RESOLUTION No. 4<\/p>\n<p>Here is the RESOLUTION presented to the LAW committee and<br \/>\nthe AFM Convention this week in Las Vegas.<\/p>\n<p>Recording contracts and RMA role<\/p>\n<p>WHEREAS, The RMA policy of refusing to allow buyouts options for<br \/>\nAFM recording contracts, has resulted in an 80%+ reduction of<br \/>\nrecording work in Los Angeles and across the federation, also<br \/>\nplaying a role in Local 47 needing to sell it&#8217;s historic building<\/p>\n<p>and<\/p>\n<p>WHEREAS, This policy promoted by the RMA has led to multiple<br \/>\nlocations across the federation recording non-union because<br \/>\ncontracts are unusable. (i.e. Nashville, Los Angeles &#8211; dark,<br \/>\nVirginia, Indiana, New York &#8211; dark, San Francisco &#8211; dark,<br \/>\nVancouver, etc., Seattle)<\/p>\n<p>WHEREAS, Repeated lawsuits by the RMA, through its surrogates,<br \/>\nagainst the AFM have squandered hundreds of thousands of dollars<br \/>\nof rank and file musicians&#8217; dues in frivolous and self-serving<br \/>\nlitigation.<\/p>\n<p>WHEREAS,\u00a0 the unsuccessful campaign instigated by the RMA<br \/>\nagainst Lions Gate has also wasted tens of thousands of dollars<br \/>\nof rank and file musicians&#8217; dues; and<\/p>\n<p>WHEREAS the Colorado Symphony has decertified the AFM because<br \/>\nof ineffective media restrictions. (This was later removed)<\/p>\n<p>Whereas\u00a0the AFM,\u00a0while adopting most of the RMA\u2019s ineffective<br \/>\npolicies, has refused to sanction union members in Nashville<br \/>\ndoing non-union recording projects despite the fact that the<br \/>\nNashville local president is a member of the IEB; and<\/p>\n<p>WHEREAS, Officers of the RMA have participated in recording<br \/>\nsessions outside of the U.S. and have played on domestic<br \/>\nlibrary recording sessions also without AFM sanctions; and<\/p>\n<p>WHEREAS, both the AFM and RMA have no program, whatsoever,<br \/>\nto improve the economic hardships faced by recording musicians:<br \/>\ntherefore, be it<\/p>\n<p>RESOLVED, That the AFM move forward to allow proper buyout<br \/>\nand competitive contracts in areas such as Video Games, Trailers,<br \/>\nSamples, Low and Medium Budget Films etc.; and be it further.<\/p>\n<p>RESOLVED, That to accomplish this, the destructive influence of<br \/>\nthe RMA be removed by excluding it from any role in the<br \/>\nformation, execution or creation of any AFM contracts<\/p>\n<p>Submitted by Local 300<\/p>\n<p>===============================<\/p>\n<p>II. HISTORY CALLING FOR THE RMA REMOVAL RESOLUTION<\/p>\n<p>Colleagues,<\/p>\n<p>Long time AFM and Local 47 member Charles Fernandez attended<br \/>\nthe convention with the intention of speaking in support of the<br \/>\nresolution.<\/p>\n<p>Unfortunately, Member Fernandez was not informed as to when the<br \/>\ncommittee would discuss Resolution 4, so was not in attendance<br \/>\nwhen it was. Whether this was by design, or accidental, we don&#8217;t<br \/>\nknow. We do, however, know that member Fernandez was not<br \/>\nallowed to speak on the floor of the convention, though he was<br \/>\ntold he could speak to the committee before the decision.<\/p>\n<p>In other words, the committee made the decision without allowing<br \/>\nsupport expressed for the resolution, while no doubt the RMA was<br \/>\nthere to influence the committee and a decision was made as to it&#8217;s<br \/>\nfate without any feedback from those who wrote the resolution.<\/p>\n<p>Naturally, the sheep at the convention all bowed their heads and<br \/>\nsaid nothing, though they know better than anyone the damage<br \/>\nthe RMA has caused.<\/p>\n<p>Member Fernandez was to speak in favor of the resolution, owing to<br \/>\nhis extensive knowledge of the origin and result of the RMA&#8217;s<br \/>\noutsized role and control of Local 47 and the AFM.<\/p>\n<p>Below you will find Member Fernandez&#8217; entire presentation<br \/>\nprepared for the LAW Committee (Which they never heard.)