AN APOLOGY TO LOCAL 47<\/p>\n<p>Earlier this week, President Espinosa used an email blast from Local 47 to demand an apology from the COMMITTEE for information we supposedly \u201cmade up\u201d.<\/p>\n<p>1) DEPOSITIONS:<br \/>\n Mr. Espinosa in depositions? We used information from several<br \/>\nhighly placed sources inside and outside of the Local. We do not<br \/>\nmake anything up and there would be no benefit for us to do so.<\/p>\n<p>You can read about just one of the actions against our Local here:<br \/>\nhttp:\/\/www.nrtw.org\/press\/2007\/10\/hollywood-union-hit-federal-charge-after-union-officials-threaten-musicians-arrests. While this isn\u2019t new and \u201cMAY\u201d be the complaint that was dismissed according to the President\u2019s letter, there are other complaints that have not, as you will see below.<\/p>\n<p><!--more--><\/p>\n<p>QUESTION:<br \/>\n Before you received the email from the Local, precipitated by thier latest<br \/>\nattempt to discredit the COMMITTEE (no doubt in preparation for the<br \/>\nupcoming Local elections in December), were you aware of the one<br \/>\npresent lawsuit and the three as yet unresolved NLRB (National Labor<br \/>\nRelations Board) complaints against our Local?<\/p>\n<p>The wording of President Espinosa\u2019s letter begs the next question. While there<br \/>\nis only \u201cone outstanding lawsuit\u201d, are their any recent lawsuits that have<br \/>\nbeen settled, won or lost that Mr. Espinosa DID give depositions for, or were their<br \/>\nOTHER Local personnel who gave the depositions?<\/p>\n<p>IF the information from our multiple sources about Mr. Espinosa\u2019s depositions<br \/>\nwas in error, we gladly give and you may accept the appropriate apology. <\/p>\n<p>2) LAWSUITS:<br \/>\nThe settlement details of the ERROL HENRY\/BARBARA MARKAY<br \/>\nlawsuits were and are confidential, the fact that they were settled is not<br \/>\nconfidential.<br \/>\nNo apology there.<\/p>\n<p>3) If Local 47 paid for the policy that pays any such settlement,<br \/>\nWE in effect paid for it. <\/p>\n<p>Next Item<\/p>\n<p> There is a general air of secrecy because of what looks to be<br \/>\n&#8220;behind closed doors&#8221; abuses of &#8220;executive session&#8221;, as was<br \/>\ndetailed in a previous mailing. Perhaps it will be good for you<br \/>\n(Hal) to articulate what kind of business (in general terms) gets<br \/>\nthe executive session treatment.<\/p>\n<p>Since there seems to be nothing in the By-Laws that articulate<br \/>\nthe subjects covered by executive session, please give the<br \/>\nmembership some general understanding of what it is that<br \/>\nrightly should not be in open session. Perhaps in doing this,<br \/>\nyou can reflect on the business that you actually discuss in<br \/>\nexecutive session and see whether all of it can be justified in<br \/>\nlight of your responsibilities to the MEMBERSHIP.<\/p>\n<p>===============<\/p>\n<p>II. MORE ATTACKS ON THE REFERRAL SERVICE<\/p>\n<p>At the last meeting, Member Jay Rosen seemed to do the Local 47<br \/>\nOfficers\u2019 bidding in enabling the overturning of a motion meant to<br \/>\nprotect the Referral Service office from being buried in the back<br \/>\nof the Local.<\/p>\n<p>We have it on good authority that this time, someone else will be<br \/>\nthe board\u2019s appointee to call for the reversing  of the motion from<br \/>\nthe October 22nd meeting, the motion that is forcing the board to<br \/>\nbring the RS office to the level of success enjoyed before its<br \/>\ngutting by the Espinosa Administration. <\/p>\n<p>Disgruntled members who don\u2019t even use the RS have been expressing<br \/>\nthe opinion that the RS office should not be re-located but allowed to<br \/>\nsimply disappear, because it\u2019s brought in so little income recently.<br \/>\nOf course, these \u201cdisgruntled members\u201d leave out the fact that it is<br \/>\nthe Espinosa Administration\u2019s gutting of the RS that has led to<br \/>\nthis situation.<\/p>\n<p>NOT USING THE RS OFFICE?