\nAlan\u00a0and\u00a0Marilyn Bergman, Steve Tyrell, Denise Donatelli\u00a0and
\nSandra Booker\u00a0Holley, Brett Ratner\u00a0and more!

\nLalo Schifrin\u00a0is a venerated composer, conductor, pianist, and
\njazz musician. He has written classic television themes and over
\n100 film scores including\u00a0Mission: Impossible, Mannix, Bullitt,
\nCool Hand Luke, The Cincinnati Kid, The Competition\u00a0and so
\nmany more.<\/p>\n
His five Grammys, one Cable ACE Award, and six Academy
\nAward nominations is a testament to his impact on the music
\nindustry.The evening will be hosted by\u00a0Robert Townson.<\/p>\n
Proceeds will go to support music education in schools and
\naide for Local 47 professional musicians in crisis.<\/p>\n

II. MGM, Paramount Say ‘Ben Hur’ Musicians Not Covered<\/p>\n

The studios make their move to dismiss a lawsuit from<\/p>\n
a guild that claims that musicians haven’t been properly<\/p>\n
compensated. MGM and Paramount Pictures are moving<\/p>\n
to dismiss a lawsuit brought by a guild that claims<\/p>\n
musicians who recorded the score for the 2016 film<\/p>\n
remake of\u00a0Ben Hur have been denied rightful\u00a0wages,<\/p>\n
benefits and residual compensation.<\/p>\n
In a motion filed Wednesday, the studios argue that<\/p>\n
these musicians are not covered under a collective<\/p>\n
bargaining agreement. The lawsuit comes from<\/p>\n
The American Federation of Musicians of the United<\/p>\n
States and Canada, who assert that the studios are<\/p>\n
violating Section 301 of the Labor Management<\/p>\n
Relations Act. In the complaint, the guild noted<\/p>\n
that\u00a0Ben Hur was shot in Italy, but that producers<\/p>\n
retained\u00a0the services of a California composer,<\/p>\n
Marco Beltrami.<\/p>\n
Each of the major studios is a signatory to a<\/p>\n
union-negotiated 2015 agreement over<\/p>\n
motion pictures.<\/p>\n
But\u00a0MGM and Paramount are relying on the<\/p>\n
allegation that Beltrami was hired by Paramount’s<\/p>\n
“contractor,” BH Productions LLC. According<\/p>\n
to the defendants,<\/p>\n
this puts the musicians \u2014 who they say were<\/p>\n
fully compensated \u2014 outside the relevant<\/p>\n
bargaining unit. What’s more, the defendants<\/p>\n
question whether the musicians have ever<\/p>\n
consented to this lawsuit.<\/p>\n
“Because the AFM lacks standing under<\/p>\n
Section 301 to pursue claims on behalf of<\/p>\n
the musicians allegedly hired by the composer,<\/p>\n
the AFM cannot seek damages on their behalf,”<\/p>\n
states the motion. “The AFM has not alleged,<\/p>\n
and cannot allege, that the musicians ever<\/p>\n
authorized the AFM to seek financial recovery<\/p>\n
for purported injuries caused to them. Indeed,<\/p>\n
the AFM has not even alleged that the musicians<\/p>\n
are aware that the AFM is seeking to represent<\/p>\n
their interests in this action.”<\/p>\n
Paramount previously used similar arguments<\/p>\n
to beat an AFM lawsuit over the score to\u00a0Same<\/p>\n
Kind of Different as Me. That legal action<\/p>\n
challenged how the film wasn’t scored in North<\/p>\n
America in alleged breach of the CBA. Crucially,<\/p>\n
the case failed after a judge determined that the<\/p>\n
musicians weren’t employed by Paramount,<\/p>\n
but rather by the production vehicle,\u00a0SKODAM Films.<\/p>\n
In some ways, Paramount is being even more<\/p>\n
bold in its defense of\u00a0Ben Hur.<\/p>\n
The adjudication of\u00a0Same Kind of Different as Me<\/p>\n
happened at the summary judgment phase after<\/p>\n
the parties engaged in discovery and explored<\/p>\n
evidence of Paramount’s control over the picture<\/p>\n
and whether it could be deemed a joint employer.<\/p>\n
In contrast,\u00a0MGM and Paramount are now looking<\/p>\n
to kill the\u00a0Ben Hur\u00a0lawsuit on a motion for judgment<\/p>\n
on the pleadings. What that means is that the studios<\/p>\n
don’t want any costly discovery. Represented by<\/p>\n
attorney Adam Levin at Mitchell Silberberg & Knupp,<\/p>\n
they are challenging whether AFM has even alleged a<\/p>\n
plausible case.<\/p>\n

where it as recorded, but it seems it was scored<\/p>\n
overseas considering none of the names are<\/p>\n
familiar and LA wants all the credit it can get.<\/p>\n

Composer is hired now, it has to be scored here?<\/p>\n
The movie was made in Italy. They have squat<\/p>\n
to say about it…. further, if there were a number<\/p>\n
of instruments recorded here, not on contract,<\/p>\n

Artist Bios:
\nJACQUELINE SUZUKI, violin, is a longtime
\nmember of the Long Beach and Santa Barbara
\nSymphonies. A native of San Francisco, she
\nbegan her earliest chamber music studies on
\nscholarship at the San Francisco Conservatory.
\nShe has performance degrees from the
\nMannes College of Music (BM), where she studied
\nwith William Kroll, and the California Institute
\nof the Arts (MFA).<\/p>\n
As a Los Angeles freelancer, she has performed
\nwith many ensembles and in many genres, from r
\nock, jazz, Latin and Arabic, to playing in the pit
\nfor the Bolshoi Ballet and onstage with the Three
\nTenors. She has recorded with diverse artists:
\nSnoop Dogg, Neil Sedaka, Leonard Cohen, Whitney
\nHouston, Bocelli, Lalo Schifrin, McCoy Tyner,
\nPlacido Domingo and many others, and appears
\non recordings by the Long Beach, Santa Barbara
\nand Pacific Symphonies. She has spent summers
\nat the Peter Britt, Oregon Coast, Carmel Bach
\nand Cabrillo Festivals and has performed in a
\nstring quartet \u201cin residence\u201d on a raft trip
\ndown the Green River in Utah. Tours have
\ntaken her many times to Japan, Taiwan,
\nMexico, Canada, Europe, the Middle East
