PENSION MYTHS AND FACTS<\/p>\n<p>FACTS, NOT MYTHS<br \/>\nMPS responds to President Ray Hair&#8217;s July 2017 International<br \/>\nMusician article<\/p>\n<p>Dear Plan Participants,<br \/>\nRay Hair attempts to \u201cbust the myths\u201d related to our pension<br \/>\nfund\u2019s crisis in this month\u2019s International Musician, which<br \/>\nwas copied verbatim from the AFM-EPF June newsletter<br \/>\n(that message can be found here and here). President<br \/>\nHair\u2019s message actually raises more questions than it<br \/>\nanswers.<\/p>\n<p>President Hair\u2019s Myth #1:\u2028The Fund is not critical and<\/p>\n<p>declining so we\u2019re \u201csafe.\u201d<\/p>\n<p>MPS Question #1: Why the dramatic deterioration in the past<br \/>\n12 months? President Hair states that avoiding critical and<br \/>\ndeclining status this year doesn\u2019t mean that our fund is<br \/>\nhealthy. We agree with that. But he doesn\u2019t address the<br \/>\nkey issue.<\/p>\n<p>The recent Annual Funding Notice shows the funded<br \/>\npercentage of our plan (view here) has declined from<br \/>\n81.6% to 69% in just one year. That is a decrease of<br \/>\n12.6 points, which is our largest decrease since the<br \/>\nfinancial crisis of 2008-9 (funded percentages since<br \/>\n2009 are 75%, 94.5%, 91.8%, 88.5%, 86.9%, 85.6%,<br \/>\nand 81.6%.). So while that percentage has been<br \/>\ntrending down moderately, this past year it took a<br \/>\ndramatic fall. Why? President Hair does not say.<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;-<br \/>\nPresident Hair&#8217;s Myth #2: \u2028The Keep Our Pension<\/p>\n<p>Promises Act (KOPPA)<br \/>\nproposed by Senator Bernie Sanders is good<br \/>\nfor participants.<\/p>\n<p>MPS Question #2: Why is President Hair so<br \/>\nenamored with a law that numerous<br \/>\nSenators and Congressmen want repealed<br \/>\nor revised (read about MPRA)?<\/p>\n<p>Mr. Hair asserts that he met with staffers of<br \/>\nDemocratic senators in Washington, D.C., on<br \/>\nJune 6, and discovered that with the current<br \/>\nRepublican senate in place, KOPPA would likely<br \/>\nnot be enacted into law. If this was news to Mr.<br \/>\nHair and Mr. Gagliardi at their meeting, it certainly<br \/>\nisn\u2019t to anyone else. MPS stated back in May that<br \/>\nit is unlikely this legislation would be passed in<br \/>\ntoday\u2019s current political climate, but it could be<br \/>\npassed after the 2018 and 2020 elections. It also<br \/>\nshouldn\u2019t stop our trustees from seeking<br \/>\nimprovements to already existing laws, or lobby<br \/>\nfor a new piece of legislation altogether that<br \/>\nwould be better suited to the needs of all plan<br \/>\nparticipants.<\/p>\n<p>Mr. Hair and our trustees only seem interested<br \/>\nin one piece of legislation: the Multiemployer<br \/>\nPension Reform Act of 2014 (MPRA), which<br \/>\nallows the trustees of financially-troubled multi<br \/>\nemployer pension plans to apply to the US<br \/>\nTreasury for reduced benefits to retirees and<br \/>\ntheir widows\/widowers. Numerous senators<br \/>\nand congressmen on both sides of the aisle<br \/>\nhave expressed extreme dissatisfaction with<br \/>\nMPRA. In fact, a number of them have stated<br \/>\nthat they want it substantially revised, or repealed<br \/>\naltogether. Several Republican senators have<br \/>\njoined with Senator Rob Portman, R-Ohio, to<br \/>\nrevise MPRA (Pension Accountability Act).<\/p>\n<p>Portman\u2019s proposal would disallow any benefit<br \/>\ncuts without a majority of the votes cast by the<br \/>\nplan participants. Despite these proposals for<br \/>\nsubstantial revision to MPRA, our trustees<br \/>\nhave not engaged with these efforts, choosing<br \/>\nto enforce MPRA as written, allowing benefit<br \/>\ncuts over the objections of plan participants.