<\/p>\n<p>There are COMMITTEE members who have never used the RS<br \/>\nand most likely will not use it in the future, but we understand it\u2019s<br \/>\nimportance to the freelance musicians and are happy and willing<br \/>\nto support a service that does not benefit us directly.<\/p>\n<p>We received these two statements concerning the upcoming meeting<br \/>\non April 28th, 2008.<\/p>\n<p>\u2022MEMBER COMMENTS CONCERNING THE FUTURE OF THE RS.\u2022<\/p>\n<p>There is a plan afoot for the April GM:<br \/>\nOur EB has paid our Local #47 attorney (with OUR dues money) to<br \/>\nstate that the Oct 22, 2007 Passed Motions (restoring the RS employees,<br \/>\nbudget and effectiveness) are not valid because the June 2005 Special<br \/>\nMeeting (where FMA Members voted that the RS must stay where it<br \/>\nis) was not valid.  They are going to argue that the Motions are tied to<br \/>\nthe location.<\/p>\n<p>Huh?? The two have ABSOLUTELY NOTHING to do with each other \u2013<br \/>\nthe RS will be \u201crestored to its effectiveness\u201d because THAT IS THE<br \/>\nWILL OF THE MEMBERS by legal, binding Bylaw-approved Majority<br \/>\nVote.  The RS location is not mentioned in the Passed Motions and has<br \/>\nno bearing on the situation.<\/p>\n<p>The RS Committee stated at the RS meeting on May 27 that \u201cwe are in<br \/>\nfavor of the RS being moved to the new location proposed by Amie Moore.\u201d<br \/>\n(This would be the area through the double doors to the left of the Security<br \/>\ndesk, taking out the wall of Al Rubalcava\u2019s old office\u2026 actually an<br \/>\nimprovement.) <\/p>\n<p>This disarms the \u201cmoving the RS\u201d argument in any case\u2026 except now the<br \/>\nRS isn\u2019t going into a broom closet the way the EB wanted it to.<\/p>\n<p>So\u2026 is our Executive Board now paying our lawyer to find ways to violate<br \/>\nour Bylaws? Whatever trick it is, you can bet we\u2019ll all be taking notes so<br \/>\nwe can use the same trick as well.<\/p>\n<p>And we\u2019ll be informing the Dept of Labor<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>\u201cWe need to make SURE we have EVERYONE at the April 28<br \/>\nGeneral Meeting \u02c6 I just heard that certain disgruntled Members<br \/>\n(who don&#8217;t use the RS themselves, and have lost sight of the<br \/>\npurpose of a Fraternal Union) are going to try to overturn our<br \/>\nPassed Motions from the Oct 22 GM \u02c6 the Motions which are<br \/>\nforcing them to restore the Referral Service. <\/p>\n<p>WE HAVE THE VOTES! But only if we ALL show up and vote!<\/p>\n<p>Please spread the word!\u201d<\/p>\n<p>&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>Please spread the word indeed!<\/p>\n<p>WE NEED YOU AT THE APRIL 28TH GM MEETING TO STAVE<br \/>\nOFF THE NEXT ATTACK ON THE RANK AND FILE SERVICES.<\/p>\n<p>================<\/p>\n<p>III. THE LAST REFERRAL SERVICE WEBSITE MEETING<\/p>\n<p>The last RS website meeting was, from all reports, well attended<br \/>\nand very informative.<\/p>\n<p>OTHER INFORMATION LEARNED:<br \/>\n\u2022Local 47 RS Website programmer Ray Garcia gave the attendees<br \/>\ninformation that the website is still under construction. Several<br \/>\nsuggestions for improvements were made by members. He informed<br \/>\nthose in attendance that they just changed the system so it will update<br \/>\nin one day instead of a week, and the member can see previews, etc.<\/p>\n<p>\u2022Secretary Lashinsky, who attended the meeting, was reminded<br \/>\nthat members are expecting the Executive Board to abide by the<br \/>\npassed motions from the Oct 22 general meeting, one of which<br \/>\nsays they must \u201crestore and then surpass\u201d the highest level of<br \/>\neffectiveness of the RS, and its advertising budget. <\/p>\n<p>\u2022The RS Committee made clear that as members of the Local, they<br \/>\ndeserve all information on the building, running and maintaining<br \/>\nof the RS Website as well as being able to express suggestions or<br \/>\ncomplaints. <\/p>\n<p>\u2022Lastly, it was pointed out that the Referral Service Committee<br \/>\nis expecting the RS to make regular outgoing phone calls to<br \/>\nchambers of commerce, city halls, film companies, other long-<br \/>\ntime clients, etc \u2013 like it used to under David Schubach and Errol<br \/>\nHenry.