<\/p>\n<p>ABOUT THE RESOLUTION TO REMOVE THE RMA FROM CONTRACT ROLES<br \/>\nLocal 47 member, Charles Fernandez<\/p>\n<p>The RMA in its original form was the RMAC in the 60\u2019s. It\u2019s incarnation<br \/>\nas the RMA originated in the early 1980\u2019s.<\/p>\n<p>The original concept behind special payments in the 1960&#8217;s was to<br \/>\nattract business with lower, more affordable rates up front with the<br \/>\nunderstanding that if a film was successful, a percentage of that<br \/>\nsuccess (profit) would go to the musicians.<\/p>\n<p>Back when Los Angeles and New York were the only places to record<br \/>\nthis worked fine. The RMA LA contractor, however, spent years<br \/>\ncharging triple and quadruple scales, believing that they had a corner<br \/>\non the market and that producers would never seek another option.<br \/>\nThis same RMA contractor would book most big rooms in town<br \/>\nmaking them unavailable, then cancel all but one at the last minute.<br \/>\nThe contractor would also over book musicians to make them<br \/>\nunavailable, then cancel them at the last minute as well.<\/p>\n<p>An employee at a major music copyist\u2019s office once overheard this<br \/>\nmain RMA contractor telling a potential client, \u201cI\u2019ve got the only<br \/>\norchestra in town and I\u2019m not available, so you need to go elsewhere.\u201d<br \/>\nThis at a time when you could easy have 6 or 7 top notch orchestras in<br \/>\nLos Angeles working at once. It\u2019s not much different today, considering<br \/>\nthere are immeasurably more \u201cA-list\u201d players in Los Angeles than there<br \/>\nare on the \u201cA-list\u201d.<\/p>\n<p>It was bound to happen that producers would tire of being fleeced and<br \/>\nbegin looking elsewhere to record.<\/p>\n<p>With Mr. Holland\u2019s Opus and Die Hard II, Seattle proved it could score<br \/>\nanything LA could and record it did. London as well could and did score<br \/>\nprojects big and small. The horse had left the barn, movie studios could<br \/>\nno longer be held hostage by triple and quadruple budgets and huge<br \/>\nback end payments.<\/p>\n<p>Some RMA members say that the strike of the 1980\u2019s opened the door<br \/>\nto studios looking for other recording options. If the RMA leadership<br \/>\nhad had even the slightest interest in a long term view, the exodus<br \/>\ncould have been slowed, but the back end made the result inevitable,<br \/>\nstrike or not.<\/p>\n<p>The RMA has controlled big budget recording and Local 47 in Los<br \/>\nAngeles for a long time and to a large extent still does. One wrong<br \/>\nword and your recording career was over as can be attested to by<br \/>\n100\u2019s of musicians who fell \u201cout of favor\u201d with the RMA leadership.<br \/>\nThis same threat doesn\u2019t work so well anymore since the work is a<br \/>\nshadow of it\u2019s former self.<\/p>\n<p>Once the work started to leave, the RMA Leadership covered their<br \/>\nears or simply refused to see the inevitable. They were and are the<br \/>\nbuggy whip makers in the age of the remote recording, internet and<br \/>\ncloud technology whose only concern was and is the size of their<br \/>\nJuly check, regardless of the damage caused to anyone else.<\/p>\n<p>But what has the RMA done besides being completely in denial on<br \/>\nthe backend? Local 47 is little more than RMA West, and most of<br \/>\nthe IEB has not had the spine to stand up to them.<\/p>\n<p>A WAR<\/p>\n<p>Let\u2019s talk about the Tom Lee years. The RMA leadership detested<br \/>\nTom Lee because he wouldn\u2019t genuflect to the RMA and insisted<br \/>\non working on the behalf of ALL members.<\/p>\n<p>A case in point was his \u201cVideo Game Agreement\u201d. To this date, it<br \/>\nis only the Tom Lee VG agreement put out by the AFM that has<br \/>\never been used for any significant work.<\/p>\n<p>WHY?