PENSION COMMENT<\/p>\n<p>FYI:<br \/>\nWhen our AFM Pension took its stock market dive in 2008,<br \/>\nYou recall our L.A. \/ NY H&amp;W Fund had similar financial woes.<br \/>\nA person in the H&amp;W loop gave me the following info.<\/p>\n<p>(This regards only H&amp;W management, but we can imagine<br \/>\na similar band of irresponsible folks who \u201cmight\u201d have<br \/>\nbeen ignoring the location\/vulnerability of our Pension<br \/>\nmoney during the stock market crash.<\/p>\n<p>For instance, if those Pension Trustees had been paying<br \/>\nattention to the crisis, they could have switched us to safe<br \/>\nBlue Chip stocks before the worst of it.)<\/p>\n<p>H&amp;W Trustees at the time of the 2008 crash:<\/p>\n<p>Lewis, Vince, exec at Disney, exec at Entertainment<br \/>\nPartners, Gary Hughes (\u201cManagement trustee,\u201d) one<br \/>\nmore un-named person.<\/p>\n<p>Six total Trustees: 3 from the Union side and 3 from<br \/>\nthe music business executive side.<br \/>\nTrustees are volunteers. They serve as a community service.<br \/>\nTrustees are not officially &#8220;Trustees&#8221; until they meet<br \/>\ntogether to make decisions.<\/p>\n<p>No Union allows membership to contact Trustees directly.<\/p>\n<p>Very sad.<br \/>\nAgain, this is not a list of AFM Pension Trustees.<br \/>\nThen again, maybe some of them were\u2026<\/p>\n<p>=================================<\/p>\n<p>II. AFM &amp; SAG-AFTRA Fund in the Spotlight at ASCAP Expo<\/p>\n<p>The little-known AFM &amp; SAG-AFTRA Intellectual Property Rights<br \/>\nDistribution Fund pays royalties even to oft-neglected session musicians<br \/>\nand backup singers.<\/p>\n<p>Stevie Wonder was the headliner \u2014 and closing act \u2014 of the ASCAP<br \/>\nI Create Music Expo that concluded this weekend, but musicians and<br \/>\nsingers will be interested to know that an obscure fund, jointly run<br \/>\nby the American Federation of Musicians and performers\u2019 union<br \/>\nSAG-AFTRA, also had a moment in the sun at the annual conference<br \/>\nfor songwriters, composers, artists and producers.<\/p>\n<p>If those two unions seem like an odd pairing, they aren\u2019t: since its<br \/>\n2012 founding by way of merger, SAG-AFTRA, like AFTRA<br \/>\nbefore it, has represented recording artists \u2014 singers \u2014 as<br \/>\nwell as actors and others, such as broadcasters.<\/p>\n<p>The joint fund, the AFM &amp; SAG-AFTRA Intellectual Property<br \/>\nRights Distribution Fund, distributed about $60 million in royalties<br \/>\nin 2016 and thus will be welcome as anything but odd by those<br \/>\nwho receive checks from it \u2014 a variety of singers and musicians,<br \/>\nincluding such non-featured performers as backup singers and<br \/>\nsession musicians, who otherwise might not receive music<br \/>\nroyalties at all.<\/p>\n<p>Although that total is far less than the approximately $1 billion<br \/>\nin residuals that SAG-AFTRA distributes annually, and is also<br \/>\nless than the $90 million to $100 million in audiovisual AFM<br \/>\nresiduals that are disbursed each year (which are administered<br \/>\nby yet another organization, the Film Musicians Secondary<br \/>\nMarkets Fund), the checks can be significant, ranging up to<br \/>\n$1 million in some cases, said fund executive director Dennis<br \/>\nDreith.<\/p>\n<p>\u201cWe do for non-featured performers what SoundExchange<br \/>\nand AARC do for featured performers,\u201d explained Dreith,<br \/>\nreferencing two other music royalty organizations. He spoke<br \/>\nto The Hollywood Reporter after conducting a seminar Friday<br \/>\nfor about 100 people at the Expo.<\/p>\n<p>One recipient of a payment from the fund was so unaccustomed<br \/>\nto receiving royalties that she rang up Dreith and asked if she<br \/>\nwas really allowed to cash the check. He assured her that she was.<\/p>\n<p>Citing the case of a former Motown session bass player who he said<br \/>\ndied impoverished after helping churn out hit after hit (\u201cYou Can&#8217;t<br \/>\nHurry Love\u201d by The Supremes, \u201cMy Girl\u201d by The Temptations,<br \/>\nand dozens more), Dreith added that the fund helps ensure that<br \/>\n\u201cthere won\u2019t be another James Jamerson,\u201d at least in the economic sense.<\/p>\n<p>Where the Money Comes From<\/p>\n<p>Unlike Expo organizer ASCAP, which collects and pays royalties to<br \/>\nsongwriters and composers, the joint union fund is for performers.<br \/>\nIt was established in 1998, which may give a clue as to its initial<br \/>\nscope: the royalties are collected from U.S. digital platforms, but<br \/>\nnot from U.S. terrestrial (conventional) radio, as to which there<br \/>\nis no provision in law for performance royalties. The Fair Play<br \/>\nFair Pay Act, which the fund and unions vigorously support,<br \/>\nwould change that and require AM and FM stations to pay<br \/>\nsuch royalties, too.<\/p>\n<p>Those for-now digital royalties are paid to non-featured vocalists and<br \/>\nnon-featured musicians regardless of their union membership or<br \/>\naffiliations. The fund collects foreign performance royalties for<br \/>\nU.S. non-featured performers as well, but only for members of<br \/>\nAFM and SAG-AFTRA.<\/p>\n<p>That, anyway, is what the sound recording division of the fund<br \/>\ndoes. Two more recent arms, the symphonic royalties and<br \/>\naudiovisual divisions, represent evolutions beyond digital-only.<br \/>\nThe first focuses on royalties for featured and non-featured<br \/>\nperformers in symphonic sound recordings, including archival<br \/>\nrecordings and radio broadcasts licensed for use on cable,<br \/>\nsatellite and digital media. And the audiovisual division<br \/>\ncollects royalties \u2014 again, for featured and non-featured<br \/>\nsingers and musicians \u2014 from foreign territories for films<br \/>\nand television programs containing U.S. performers, which<br \/>\nhave been broadcast on Spanish and German television,<br \/>\nand motion pictures containing U.S. performers, which have<br \/>\nbeen exhibited in cinemas in Spain.<\/p>\n<p>There is no word on whether that limited geographic portfolio<br \/>\nmight expand.<\/p>\n<p>Like residuals, which inspired this reporter to prepare a<br \/>\ncolored chart that Backstage likened to \u201ca periodic table of<br \/>\nelements on mushrooms,\u201d music royalties are complex: a<br \/>\nflowchart in the ninth edition of Harold Vogel\u2019s definitive<br \/>\nEntertainment Industry Economics, which features almost<br \/>\ntwo-dozen circles, squares and other shapes and a similar<br \/>\ncomplement of connecting lines, looks like an oil refinery<br \/>\ndiagram \u2014 except that the latter is easier to understand.<br \/>\nIndeed, turning bauxite into aluminum is apparently simpler<br \/>\nthan the way money flows in the music business. But in one<br \/>\nsmall corner, at least, the AFM &amp; SAG-AFTRA fund has it covered.<\/p>\n<p>===================================<\/p>\n<p>III.