<\/p>\n<p>Thank you to the Referral Service Committee for keeping the<br \/>\nmeeting open and honest!<\/p>\n<p>Bravo!<\/p>\n<p>==============<\/p>\n<p>IV. POSITIVE CHANGES AT THE RMALA?<\/p>\n<p>It would seem that by many measures, the election of Pete Anthony<br \/>\nto the Presidency has been a good thing.<\/p>\n<p>Improvements we\u2019ve seen:<br \/>\n1) Promising communications are open with the AFM for the first<br \/>\ntime in years.<br \/>\n2) They are trying to communicate with their members in a<br \/>\nmore transparent way. (A series of meetings at area homes is<br \/>\nscheduled.)<br \/>\n3) They are acknowledging for the first time the fear of retaliation<br \/>\nfor speaking truth to power by enabling members to submit<br \/>\nquestions anonymously for the upcoming meetings. <\/p>\n<p>Their realization of this fact, one they have refuted for YEARS, can be<br \/>\na big step toward changing other conduct.<\/p>\n<p>Hopefully, these meetings aren\u2019t simply to coerce their members to pack<br \/>\nthe April meeting to further damage the Local for the freelance and<br \/>\ncasual musicians. That will depend on who is running them.<\/p>\n<p>Given the influence of the RMA on our Local 47 board, perhaps<br \/>\nMr. Anthony can remind the Local 47 board and rank and file<br \/>\nRMA members that it does them no harm to have a working<br \/>\nviable and growing Referral Service office for the rank and file<br \/>\nLocal 47 members. <\/p>\n<p>A strong RS cannot affect their ability to work one iota and its at times<br \/>\nlike this that we have to open more work access possibilities, not shut<br \/>\nthem down or limit their effectiveness.<\/p>\n<p>================<\/p>\n<p>V. MORE MEMBER RESPONSES TO RUNAWAY SCORING SOLUTION<\/p>\n<p>Here are a few more responses to our \u201cMEMBER IDEA\u201d section.<\/p>\n<p>&#8212;&#8212;&#8212;-<\/p>\n<p>About your solutions to runaway scoring. You can&#8217;t force production<br \/>\ncompanies to work with us. Threatening to make them in-eligible for<br \/>\nawards will never work. Getting other unions to side with us<br \/>\nobviously isn&#8217;t going to happen. If we want to bring back work we<br \/>\nhave to compete for it. We have to give the best product for the best<br \/>\nprice, end of story. That is how the work was taken from us &#038; that is<br \/>\nthe only way we will get it back. <\/p>\n<p>&#8212;&#8212;&#8212;-<\/p>\n<p>Patty Zimmitti had an idea before she passed away that was very simple<br \/>\nand would still work. Have a Buy-out rate for films that don&#8217;t want to<br \/>\nsign an assumption agreement. Make the rate higher as to build in any<br \/>\npotential back end. Since soundtracks are dead this could be included<br \/>\nas well. This is exactly what London did. If you want to score in<br \/>\nLondon TODAY and not pay the higher &#8220;buy-out&#8221; rate you still can.<br \/>\nThis is very simple and would retrieve a good percentage of the work,<br \/>\nnot every film but most. Given the current exchange rate for London,<br \/>\nthis is the perfect time. It could be cheaper to score here than in<br \/>\nLondon. And since London is the only competition that has equal (or<br \/>\ngreater) quality of musicians and facilities in the world that is all<br \/>\nyou can worry about. You can&#8217;t compete with inferior, cheap and bad<br \/>\nsounding orchestras and recordings. &#8220;You get what you pay for and<br \/>\nsometimes less&#8221;. So the AFM should be realistic and become<br \/>\ncompetitive with like product. You will never get any producer to<br \/>\nrecord here that would be willing to sacrifice quality for dollars.