MPS<\/p>\n<p>Dear Fellow Musicians,<\/p>\n<p>Our American Federation of Musicians pension fund has been<br \/>\nheading toward a crisis for decades. As a result, the pension<br \/>\nfund trustees are now considering making considerable cuts<br \/>\nto our pension benefits. After a lifetime of paying into a system<br \/>\nwe were promised would support us in our retirement, the<br \/>\ntrustees are now seeking to break that promise. It is imperative,<br \/>\nat this critical time, that we gather our forces to show strength<br \/>\nin numbers. If you are receiving this email, you are important<br \/>\nto this cause. We urge every musician to read this email.<\/p>\n<p>Please act now and join the MPS EMAIL LIST to stay informed.<\/p>\n<p>Background<\/p>\n<p>AFM pension fund trustees sent out a letter over a year ago<br \/>\nin December of 2016 disclosing for the first time that we would<br \/>\nin all probability face massive cuts to our existing benefits as<br \/>\nsoon as spring 2017. Shock and confusion set in. How could<br \/>\nthis happen? In the months that followed many AFM members<br \/>\nlooked to our elected leaders and trustees for help, information<br \/>\nand a plan. Before long, it became clear that we would need to<br \/>\ndeal with the pension crisis ourselves. What resulted was the<br \/>\nformation of Musicians for Pension Security, a non-profit<br \/>\nvolunteer organization made up of musicians who do thousands<br \/>\nof hours of work in order to help our friends and colleagues<br \/>\naround the country to seek solutions and stay informed in<br \/>\nthe face of the AFM pension crisis.<\/p>\n<p>MPS Initiatives and Accomplishments<br \/>\n&#8211; MPS national conference calls which are regularly<br \/>\nattended by scores of engaged participants across<br \/>\nthe country.<br \/>\n&#8211; MPS launched our first ever MPS fundraising<br \/>\ncampaign which raised $15,000 in less than two weeks.<br \/>\nFunds were used to retain one of the most respected<br \/>\nactuaries in the country to start an independent actuarial<br \/>\nanalysis of the fund.<br \/>\n&#8211; MPS has worked closely with policymakers in Washington<br \/>\nD.C. like Senator Sherrod Brown (D-OH) and Senator<br \/>\nLamar Alexander (R-TN) to develop and discuss new<br \/>\npension legislation like the Butch Lewis Act.<br \/>\n&#8211; MPS spearheaded a call to action, where thousands<br \/>\nof AFM members called and emailed AFM President<br \/>\nRay Hair urging him and the other AFM-EPF trustees<br \/>\nto support The Butch Lewis Act, which they finally<br \/>\nendorsed just a few weeks later.<br \/>\n&#8211; MPS Executive Director, Adam Krauthamer received<br \/>\nan award from the Pension Rights Center in Washington<br \/>\nDC in recognition of his services to the AFM-EPF plan<br \/>\nparticipants.<\/p>\n<p>&nbsp;<\/p>\n<p>We are only able to achieve critical change through<br \/>\nstrength in numbers. THERE THEY (AFM) GO AGAIN!<br \/>\nHow MGM&#8217;s &#8216;Ben-Hur&#8217; Evolved Into a Pending<br \/>\nFight Before the National Labor Relations Board<\/p>\n<p>Are MGM and Paramount union-busting? Is the American<br \/>\nFederation of Musicians tampering with witnesses in a<br \/>\nlawsuit over wages and benefits? A labor dispute escalates.<\/p>\n<p>It&#8217;s with no small measure of irony that Ben-Hur, the iconic<br \/>\nfilm about a prince-turned-slave&#8217;s revenge, has instigated<br \/>\na modern-day labor brawl. That&#8217;s thanks to MGM&#8217;s decision<br \/>\nto reboot the film, and specifically, the musicians hired to<br \/>\nperform the score.<\/p>\n<p>Last April, the\u00a0American Federation of Musicians of the<br \/>\nUnited States and Canada filed a lawsuit against\u00a0MGM<br \/>\nand Paramount \u2014 and the complaint seemed simple<br \/>\nenough at the time. The guild accused the studios of<br \/>\nfailing to pay proper wages, benefits and residual<br \/>\ncompensation to the musicians on the 2016 remake.<\/p>\n<p>MGM and Paramount responded by arguing that the<br \/>\nmusicians were subcontracted and therefore not covered<br \/>\nby the union agreement. In October, a California federal<br \/>\njudge rejected MGM&#8217;s motion for judgment on the<br \/>\npleadings and allowed the litigation to proceed.<\/p>\n<p>Now, the dispute has escalated to the point where one<br \/>\nside implies union-busting and the other side suggests<br \/>\nwitness tampering. The case has gotten so heated that<br \/>\nit has provoked AFM to file charges against MGM to<br \/>\nthe National Labor Relations Board.