<\/p>\n<p>Video games have no back end, never will, but the VG Companies<br \/>\nwill not sign an assumption agreement. The Tom Lee contract<br \/>\nallowed composers to sign the assumption agreement (No back<br \/>\nend to pay, no problem for the composer).<\/p>\n<p>Video Games were scored AFM with this contract; composers,<br \/>\nplayers and the companies were happy.<\/p>\n<p>But since the RMA leadership didn\u2019t have a big say in it\u2019s writing,<br \/>\nand because anything having to do with Tom Lee had to be bad,<br \/>\nthe RMA leadership hated this contract.<\/p>\n<p>They hated it so much in fact, that as an orchestra prepared for<br \/>\nfive days of double sessions for the Simpson\u2019s Video Game, someone<br \/>\nassociated with RMA put notes on the stands of the players saying<br \/>\nin effect, \u201cWe don\u2019t like this contract and we don\u2019t think you<br \/>\nshould be working under this contract.\u201d<\/p>\n<p>Half the orchestra bailed on the sessions, afraid of blacklisting if<br \/>\nthey stayed. The VG Companies were livid and vowed never to<br \/>\nreturn to Los Angeles. The studio and their crew lost a week of<br \/>\nwork. So the work remained union, but went to San Francisco.<br \/>\nNone of those companies would touch LA and the \u201cRMAers\u201d with<br \/>\na 20 foot pole and still won\u2019t.<\/p>\n<p>The RMA leadership never forgot this, as you will see.<\/p>\n<p>THE PMG (THE GUILD)<\/p>\n<p>The RMA Leadership created an illegal \u201cUnion\u201d (their word) called<br \/>\nthe Professional Musicians Guild to record Video Games in the event<br \/>\nthat Tom Lee was re-elected. The listed leadership for both the RMA<br \/>\nand the PMG were similar. Marc Sazar was listed as the PMG Secretary<br \/>\nTreasurer, Vice-President of the RMA, while even being the web master<br \/>\nof Local 47. Conflicts of interest do not come much bigger than this.<br \/>\nHal Espinosa, then president of Local 47, was nothing more than an<br \/>\nadvocate for the RMA and whatever itch that wanted scratched.<\/p>\n<p>At the video game conferences in San Francisco, these RMA\/CMG<br \/>\nmembers introduced themselves as AFM members who were<br \/>\nauthorized to handle video games contracts (A blatant lie). They<br \/>\nalso told the game industry reps that they should call the \u201cguild\u201d<br \/>\nwhen they\u2019re ready to record. If you called the number on the \u201cGUILD\u201d<br \/>\nbusiness card you reached the RMA OFFICE IN THE LOCAL 47 BUILDING.<br \/>\nThe Local said nothing. If the RMA leadership couldn\u2019t get the work<br \/>\nlegally, they\u2019d try to do so illegally.<\/p>\n<p>This illegal organization violated AFM Bylaw (Article 10, Section 3) by<br \/>\ncreating an illegal competing union in the federation\u2019s jurisdiction,<br \/>\ntrying to take over Video Games negotiations, and falsely claiming<br \/>\nAFM approval.<\/p>\n<p>They even got a journalist to write an article for them.<\/p>\n<p>\u2014\u2014\u2014\u2014<\/p>\n<p>Variety Business: Musicians to tune out AFM union\u2028Over 200 join Professional Musicians Guild\u2028By JON BURLINGAME<br \/>\nL.A. musicians have placed the American Federation of Musicians<br \/>\non notice: Shape up or face possible decertification as their collective-<br \/>\nbargaining agent for film and TV recordings.<br \/>\nMore than 200 of the estimated 900 professional musicians who are<br \/>\nmost active on film-scoring dates have already joined the new<br \/>\nProfessional Musicians Guild, according to PMG president Andrew<br \/>\nMalloy&#8230;<\/p>\n<p>\u2014\u2014\u2014\u2014<\/p>\n<p>The Guild\u2019s goal was perfectly clear, and in their own words, it was<br \/>\nan attempt to bust the AFM.<\/p>\n<p>With one of their Officers being the Secretary-Treasurer of the PMG,<br \/>\nthe Vice President of the RMALA and webmaster of Local 47, the<br \/>\nconflict of interest between the RMA and the GUILD could not be more<br \/>\nsolid.