<br \/>\nRegarding the possibility of our plan falling<br \/>\ninto MPRA in the next year or two, President<br \/>\nHair has clearly overlooked one very important<br \/>\nscenario \u2013 in the event that MPRA is revised to<br \/>\nbenefit the plan participants after the 2018 or<br \/>\n2020 elections, those who already had cuts<br \/>\nenacted may very well be denied the new<br \/>\nfavorable benefits of the revised law.<\/p>\n<p>It has become clear over the past several months<br \/>\nthat the trustees view MPRA as the only legislative<br \/>\ntool in their toolbox. A question MPS still wants<br \/>\nanswered is whether the trustees used plan money<br \/>\nto help draft and lobby for the passage of MPRA in<br \/>\n2014. We asked the trustees this question in our<br \/>\ninformation request last month (read here), and<br \/>\nthey refused to answer.<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<br \/>\nPresident Hair&#8217;s Myth #3: The plan lost 40% in<br \/>\ninvestment returns when other plans lost 25%.<\/p>\n<p>MPS Question #3: Why won\u2019t the trustees answer<br \/>\nour questions regarding the losses of 2008-9?<\/p>\n<p>Mr. Hair would like us to know that the plan lost 29%<br \/>\nin investment returns for the 12 months ending<br \/>\nMarch 31, 2009, not 40% as some have alleged.<br \/>\nThere have been numerous conflicting communications<br \/>\nfrom the trustees on this subject. MPS formally<br \/>\nrequested detailed information regarding the Fund\u2019s<br \/>\nrealized losses in 2008-09 (read items 6-8), but the<br \/>\ntrustees refused to answer those questions.<\/p>\n<p>Executive Director, Maureen Kilkelly, informed us<br \/>\nthat they would provide only the documents required<br \/>\nby law, and that they \u201c\u2026 are not responding to<br \/>\nthe remaining requests.* &#8221;<\/p>\n<p>MPS also asked the trustees for detailed information<br \/>\nregarding the performance of the alternative investment<br \/>\nportfolio. It\u2019s clear that the trustees have revised their<br \/>\ninvestment strategy since 2014, and shifted to a more<br \/>\naggressive investment mix. Currently, approximately<br \/>\n32% of plan assets are allocated to alternative<br \/>\ninvestments, including private equity. Our questions<br \/>\nregarding the private equity portfolio, including the<br \/>\nnature of the fees and investment returns, were not<br \/>\nanswered by the trustees.<\/p>\n<p>We also asked whether they received any legal<br \/>\nadvice that the plan had a viable lawsuit against<br \/>\nany of its investment advisors for the poor performance<br \/>\nduring not only in the 2008 financial crisis, but also<br \/>\nthe past 10 years \u2013 a lost decade from an investment<br \/>\npoint of view. The trustees refused to answer us on<br \/>\nthis critical point as well.<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<p>President Hair&#8217;s Myth #4: The Fund office received<br \/>\nhuge staff pay increases in 2009.<\/p>\n<p>MPS Question #4: Why won\u2019t the trustees answer<br \/>\nour questions about expenses?<\/p>\n<p>President Hair indicates that plan participants<br \/>\nmisunderstand why expenses seem to have gone<br \/>\nup abruptly in 2009, and continued to increase since.<br \/>\nIt is precisely this reason that MPS asked<br \/>\nnumerous questions regarding expenses<br \/>\n(see items 11-16). The trustees refused all<br \/>\nrequests. We again ask that the trustees<br \/>\nrespond fully to our information request so<br \/>\nwe may understand exactly what went wrong<br \/>\nwith our fund, and what can be done in the<br \/>\nfuture to repair it.<\/p>\n<p>President Hair, who has been the AFM trustee<br \/>\nco-chair since 2010, isn\u2019t busting any myths \u2013<br \/>\nhe is using carefully curated facts in order to<br \/>\nmake his case. When asked questions that<br \/>\nare uncomfortable or inconvenient, AFM-EPF<br \/>\nrefuses to answer.<\/p>\n<p>This is not transparency.