<\/p>\n<p>According to AFM, MGM and Paramount have unlawfully<br \/>\ncoerced musicians employed in the scoring of Ben-Hur<br \/>\nby conditioning their employment on a promise not to<br \/>\nadhere to union economic standards, not to communicate<br \/>\nwith the guild about this film project and not to exercise<br \/>\nrights to bargain collectively over terms and conditions<br \/>\nof their employment.<\/p>\n<p>The ramifications of musicians taking work not sanctioned<br \/>\nby the union are beginning to reverberate. As a result of<br \/>\nthis movie and the subsequent legal proceedings, questions<br \/>\nare being presented about a guild&#8217;s ability to discipline its<br \/>\nown members and an employer&#8217;s ability to find out about<br \/>\nsuch activity.<\/p>\n<p>The case is now in the discovery phase. Both sides want<br \/>\ninformation. And there&#8217;s been no shortage of accusations<br \/>\nthat the legal process is being abused.<\/p>\n<p>In December, for instance, Magistrate Judge Michael Wilner<br \/>\nnoted that &#8220;AFM is undoubtedly authorized to conduct<br \/>\nlegitimate disciplinary proceedings to enforce union rules,&#8221;<br \/>\nbut added, &#8220;There is a strong and pungent whiff of abuse<br \/>\nof the Court&#8217;s process here. It sure looks like the union<br \/>\nused Rule 45 subpoenas in its lawsuit against MGM<br \/>\nand Paramount simply to gain evidence against its<br \/>\nwayward members.&#8221;<\/p>\n<p>Recently, MGM has been investigating.<\/p>\n<p>In court papers filed late last week, MGM told the judge<br \/>\nthat it had learned that AFM fined music conductor<br \/>\nMark Graham $10,000, but &#8220;held in abeyance&#8221; three-<br \/>\nquarters of that amount pending the guild&#8217;s satisfaction<br \/>\nwith his future behavior.<\/p>\n<p>The studio wants permission to find out about other<br \/>\nmusicians disciplined by AFM.<\/p>\n<p>&#8220;Discovery regarding the AFM\u2019s actions, including actual<br \/>\nand\/or threatened sanctions against percipient witnesses<br \/>\nin this lawsuit is indisputably relevant to the credibility of<br \/>\nthose witnesses\u2019 testimony,&#8221; writes MGM&#8217;s attorney Adam<br \/>\nLevin. &#8220;The AFM\u2019s refusal to produce this potentially relevant<br \/>\ndiscovery appears to be based on an unfounded interpretation<br \/>\nof the National Labor Relations Act, which does not allow<br \/>\nunions to secretly discipline and cut deals with persons<br \/>\nwho are witnesses in civil litigation.&#8221;<\/p>\n<p>But AFM has a different read on what&#8217;s going on.<br \/>\nIn late November, the guild quietly filed charges at<br \/>\nthe NLRB against MGM and the law firm of Mitchell<br \/>\nSilberberg &amp; Knupp.<\/p>\n<p>The studio is accused of violating a provision of labor code<br \/>\nthat prohibits employers from interfering with employees&#8217;<br \/>\nexercise of labor rights. Specifically, AFM alleges it is<br \/>\nunlawful that MGM would interrogate union members<br \/>\nabout intra-union disciplinary matters and other<br \/>\nconfidential protected union activity.<\/p>\n<p>The NLRB may eventually get around to issuing a decision<br \/>\nabout this, but in the meantime, a judge is holding a<br \/>\nhearing next week to examine MGM&#8217;s efforts to compel<br \/>\ndisclosures about intra-union communications and disciplinary<br \/>\nactions.<\/p>\n<p>Jennifer Garner, attorney for AFM, argues to the court<br \/>\nthat after coercing musicians to take economic<br \/>\nsub-standard work, MGM and Paramount now<br \/>\nwish to complete the unacceptable bargain.<\/p>\n<p>&#8220;The Ben-Hur employers promised anyone who capitulated<br \/>\nto these yellow dog terms that their acceptance of such<br \/>\nemployment would be protected from disclosure to the<br \/>\nrepresentative union,&#8221; she writes in a bid for a protective<br \/>\norder. &#8220;Thus, in actuality, it is the Ben-Hur employers who<br \/>\nhave violated the musicians\u2019 rights and have resorted to<br \/>\neconomic and political coercion to silence them and\/or<br \/>\ncurry their favor as witnesses in this action.&#8221;<\/p>\n<p>&nbsp;<\/p>\n<p>[Colleagues, No musicians were coerced into taking<br \/>\nthis work. It&#8217;s called freelancing and If the<br \/>\ncompany had been forced to go union, the work<br \/>\nwould have gone overseas.<\/p>\n<p>At least this way the work stayed here, but that&#8217;s not<br \/>\ngood enough for the AFM and Local 47. If it&#8217;s not<br \/>\ngoingto the RMA elites it shouldn&#8217;t happen so they<br \/>\nengage in selective enforcement and harassment.<\/p>\n<p>I hope Mark Graham does no give over the<br \/>\nIdentities of the players, the AFM doesn&#8217;t<br \/>\ndeserve them.]<\/p>\n<p>&nbsp;<\/p>\n<p>================================<\/p>\n<p>&nbsp;<\/p>\n<p>III.
