/>\nthat they know far more about the potential for<br \/>\nbenefit cuts then they let on. Here is a summary:<\/p>\n<p>1. The trustees began actively considering cutting<br \/>\nour pensions beginning at their August 4, 2015<br \/>\nmeeting, targeting 25-30% cuts beginning in<br \/>\nFebruary 2016. (Supporting docs here)<\/p>\n<p>2. It took Ray Hair and our other trustees a year<br \/>\nand a half after that August 2015 meeting before<br \/>\nthey snuck the bad news of potential cuts to<br \/>\nexisting benefits into a letter to plan participants<br \/>\nin December of 2016. (Read it here)<\/p>\n<p>3. It is true that the trustees have not formally<br \/>\ndecided to make the cuts yet. That decision<br \/>\nwill be made in June of this year. However,<br \/>\nthe trustees\u2019 last \u201cBase Case\u201d (what they<br \/>\nexpect to happen) projection from just two<br \/>\nmonths ago, dated December 18, 2017,<br \/>\ncalls for cuts in 2018 (Projections here).<\/p>\n<p>4. The prospect of cuts to our existing benefits<br \/>\nis so real that the AFM fund\u2019s actuary, Milliman,<br \/>\nis already engaged in discussions with the key<br \/>\nmembers of the US Treasury, which will be<br \/>\nmaking the decision whether or not to approve<br \/>\nthe cuts. In those discussions, Treasury gave<br \/>\n\u201cinformal nonbinding guidance\u201d on how best to<br \/>\nfashion the cut application. These discussions<br \/>\nwere initiated on November 1, 2017. (See here.)<\/p>\n<p>The AFM-EPF trustees have repeatedly pledged<br \/>\nto be transparent with us and yet none of the<br \/>\nabove information was discussed or revealed<br \/>\nin January when the trustees were asked about it.<\/p>\n<p>Keep in mind, the AFM-EPF webinar in late January<br \/>\nwas just six weeks after the trustees were discussing<br \/>\nbenefit cuts at their December 18, 2017 meetings.<br \/>\nWhen asked about cuts AFM President Ray Hair<br \/>\nonly said, \u201cAt this time, we just don\u2019t know,\u201d but<br \/>\naccording to their own documents, he and the<br \/>\nother trustees have a very good idea.<\/p>\n<p>In solidarity,<\/p>\n<p>Musicians for Pension Security<\/p>\n<p>Stay informed with MPS. Click\u00a0HERE.<\/p>\n<p>========================<\/p>\n<p>&nbsp;<\/p>\n<p>IV.NATIONWIDE MPS MEETING<\/p>\n<p>March 21, 2018 at 5pm<br \/>\nNew York City (venue\u00a0TBA)<br \/>\nLIVE STREAMING ON FACEBOOK<\/p>\n<p>BREAKING AFM PENSION NEWS!<br \/>\n\u2022\u00a0\u00a0 \u00a0Musicians for Pension Security recently obtained the<br \/>\nAFM-EPF trustees\u2019 own documents\u00a0made public by law.<br \/>\n(read them here)\u00a0These documents reveal that the<br \/>\npension trustees have been planning cuts to our pension<br \/>\nbenefits going all the way back to August of 2015.<br \/>\nAccording to those documents the trustees are targeting<br \/>\na 25-30% cut to existing benefits. MPS now believes<br \/>\nthe trustees could set an MPRA application into motion<br \/>\nas early as June 2018, which starts the process that<br \/>\nallows the trustees to cut our benefits.<\/p>\n<p>\u2022\u00a0\u00a0 \u00a0MPS hired Tom Lowman, a nationally recognized<br \/>\npension actuary, to review the situation. At the March<br \/>\n21 meeting, Tom will show how our trustees are<br \/>\nproceeding upon assumptions that we would like<br \/>\nto change and will explain why. He will present a<br \/>\nplan to stabilize our pension in the near term and<br \/>\nhe will recommend measures to assure the long-<br \/>\nterm stability of the plan.<\/p>\n<p>\u2022\u00a0\u00a0 \u00a0Tom Lowman thinks that delaying cuts and<br \/>\nworking on improving the funding is the way<br \/>\nto go. Cutting now may result in larger cuts<br \/>\nthan needed and cutting now while hoping<br \/>\nto restore some of those cuts later would<br \/>\nbe difficult. He will explain why at the March<br \/>\n21 meeting.<\/p>\n<p>\u2022\u00a0\u00a0 \u00a0At the meeting you will also hear from<br \/>\nJonathan Kantor, our legal counsel, who<br \/>\nwill explain the process that our trustees<br \/>\nare following to obtain the cuts, together<br \/>\nwith legal options that they &#8212; and we &#8212; have.<\/p>\n<p>It is critical that all AFM members make<br \/>\nevery effort to attend\u00a0this meeting.