<\/p>\n<p>President Hair focuses on \u201cbusting myths\u201d<br \/>\nbecause he and the other trustees choose to<br \/>\ndodge the facts \u2013 over the past decade, our<br \/>\nfund has endured poor performance with an<br \/>\naverage 3.2% return net of investment fees,<br \/>\nspent $250 million in fees, and left us with<br \/>\nserious questions about how our plan money<br \/>\nhas been spent. One thing is obviously missing<br \/>\nwhen it comes to the communications from Mr.<br \/>\nHair and the other trustees \u00ad\u00ad\u00ad\u2013 what is the<br \/>\ntrustees\u2019 strategic long-term plan moving forward<br \/>\nto deal with the continual problems at the AFM-EPF?<\/p>\n<p>President Hair, is the plan to fix the AFM-EPF<br \/>\nfund a myth as well?<\/p>\n<p>Sincerely,<br \/>\nMusicians for Pension Security, Inc.<br \/>\n*Ms. Kilkelly included a disclaimer on her<br \/>\nemail that prevents us from sharing it publicly.<\/p>\n<p>[EC: Our dues pay the salaries of the trustees,<br \/>\nthey have no right to refuse answering reasonable<br \/>\nquestions of their employers (us).<\/p>\n<p>Why haven&#8217;t these people been fired?]<\/p>\n<p>===========================================<\/p>\n<p>II. NEW PENSION FUND ASSESSMENT<\/p>\n<p>This is as good an analysis as I&#8217;ve seen or our AFM<\/p>\n<p>pension situation.<\/p>\n<p>&#8220;The AFM Pension Crisis &#8211; A View from the Membership&#8221;.<br \/>\nThree months in preparation, this paper has received<\/p>\n<p>endorsements from two of the leading authorities on<\/p>\n<p>pension finance in the U.S.:<\/p>\n<p>http:\/\/www.AFMPensionPerspectives.com<\/p>\n<p>Here&#8217;s the intro:<\/p>\n<p>We are long-time AFM members with an interest<\/p>\n<p>and background in finance and math. Our only agenda<\/p>\n<p>is to try to bring our pension fund back to a usable<\/p>\n<p>state for all members, of all generations. We are<\/p>\n<p>concerned that if the Fund continues in its<\/p>\n<p>present course, those of you who are now \ufb01fty<\/p>\n<p>may receive only a few years of a (possibly<\/p>\n<p>reduced) pension. If you are forty-five or<\/p>\n<p>younger you may receive nothing at all.<\/p>\n<p>This is not inevitable and we think there<\/p>\n<p>is a good chance our fund can be saved. To<\/p>\n<p>do this, we think it\u2019s important to understand<\/p>\n<p>how pension funds work. If you are allergic<\/p>\n<p>to numbers or \ufb01nance, but have had a savings<\/p>\n<p>account or taken out a loan, you will be able to<\/p>\n<p>understand the basics of a pension plan. There<\/p>\n<p>are many di\ufb00erent versions of how we got into<\/p>\n<p>this mess. In particular, we find the Trustees\u2019<\/p>\n<p>version inexplicably incomplete. Our version<\/p>\n<p>has the advantage of being consistent with the<\/p>\n<p>views of pension experts and unfolds naturally<\/p>\n<p>as we explain how pensions work in Part 1.<\/p>\n<p>Since our story di\ufb00ers from the Trustees version in<br \/>\nnumerous ways, we realize it might be controversial.<br \/>\nTo remove any doubt you may have that our comments<br \/>\nare within the mainstream of \ufb01nancial thought and not<br \/>\nsome crazy theory, we invited the highly respected<br \/>\npension authorities M.\u00a0Barton Waring and Ronald J.<br \/>\nRyan to review our work. Their complete comments<br \/>\nto us follow this introduction. We are grateful for<br \/>\ntheir time and e\ufb00orts.<\/p>\n<p>Talking about things without knowing much about<br \/>\nthem is a good way to generate a lot of heat without<br \/>\ngenerating any illumination. We think there\u2019s been<br \/>\na lot of that going on and we hope this will help fix that.<br \/>\nAlong the way, we also talk about ways to evaluate<br \/>\npension fund investment performance, the serious<br \/>\nissue of our shrinking pension \u2019nest-egg\u2019, and some<br \/>\npossible ways that we can all work together to fix<br \/>\nthe fund.<\/p>\n<p>Moving forward looks like it will require the e\ufb00orts<br \/>\nof many members. If you are a member of an<br \/>\norchestra committee or other in\ufb02uential group,<br \/>\nwe hope you will try to do something to get your<br \/>\ncolleagues to help bring our pension back to a<br \/>\nhealthy status.
