LOCAL REACHES NEW LOW AGAINST RANK AND FILE<\/p>\n<p>We&#8217;ve received several reports that at a recent non-union<br \/>\nrecording session, a recently fired high up employee was<br \/>\nfound lurking in the bushes, taking pictures of members<br \/>\nentering the studio.<\/p>\n<p>All those identified were charged $500 for trying to feed their<br \/>\nfamilies, with no union work to be had.<\/p>\n<p>BUT WAIT,<\/p>\n<p>The Local decided to hold the $500 charge over their heads,<br \/>\ntelling them that it will not be pressed UNLESS they are<br \/>\ncaught again.<\/p>\n<p>So, the Local is now targeting rank and file for trying to pay<br \/>\ntheir bills, unless you&#8217;re in the upper echelon of course, and<br \/>\nthreatening them with further targeting.<\/p>\n<p>If the Local spent half the time and effort they spend<br \/>\non targeting rank and file members trying to create<br \/>\nworld competitive contracts\u00a0 much of the nonunion<br \/>\nwork would be unnecessary.<\/p>\n<p>As long as the RMA runs things, that won&#8217;t happen.<\/p>\n<p>Many RMA members do the nonunion work at the same<br \/>\nrate as the rank and file, but because of their positions<br \/>\nnever face the targeting.<\/p>\n<p>Corruption is as corruption does.<\/p>\n<p>===========================================<\/p>\n<p>II. MUSICIANS FOR PENSION SECURITY RESPOND.<\/p>\n<p>Musicians for Pension Security respond\u00a0to the lawsuit<br \/>\nfiled\u00a0against the AFM-EPF trustees and Fund\u00a0Administrator<br \/>\nDear Plan Participants,<\/p>\n<p>A class action lawsuit was recently filed against the trustees of the AFM-<br \/>\nEPF. The central allegation is that Fund trustees failed to properly oversee<br \/>\nthe investment functions of our plan. In particular, it claims they directed<br \/>\ntoo much plan money into\u00a0emerging market\u00a0stocks, and as a result, the<br \/>\ninvestment returns were lower than if they were invested in US stocks.<\/p>\n<p>Musicians for Pension Security did not file this lawsuit.<\/p>\n<p>It was initiated by two AFM-EPF members who are not affiliated with<br \/>\nour organization. MPS applauds any effort to hold plan trustees<br \/>\naccountable for their performance and transparency failures.<br \/>\nHowever, the litigation process could take years to unfold, and<br \/>\nduring this time the trustees will be deciding the fate of our plan.<br \/>\nIn the next few years, they will determine if the plan will move into<br \/>\ncritical and declining status,\u00a0and whether or not to file an application<br \/>\nto the US Treasury for cuts to our pension benefits.\u00a0We cannot<br \/>\nlet the lawsuit distract us from the key task of protecting our<br \/>\npension benefits.<\/p>\n<p>MPS believes that the lawsuit, if successful, would only recover<br \/>\napproximately 1% of plan assets. In all likelihood our trustees<br \/>\nhave an insurance policy insulating them from possible litigation,<br \/>\nand in general, these policies provide somewhere between<br \/>\n$20-$40 million of protection. After deducting attorneys&#8217; fees,<br \/>\nwe believe that at most only approximately\u00a0$20 million could<br \/>\nbe recovered. This equates to less than 1% of plan assets,<br \/>\nor about $400 per participant.<\/p>\n<p>While holding AFM-EPF trustees accountable is laudable,<br \/>\nMPS remains focused on how plan participants can have a<br \/>\ngreater influence right now.\u00a0We have retained our own<br \/>\nindependent actuary to provide a second opinion concerning<br \/>\nthe finances of our fund. MPS will continue to engage with<br \/>\npolicymakers in Washington to find solutions in plan<br \/>\nparticipants&#8217; best interests. HELP THE MUSICIANS FOR PENSION SECURITY<\/p>\n<p>Dear Plan Participants,<br \/>\nMusicians For Pension Security, Inc. (MPS), is a nonprofit<br \/>\ngroup managed and supported by AFM union members<br \/>\nacross the country who are deeply concerned with the<br \/>\ncurrent state of our AFM-EPF Pension Plan. Our purpose<br \/>\nis to fully understand how our plan became so troubled,<br \/>\nand to hold our trustees and their advisers fully<br \/>\naccountable. Further, we demand more transparency<br \/>\nfrom our trustees and to seek solutions to our current<br \/>\ndilemma other than cutting our hard-earned pension<br \/>\nbenefits.<\/p>\n<p>MPS believes that without plan participants&#8217; active<br \/>\ninvolvement, the trustees of AFM-EPF Plan will most<br \/>\nlikely move to cut our pension benefits within the<br \/>\nnext few years. Therefore, this year will be pivotal<br \/>\nin our fight for pension security, and we at MPS are<br \/>\nplanning a number of initiatives to support YOU,<br \/>\nthe plan participant.<\/p>\n<p>To do this, we will need your financial support.