<\/p>\n<p>No less solid was the link between the GUILD and LOCAL 47.<\/p>\n<p>At a conference in New England at the time, Mr. Espinosa not only<br \/>\ndefended the GUILD, and admitted that one of the PMG\u2019s officers held<br \/>\nan enforcement position at the Local (The Hearing Board), but went<br \/>\nfurther and said he would take no action against any GUILD member<br \/>\nunless forced to by the Federation.<\/p>\n<p>His true loyalties were clear; to the RMALA above all. The IEB was no<br \/>\nmore help than President Espinosa. The governing body of our federation<br \/>\nwould do nothing to stop this illegal guild, or was simply impotent to do<br \/>\nso. Local 47 was (and still is) owned by the RMA, but it turned out so was<br \/>\nthe IEB.<\/p>\n<p>In truth, it was all about getting back at Tom Lee at the member\u2019s<br \/>\nexpense.<\/p>\n<p>THE LAWSUITS<\/p>\n<p>Then there were the lawsuits. The RMA leadership would call a contract<br \/>\npromulgated or that they didn\u2019t have enough input. Or it was a tax<br \/>\nthey didn\u2019t like. They even got the RMA Membership up in arms about<br \/>\na sliding scale of tax payments that was actually put in place by the<br \/>\nRMA leadership itself, as well as changing the rules so that only those<br \/>\nplayers who spent enough hours recording could vote on contracts,<br \/>\n(Shutting out a vast majority of their own members nation-wide), yet they<br \/>\nshifted the blame to Tom Lee, and the gullible bought it hook, line and<br \/>\nsinker.<\/p>\n<p>The RMA then created a company called FAREPLAY, to collect money<br \/>\nfrom RMA Members to help pay for the Lawsuits.<\/p>\n<p>Though the RMA kept losing these suits, they made it clear that as<br \/>\nlong as Tom Lee was the AFM President they would make the AFM\u2019s<br \/>\nlife hell and that they would see the AFM member\u2019s dues spent fighting<br \/>\nthe RMA Lawsuits.<\/p>\n<p>At the following convention, the votes were in, and the RMA\u2019s candidate,<br \/>\nRay Hair was elected. The RMA had not forgotten about that Video Game<br \/>\nwork though, and if they couldn\u2019t have it no one could. This is where we<br \/>\nsee the true pettiness and insidiousness of the RMA leadership.<\/p>\n<p>One of the first things the newly elected President Hair was told to do was<br \/>\nto decree that ONLY COMPANIES could sign the VG assumption<br \/>\nagreement, not composers. In that moment, all video game scoring not<br \/>\ngrandfathered in with the Tom Lee Contract was lost, gone off to Seattle,<br \/>\nor London or anywhere, or eventually, Nashville, but never AFM again. As<br \/>\nI said, if the RMA leadership couldn\u2019t have it, no other AFM members<br \/>\ncould.<\/p>\n<p>Another example of RMA Arrogance?\u00a0 Two RMA leaders from Los Angeles<br \/>\nwent to a meeting with the RMASF board and had the gall to tell them,<br \/>\naccording to sources, \u201cWhy don\u2019t you guys concentrate on side-lining<br \/>\nand leave the recording to us.\u201d<\/p>\n<p>It wasn\u2019t long after that, that the RMASF, seeing the true nature of the<br \/>\nRMA and that it will only ever be about the RMA Los Angeles, disbanded<br \/>\ntheir chapter.<\/p>\n<p>Eventually, and fairly recently, President Hair stopped filing every lawsuit<br \/>\nthe RMA leadership wanted.<\/p>\n<p>The Result? One of those same two RMA leaders stood up in a meeting<br \/>\nand announced to the room that Ray Hair was the worst president the<br \/>\nAFM had ever had. Quite a statement coming from one of his creators,<br \/>\nand all because he (Ray Hair) wouldn\u2019t continue to kiss the ring and file<br \/>\nall the lawsuits the RMA leadership wanted (Spending rank and file\u2019s<br \/>\ndues money).<\/p>\n<p>Of course these lawsuits would only benefit the RMA elites. It seems<br \/>\nPresident Hair is now in new \u201cTom Lee\u201d.<\/p>\n<p>BUH BYE WORK!