<br \/>\nThe good news is that people are recording orchestras everywhere<br \/>\nwhich means that they are writing and recording orchestral music. If<br \/>\nwe can become competitive there might actually be a chance to keep<br \/>\nthe orchestral recording business alive in LA. <\/p>\n<p>The other point that I would like to make is about this $50,000 fine<br \/>\nnonsense. When one wants to support a union what do you do:  you<br \/>\nboycott the nonunion company, not the workers. It is clear as to who<br \/>\nthese companies are. Print a boycott list. Fine the the production<br \/>\ncompanies that are also distributers. The studios own the<br \/>\ndistribution companies that distribute all of the non-union films. If<br \/>\none really wants to be tough, make the contract with the studios<br \/>\ninclude all of the films that they participate in, not just the ones<br \/>\nthat they &#8220;produce&#8221;. This is done by all of the other unions. Fining<br \/>\nPete Anthony or some poor orchestrator for trying to make a living<br \/>\nshows to the world how weak, pitiful and powerless the musician&#8217;s<br \/>\nunion has become. It also does not give the people who occasionally<br \/>\nhave some modicum of influence to keep a project in Los Angeles any<br \/>\nfaith or desire to do such a thing. <\/p>\n<p>Lastly, there is a real problem here that is eating at the very core<br \/>\nof what we are discussing. Because there is so little work and so few<br \/>\nscoring stages left in Los Angeles, there is no incentive for young<br \/>\nmusicians to come try to become part of this system. Pretty soon, the<br \/>\ngreed and lack of any creative approach to problem solving will<br \/>\ndestroy whatever is left.<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>getting the no awards for any non-union work can work but<br \/>\nit will have to be with the RMALA and the AFM spearheading it to<br \/>\nthe other unions so we &#8220;come with the lunch&#8221;<\/p>\n<p>we would actually have to all work together \u2013 <\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<p>I really don&#8217;t think the &#8221; Made\/Scored in Hollywood or Forget<br \/>\nAbout Industry Recognition&#8221; is the proper approach. Movies will be made and<br \/>\nMake money with or without Hollywood.  The last thing I think any Local<br \/>\nshould do it to shut out the competition in the public eye.  When the public<br \/>\nlooses it&#8217;s respect and fascination with the glorious past of Hollywood, it will<br \/>\njust move on.  I don&#8217;t think Paris will ever publicly shut out the Italian designers<br \/>\nfor the same reason.<\/p>\n<p>==============<\/p>\n<p>VI. My own story is yet another reflection of the unresponsive and unhelpful<br \/>\npeople at Local 47.  My name is Harvey Wyerman and I am recently retired after<br \/>\n40 years of a successful law practice.  Upon my retirement my dream was to take<br \/>\nup my old friend the tenor saxophone and, after refreshing myself on the basics<br \/>\nof the instrument, join in harmonic joy with my fellow musicians while making a<br \/>\nbuck or two to feed myself and my wife Gladys (though we do enjoy the benefit<br \/>\nof several generous trust funds from my various successes in public litigation).  I<br \/>\n dug out all my old Rubank methods as well as what sheet music I had saved from<br \/>\nthe 50&#8217;s (Ah, those were the days&#8230;) and soon was up to snuff.  Joining the union<br \/>\nseemed the next logical step, which I did.  But after that the door seemed to shut in<br \/>\nmy face.  I would frequently call the various officers and employees, wanting to<br \/>\nget together for a friendly &#8220;jam&#8221; or just a cup of coffee to see how I could break<br \/>\ninto the biz but no one seemed interested in giving me the time of day.  This was<br \/>\nnot the comradery I had expected nor does it seem to reflect what all of us should<br \/>\ncherish; the love of music and the sheer joy of playing together and making a<br \/>\nliving.  Perhaps those people that you call the &#8220;RMA&#8221; are the ones that have taken<br \/>\nall the fun out of the game, or are stealing it all for themselves.  Shame on them!<br \/>\nPlease excuse the ramblings of an old man (I am in my 70s) but this thing just makes<br \/>\nme so angry. We would<br \/>\nsuggest as 3 possible starting points:<br \/>\n1) Go to the monthly Local 47 jam session<br \/>\n(They occur on every 3rd Saturday of the month from 1PM to 3:30 PM<br \/>\nin the auditorium of the Local \u2013 for questions call (323) 993-3157 );<br \/>\n2) Approach one of the many Big Bands who rehearse weekly about sitting<br \/>\nin; and<br \/>\n3)As you\u2019re coming back to the sax after so long, you might also consider<br \/>\njoining a community wind band so you can get used to playing with a<br \/>\nensemble again.]