Symphonic musician<br \/>\n&#8230;Reporting issues the Musicians Union doesn&#8217;t dare to mention &#8211; National touring musician<\/p>\n<p>===================================<\/p>\n<p>I. LETTER TO LOCAL 47 BOARD<\/p>\n<p>Below is a letter sent to the Local 47 Executive board by<br \/>\na long standing member:<\/p>\n<p>To: The Executive Board of Local 47, Musicians Union<br \/>\n&#8211; April 28, 2016<\/p>\n<p>You have asked me to write a letter on the reasons<br \/>\nwhy I went fi-core (Beck status) due to the expense<br \/>\nof my charge through the NLRB. On the surface, my<br \/>\nreasons were purely an emotional response to<br \/>\nJohn Acosta&#8217;s words &#8220;The union is for everyone&#8221;<br \/>\nwhich I whole heartedly agree with but I find sorely<br \/>\nlacking today.<\/p>\n<p>The fact is the musicians&#8217; interest has not been<br \/>\naddressed in well over a decade. The contracts<br \/>\n(mp,tv,video games) that are made today, with<br \/>\nanother group&#8217;s input, are mostly centered around<br \/>\nthe secondary market fund. One example of this<br \/>\n(and showing who controls the union) was when<br \/>\nthe first video game contract came out. The<br \/>\nmusicians were happy (a living wage), the<br \/>\ncompanies were happy and the composers (the<br \/>\nlifeblood of musicians) were happy. But it was<br \/>\nshut down due to the fact there was no secondary<br \/>\nmarket fund attached. The result of this was<br \/>\ncompanies who were willing to deal with the<br \/>\nunion now want nothing to do with the union.<br \/>\nThe composers were estranged. As for the<br \/>\nmusicians, it doesn&#8217;t matter what the contracts<br \/>\nare. No companies mean no composers which<br \/>\nmean no music therefore no jobs. All because<br \/>\na select few want their secondary markets fund.<\/p>\n<p>The union is for everyone?<\/p>\n<p>An Interesting point is the secondary market<br \/>\nfund used to be known as special payments<br \/>\nand was based on single scale. This meant<br \/>\neveryone shared equally on a project. This fund<br \/>\nwas initially set up by the studios in lieu of health<br \/>\ncoverage for the musicians. What we have today<br \/>\nis everyone connected with the project, except<br \/>\nthe musicians is taking the bulk of the secondary<br \/>\nmarket funds. If this is untrue, please show me<br \/>\nthe breakdown of the fund.<\/p>\n<p>Another indication of the controlling faction<br \/>\nin the union was centered around the movie &#8220;UP&#8221;<br \/>\nin 2009. Michael Giacchino won the Academy<br \/>\nAward for his score which was done in Los Angeles.<br \/>\nThis was a great win for Local 47 and Los Angeles<br \/>\nor so one would think. However, the union&#8217;s paper<br \/>\nhad no mention of his award or that year&#8217;s Academy<br \/>\nAward orchestra which Michael Giacchino conducted.<br \/>\nIf the union is for everyone why did this happen<br \/>\n(besides the fact certain people had no part in this<br \/>\nmovie)?<\/p>\n<p>My final reason for going fi-core is I was continuously<br \/>\nupset and depressed over seeing great musicians and<br \/>\nfriends constantly having to look over their shoulders<br \/>\nfor the crime of simply trying to support their families.<\/p>\n<p>I honestly did not want to go after the union but I felt<br \/>\nI could no longer standby and do nothing. I expressed<br \/>\nmy feelings to the NLRB agent and Rick Baptist and made<br \/>\nit clear none of the charges that I stated (a: being<br \/>\nthreatened and intimidated from going fi-core;<br \/>\nb: the selective enforcement of the unions own bylaws)<br \/>\nwere done to me. This led to the charges being dropped.<\/p>\n<p>There were two reasons why I rejoined the union. When<br \/>\nI talked with Rick Baptist, (whom I have known for 30<br \/>\nyears and wanted him to understand why I went fi-core),<br \/>\nI was led to believe that things are changing for the<br \/>\nbetter. The second reason was the Supreme Court&#8217;s<br \/>\nalmost deciding in January 2016 against California&#8217;s<br \/>\nunions. I firmly believe that a strong Union is needed<br \/>\nnow more than ever.<\/p>\n<p>I must add when I started working in this town,<br \/>\nabout 35 years ago, I thought I had the greatest<br \/>\njob ever. The workplace has gone through many<br \/>\nchanges including a very dark time when if you<br \/>\nlaughed or smiled you were considered unprofessional.<br \/>\nTo see younger people think that this antiseptic,<br \/>\nlifeless, tinged with fear approach to music is the<br \/>\nway to play in the studios makes me very sad.<\/p>\n<p>How can music possibly flourish under these<br \/>\nconditions?<\/p>\n<p>This letter and my actions are simply an attempt<br \/>\nto preserve, for future generations, the same<br \/>\nattributes of creativity, love, enjoyment and<br \/>\nequality which has made my career fulfilling. I<br \/>\nwould have never had the financial life I have<br \/>\nbeen so fortunate to have in LA if it wasn&#8217;t for<br \/>\nthe union and the people in it before me.<\/p>\n<p>[Follow-up from the member]<\/p>\n<p>Hi, don&#8217;t know if you have posted that letter<br \/>\nyet but if you haven&#8217;t please add this.<\/p>\n<p>&#8221; The author of this letter gives permission<br \/>\nto post this because he has found nothing<br \/>\nhas really changed with the union. Why the<br \/>\nunion continues not to change reminds him<br \/>\nof the saying &#8220;all they are doing are rearranging<br \/>\nthe deck chairs on the Titanic&#8221;. It doesn&#8217;t have<br \/>\nto be like this.<\/p>\n<p>He hopes it does change for the Union&#8217;s sake.<\/p>\n<p>[COLLEAGUES: Now we have yet ANOTHER member<br \/>\npointing out exactly what the committee has<br \/>\nbeen saying all along. Certainly, there will be<br \/>\nthose who say, &#8220;Oh, Fernandez wrote that&#8221;, but<br \/>\nthe Local 47 board knows exactly who wrote it.]<\/p>\n<p>======================================<\/p>\n<p>III.
