MGM, Paramount Say &#8216;Ben Hur&#8217; Musicians Not Covered<\/p>\n<p>by Union Agreement<br \/>\nSeptember 28, 2017 7:58am PT by Eriq Gardner<\/p>\n<p>The studios make their move to dismiss a lawsuit from<\/p>\n<p>a guild that claims that musicians haven&#8217;t been properly<\/p>\n<p>compensated. MGM and Paramount Pictures are moving<\/p>\n<p>to dismiss a lawsuit brought by a guild that claims<\/p>\n<p>musicians who recorded the score for the 2016 film<\/p>\n<p>remake of\u00a0Ben Hur have been denied rightful\u00a0wages,<\/p>\n<p>benefits and residual compensation.<\/p>\n<p>In a motion filed Wednesday, the studios argue that<\/p>\n<p>these musicians are not covered under a collective<\/p>\n<p>bargaining agreement. The lawsuit comes from<\/p>\n<p>The American Federation of Musicians of the United<\/p>\n<p>States and Canada, who assert that the studios are<\/p>\n<p>violating Section 301 of the Labor Management<\/p>\n<p>Relations Act. In the complaint, the guild noted<\/p>\n<p>that\u00a0Ben Hur was shot in Italy, but that producers<\/p>\n<p>retained\u00a0the services of a California composer,<\/p>\n<p>Marco Beltrami.<\/p>\n<p>Each of the major studios is a signatory to a<\/p>\n<p>union-negotiated 2015 agreement over<\/p>\n<p>motion pictures.<\/p>\n<p>But\u00a0MGM and Paramount are relying on the<\/p>\n<p>allegation that Beltrami was hired by Paramount&#8217;s<\/p>\n<p>&#8220;contractor,&#8221; BH Productions LLC. According<\/p>\n<p>to the defendants,<\/p>\n<p>this puts the musicians \u2014 who they say were<\/p>\n<p>fully compensated \u2014 outside the relevant<\/p>\n<p>bargaining unit. What&#8217;s more, the defendants<\/p>\n<p>question whether the musicians have ever<\/p>\n<p>consented to this lawsuit.<\/p>\n<p>&#8220;Because the AFM lacks standing under<\/p>\n<p>Section 301 to pursue claims on behalf of<\/p>\n<p>the musicians allegedly hired by the composer,<\/p>\n<p>the AFM cannot seek damages on their behalf,&#8221;<\/p>\n<p>states the motion. &#8220;The AFM has not alleged,<\/p>\n<p>and cannot allege, that the musicians ever<\/p>\n<p>authorized the AFM to seek financial recovery<\/p>\n<p>for purported injuries caused to them. Indeed,<\/p>\n<p>the AFM has not even alleged that the musicians<\/p>\n<p>are aware that the AFM is seeking to represent<\/p>\n<p>their interests in this action.&#8221;<\/p>\n<p>Paramount previously used similar arguments<\/p>\n<p>to beat an AFM lawsuit over the score to\u00a0Same<\/p>\n<p>Kind of Different as Me. That legal action<\/p>\n<p>challenged how the film wasn&#8217;t scored in North<\/p>\n<p>America in alleged breach of the CBA. Crucially,<\/p>\n<p>the case failed after a judge determined that the<\/p>\n<p>musicians weren&#8217;t employed by Paramount,<\/p>\n<p>but rather by the production vehicle,\u00a0SKODAM Films.<\/p>\n<p>In some ways, Paramount is being even more<\/p>\n<p>bold in its defense of\u00a0Ben Hur.<\/p>\n<p>The adjudication of\u00a0Same Kind of Different as Me<\/p>\n<p>happened at the summary judgment phase after<\/p>\n<p>the parties engaged in discovery and explored<\/p>\n<p>evidence of Paramount&#8217;s control over the picture<\/p>\n<p>and whether it could be deemed a joint employer.<\/p>\n<p>In contrast,\u00a0MGM and Paramount are now looking<\/p>\n<p>to kill the\u00a0Ben Hur\u00a0lawsuit on a motion for judgment<\/p>\n<p>on the pleadings. What that means is that the studios<\/p>\n<p>don&#8217;t want any costly discovery. Represented by<\/p>\n<p>attorney Adam Levin at Mitchell Silberberg &amp; Knupp,<\/p>\n<p>they are challenging whether AFM has even alleged a<\/p>\n<p>plausible case.<\/p>\n<p>[EC: The article doesn&#8217;t state whether the score<\/p>\n<p>was recorded here. IMDB does not make it clear<\/p>\n<p>where it as recorded, but it seems it was scored<\/p>\n<p>overseas considering none of the names are<\/p>\n<p>familiar and LA wants all the credit it can get.<\/p>\n<p>So, does the AFM think that if an American<\/p>\n<p>Composer is hired now, it has to be scored here?<\/p>\n<p>The movie was made in Italy.