<\/p>\n<p>It is estimated that Los Angeles has now lost over 85% percent of its<br \/>\nwork, even worse in the rest of the federation. Many musicians, in<br \/>\nVirginia, Nashville, Seattle, Vancouver, New York, Los Angeles and<br \/>\nelsewhere, tired of not working and needing to feed their families and<br \/>\npay their mortgages are giving the finger to the AFM and either working<br \/>\ndark dates or going fi-core, and all because the AFM refuses to stand up<br \/>\nto a minuscule band of very selfish, greedy people (not all RMA members<br \/>\nto be sure, but the leadership and a few others.)<\/p>\n<p>Oh,\u2026 and sidelining? The RMAERS and their contractor began doing<br \/>\nsidelining, and have even taken over some of the USC film scoring<br \/>\nsessions, something that just a few years ago would be anathema to<br \/>\nthem. The Local administration helped that along by gutting the referral<br \/>\nservice of Local 47 and having all calls about sidelining transferred to the<br \/>\nelectronic music services office, home of guess who. They now try to take<br \/>\nover orchestras, having poisoned their own watering hole, and are trying<br \/>\nto push out the rank and file middle class in the process.<\/p>\n<p>Let\u2019s Review:<\/p>\n<p>The Guild; The Lawsuits; Fareplay; The insidious conduct; all these point<br \/>\nto an organization that has become poisonous to the federation and must<br \/>\nbe side-lined if the federation is to come back from the brink recording wise.<\/p>\n<p>When I joined Local 47 it had over 13,000 members, now it\u2019s half that.<\/p>\n<p>While no one expects the major motion pictures to go buyout, we need<br \/>\nbuyouts contracts for Video Games, Libraries, Sampling, Trailers and<br \/>\nlower budget projects.<\/p>\n<p>For the companies, they\u2019re willing to pay more for a buyout, but on the<br \/>\nother hand, I was told by an orchestrator for one of the biggest VG<br \/>\nFranchises that the company was willing to pay $100,000 extra to go to<br \/>\nLondon rather than record AFM. Now that\u2019s bad blood!<\/p>\n<p>Increase all the scales by 50%, or 100%, on a buyout basis and you\u2019ll find<br \/>\na lot of those dark dates coming back to the AFM, with the<br \/>\ncommensurate increase in dues, health and welfare and pension paid. Far<br \/>\nmore of our work would be on contract, and the ONLY ones who\u2019ll<br \/>\ncomplain will be those who\u2019ve done so very much to destroy our<br \/>\nfederation. Hell, if we\u2019d done it years ago the members may not have<br \/>\nbeen persuaded\u00a0 to sell the iconic Local 47 building.<\/p>\n<p>The choice is up to you, but now neither you nor anyone else can say they<br \/>\nweren\u2019t warned or informed. Keep kissing the RMA\u2019s ring, and you kiss<br \/>\nthe AFM\u2019s recording future good-bye.<\/p>\n<p>Thank you for your time,<\/p>\n<p>Charles Fernandez<\/p>\n<p>=============================<\/p>\n<p>III. (Some have more<br \/>\nthan one.):<\/p>\n<p>1) Armenia<br \/>\n2) Bratislava<br \/>\n3) Costa Rica<br \/>\n4) France<br \/>\n5)Lisbon<br \/>\n6) London (4 options)<br \/>\n7) Los Angeles (3 options)<br \/>\n8) Macedonia<br \/>\n9) Mexico<br \/>\n10) Nashville<br \/>\n11) New York<br \/>\n12) Prague<br \/>\n13) San Francisco<br \/>\n14) Seattle (2 options)<br \/>\n15) Tiblisi, Georgia<br \/>\n16) Vienna<\/p>\n<p>There are certainly more options than are listed here.<\/p>\n<p>[COLLEAGUES,<br \/>\nSo as was made clear, the AFM LAW COMMITTEE and AFM decided to<br \/>\ncontinue to kiss the RMA&#8217;s ring and let our recording industry die.<\/p>\n<p>Congrats folks,<\/p>\n<p>No doubt apathy and nonunion recording will grow, but remember&#8230;<br \/>\nWe did not leave our union, our union left us to genuflect for an<br \/>\nunethical and greedy recording musician leadership. Rehearsals are at CSULA on Sundays at 4:30-7PM. Tuition is $650<br \/>\nfor the entire year. Scholarship is available on a need or merit<br \/>\nbasis depending on instrument and individual student.