<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>LA better wake up and smell the jet fuel being expelled at LAX with the<br \/>\nproducers and composer teams on those very planes flying around the<br \/>\nworld to record music written by a composer that actually lives and works<br \/>\nin Los Angeles.<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>Dear Committee:<\/p>\n<p>This is a post on the Film Music Magazine&#8217;s Composer&#8217;s Forum;<\/p>\n<p>[&#8220;Thanks ****, <\/p>\n<p>That&#8217;s too bad about the cancelation.  There&#8217;s a guy out of Boston who<br \/>\n runs a &#8220;faux orchestra&#8221;, which is to say he programs computers with the<br \/>\n Vienna Symphonic Library and gives electronic concerts.  I can&#8217;t think<br \/>\n of his name, but he has rigged a Wii controller (the motion sensitive<br \/>\n controller for Nintendo&#8217;s Wii video game console) to Logic via midi and<br \/>\n conducts (at least tempo-wise, and a little velocity sensitive<br \/>\n stuff-wise) his computer by the vertical wave of the controller (the vertical<br \/>\n pulse translates to pushing the music forward one beat).  <\/p>\n<p> This may seem silly, but it leaves the possibility of conducting a<br \/>\n single live player or a small group of live players in your home along with<br \/>\n your midi synth, alleviating the need for a live player to learn and<br \/>\n follow a click track (seems the classical players prefer to be conducted<br \/>\n versus following a click).  The technology is still in its infancy,<br \/>\n and i haven&#8217;t heard of anyone trying this approach to score sweetening,<br \/>\n but maybe some day?  And if so, you&#8217;ll possibly have a larger pool of<br \/>\n composers to appeal to if part of a workshop includes a synth\/live hybrid<br \/>\n conducting component. ] <\/p>\n<p>So NOW what do we (47) do to get up on this new technology?<br \/>\nI was going to write some parody here about fearless leadership bravely<br \/>\nCharging into the future. If we do<br \/>\nwe will let everyone know.]<\/p>\n<p>&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>BTW, do you think it&#8217;s better to talk out loud about folks\/companies<br \/>\nthat &#8216;lower the bar&#8217; for everyone,<br \/>\nor sweeping their free publicity under the radar\/rug? <\/p>\n<p>I see that Mark&#8217;s FMN newsletter always seem to find some new person<br \/>\nor company that has lowered the bar and then to my dismay, seems to salute<br \/>\nthem for their ingenuity in getting work (even if it seems that their &#8220;bait&#8221;<br \/>\nis some new idea of how to &#8216;lower the bar&#8217; for the clients we all<br \/>\nseek to make their company more attractive. <\/p>\n<p>This last issue seems to celebrate someone for sharing writer&#8217;s credit (and in<br \/>\neffect a kickback\/residual payment) for contributing in the creative process<br \/>\nfor a project. In the past and present it was always the duty of the person hiring<br \/>\nyou to help guide the project, but to now give them a percentage of publishing<br \/>\nfor doing so seems like a kickback and unethical behavior on the music companies<br \/>\npart. <\/p>\n<p>I&#8217;m not surprised the official&#8217;s company hasn&#8217;t objected in today&#8217;s<br \/>\natmosphere of government officials turning over their jobs to<br \/>\ncome back and lobby the same departments they formally worked<br \/>\nfor, etc.  In the past, most companies wouldn&#8217;t stand for this type<br \/>\nof behavior. <\/p>\n<p>After all that person is already paid a handsome salary to take<br \/>\ncare of this type of business, they shouldn&#8217;t be acquiring bonuses<br \/>\nfrom the people they hire and over see.??? <\/p>\n<p>just a thought&#8230; <\/p>\n<p>=============<\/p>\n<p>Colleagues,<\/p>\n<p>The April 28th meeting may be a contentious one, one that can take more<br \/>\nrights and services away from the rank and file Local 47 members.
