DID YOU RECEIVE THIS? &#8211; PENSION FUND<\/p>\n<p>The purpose of this notice is to inform you that, on June 28,<br \/>\n2013, the actuary for the American Federation of Musicians<br \/>\nand Employers\u2019 Pension Fund (the \u201cPlan\u201d) certified to the U.S.<br \/>\nDepartment of the Treasury, and also to the Plan\u2019s Board of<br \/>\nTrustees (\u201cBoard\u201d), that the Plan is in critical status for the<br \/>\nPlan year beginning April 1, 2013. Federal law requires that<br \/>\nyou receive this notice.<\/p>\n<p>Critical Status<br \/>\nThe Plan is considered to be in critical status because it<br \/>\nhas funding problems. More specifically, the Plan\u2019s<br \/>\nactuary has certified that the Plan is in critical status<br \/>\nbecause the Plan is projected to have an accumulated<br \/>\nfunding deficiency over the next nine years due to<br \/>\na projected funding deficiency for the Plan year<br \/>\nending March 31, 2019.<\/p>\n<p>Rehabilitation Plan and Possibility of Reduction in Benefits<\/p>\n<p>Federal law requires pension plans in critical status<br \/>\nto adopt a rehabilitation plan aimed at restoring<br \/>\nthe financial health of the plan. This is the fourth<br \/>\nyear the Plan has been in critical status. The law<br \/>\npermits pension plans to reduce, or even<br \/>\neliminate, benefits called \u201cadjustable benefits\u201d<br \/>\nas part of a rehabilitation plan. On April 30,<br \/>\n2010, you were notified that the Board had<br \/>\nadopted a rehabilitation plan (the \u201c<br \/>\nRehabilitation Plan\u201d) that reduced or eliminated<br \/>\nadjustable benefits. As of June 1, 2010, the<br \/>\nPlan is not permitted to pay lump sum benefits<br \/>\n(or any other payment in excess of the monthly<br \/>\namount paid under a single life annuity) while<br \/>\nit is in critical status. If the Board determines<br \/>\nthat further benefit reductions are necessary,<br \/>\nyou will receive a separate notice in the future<br \/>\nidentifying and explaining the effect of those<br \/>\nreductions. Under current law, any reduction of<br \/>\nadjustable benefits will not reduce the level of<br \/>\na participant\u2019s basic benefit payable at normal<br \/>\nretirement, and the reductions apply only to<br \/>\nparticipants and beneficiaries whose benefit<br \/>\ncommencement date is on or after June 1, 2010.<\/p>\n<p>The Board has not made additional changes in<br \/>\nbenefits since the adoption of the Rehabilitation Plan.<\/p>\n<p>Adjustable Benefits<\/p>\n<p>The Plan previously offered the following adjustable<br \/>\nbenefits that could be reduced or eliminated as part<br \/>\nof any rehabilitation plan adopted by the Board:<\/p>\n<p>Post-retirement death benefits\/guarantees\u2028Early retirement benefit or retirement-type subsidy\u2028<br \/>\nBenefit payment options other than a qualified joint-and<br \/>\nsurvivor annuity (QJSA)  Post-normal retirement age subsidy<br \/>\nAs noted above, the Rehabilitation Plan eliminated<br \/>\nadjustable benefits as described in the notice entitled<br \/>\nImportant Notice of Benefit Changes, which was sent<br \/>\nto you April 30, 2010 and is available at<br \/>\nhttp:\/\/www.afm-epf.org\/Portals\/2\/AFMDocuments\/204h%205-1-2010.pdf<br \/>\nor by written request to the Fund Office.<\/p>\n<p>Notice of Critical Status<br \/>\nAmerican Federation of Musicians and Employers\u2019 Pension<br \/>\nFund For Plan Year Beginning April 1, 2013 and Ending<br \/>\nMarch 31, 2014<br \/>\n\ufffc<\/p>\n<p>Employer Surcharge<\/p>\n<p>The law requires that all contributing employers pay to<br \/>\nthe Plan a surcharge to help correct the Plan\u2019s financial<br \/>\nsituation until the bargaining parties amend their<br \/>\ncollective bargaining agreement to include terms<br \/>\nconsistent with the schedules set forth in the Rehabilitation<br \/>\nPlan. The amount of the surcharge is equal to a percentage<br \/>\nof the amount an employer is otherwise required to<br \/>\ncontribute to the Plan under the applicable collective<br \/>\nbargaining agreement. With some exceptions, a 5%<br \/>\nsurcharge was applicable in the initial critical year<br \/>\n(Plan year ended March 31, 2011) and a 10% surcharge<br \/>\nwas applicable for the Plan year beginning April 1, 2011<br \/>\nand remains applicable for each succeeding Plan year<br \/>\nthereafter in which the Plan is in critical status.
