I. MORE RMA FOOLISHNESS
Some time ago, the RMA sent out a blurb complaining that
they were somehow kept from taking part in the TV/Live
negotiations.
As it turns out, it was a blatant lie.
Not only was the RMA LA represented by Phil Ayling
(President-RMA International), the RMAC, the NASHVILLE Local
(Former RMA President Dave Pomeroy), but also by the President
of the RMA New York David Blanc, RMA member Tom “Bones”
Malone, plus a couple of other RMA members.
In the end it must be said, the folks who write the RMA tripe
simply have no shame. And they are some of the ones
representing the RMA rank and file.

Even knowing the facts above, the RMA put out lies trying to
create scandal where there was none, similar to what Dave
Pomeroy, Roger Blanc and Steve Erdody, among others,
have tried to do on this very list.
We actually knew they had been involved in the negotiations
before President Lee sent out his most recent email, but his
correspondence provided even more proof of the RMA’s
unprofessional, unethical conduct.
The information below was sent to all RMA members (Including the
RMA members on the COMMITTEE).

II. TV/LIVE NEGOTIATION EMAILS
FROM AFM PRESIDENT TOM LEE
Dear RMA Member,
The Recording Musicians Association International (RMA) leadership
recently disseminated an e-mail blast that contained the following
misleading allegations about the TV/VIdeotape negotiations that
are currently in progress.
From the RMA
“Local Officers pleaded with President Lee to allow the RMA to attend
the negotiations, but they were rebuffed. And in response to a written
inquiry by RMA President Phil Ayling, President Lee confirmed that he
would not allow your Player Conference representatives at the table
or in caucus”
The undeniable truth is that the AFM did not refuse Phil Ayling a seat
at the bargaining table at the TV/Videotape negotiations. Such
allegations are extremely irresponsible and are part of a larger,
reckless campaign by a handful of individuals to convince members
that the AFM does not support recording musicians.
The enclosures will demonstrate that the AFM, when officially notified,
took steps to ensure that Phil Ayling and other RMA members would
be seated at the negotiations. When you read the enclosures you will
see that NONE of the emails that I sent contained words that stated
or implied that “President Lee confirmed they would not allow
your Player Conference representatives at the table or in caucus.”
The enclosures begin with Phil Ayling’s e-mail to me on October 23rd,
in which he informs the AFM that he is the RMA’s “rank and file”
representative to the TV/Videotape negotiations (see enclosure:
“Phil Ayling Email”).
I responded to him that same day that the Federation may have to limit
the participants in this negotiation to those who actually qualify for
ratification purposes (see enclosure: “AFM President Response to
Ayling E-mail). Also in that e-mail, I asked Phil to submit any proposals
he may have for distribution to the bargaining group and I identified the
person I appointed as the Federation’s “rank and file” representative for
all recording musicians, regardless of RMA affiliation. AS YOU CAN SEE
FROM THE E-MAIL, there are no words that state or imply that “President
Lee confirmed they would not allow your Player Conference representatives
at the table or in caucus.”
Later that evening, RMA New York President, Roger Blanc, sent an email
to Local 802 officers informing them that RMA New York is sending four
individuals to the negotiations (see enclosure: Roger Blanc E-mail and
President E-mail to Landolfi”).
I then e-mailed Local 802 President, Mary Landolfi, informing her that,
due to space limitation, only those RMA New York members who were
qualified to ratify the contract would be invited to participate in the
negotiations (See enclosure: “Roger Blanc E-mail and President mail to
Landolfi”. There are no words in the e-mail that state or imply that
“President Lee confirmed they would not allow your Player Conference
representatives at the table or in caucus.”
On October 26th, I sent two e-mails to Nadine Sylvester, the Executive
Secretary to Secretary-Treasurer Sam Folio, asking her to include Phil
Ayling, John Acosta, Roger Blanc, and Juliet Haffner to the list of individuals
on the security list for entrance to the negotiations. Ms. Sylvester then sent
me an email of the list of attendees, which she confirmed with those
involved in security at the negotiations. This list includes RMA rank and file
member Phil Ayling and RMA New York rank and file members Juliet Haffner
and Roger Blanc (all three e-mails are in the enclosure, “Emails to and from
Sylvester”). Again, there are no words in the emails that state or imply that
“President Lee confirmed they would not allow your Player Conference
representatives at the table or in caucus.”
In addition, there are RMA International Board members who are attending
the negotiations. They are Local 257 (Nashville, TN) President Dave Pomeroy
and, again, Rick Blanc.
Also, the Federation rank and file representative is a member of the RMA LA.
He possesses excellent credentials and has worked on more than 180 broadcasts
a year for several years. This individual is well respected by his peers and is a
very strong representative for recording musicians all over North America.
Further, the AFM has been actively soliciting input from the rank and file in
LA and New York who are involved in television broadcasts.
As you can see by now, the allegations that the RMA is not represented at
the negotiation have no basis in fact and are completely without merit.
The time has long passed for such sensationalized charges to stop. Everyone
will benefit if the RMA leadership takes a new, cooperative approach with the
rest of the AFM. The RMA membership would be best served if the RMA
leadership would work with the rest of the union to help solve the pressing
problems facing musicians today, rather than placing much of its energy
on the spread of misinformation and the fostering of division.
On a final note, I would like to publicly condemn the RMA newsletter’s recent
denigration of the members of the AFM International Executive Board. The
attack on these hardworking unionists who have dedicated their lives to
the labor movement demonstrates a complete lack of respect for those
delegates who elected the IEB members at the last convention. Each of the IEB
members was elected on his own merit. And each had a highly successful
career in the music business before being elected to leadership positions
within the AFM. It is appalling and shows a total lack of professionalism
among the RMA leadership when their newsletter suggests that the members
of the IEB rubber stamp an agenda of the AFM President. This is a new low in
the rhetoric emanating from the RMA leadership and a disservice to the
recording musicians in Los Angeles who expect constructive dialogue from
their RMA representatives.

PHIL AYLING EMAIL
Dear President Lee and Executive Officers,
RMA has recently become aware of upcoming Negotiations for a successor Live
TV/Videotape Agreement with the major networks. Subsequent to our last RMA
General Conference, which was under the supervision of the IEB, we informed the
Office of AFM President and Secretary-Treasurer of all elections, appointments,
and delegates as is required in conformity with AFM by-law and policy.
Consistent with that, I will be coming to New York next week to fulfill obligations
as our Player Conference’s rank and file representative on the negotiating sub-
committee for TV/Videotape. I look forward to working with all who may likewise
be serving.
Because of the lateness of the hour and lack of prior notice from the AFM, RMA
has been unable to gather data and vet proposals as we do traditionally. We hope
that the federation has begun to collect relevant information and look forward to
receiving that as soon as possible. Likewise any notices which the federation may
have sent or will be sending regarding Live TV/Videotape would be helpful. It would
be my intent to share that with the RMA Executive Board and our Videotape
Committee so that they may begin their important work as soon as possible.

AFM President Response to Ayling E-mail
Dear Phil,
Thank you for your email below. Consistent with the terms of the 1961
letter of understanding written by President Herman Kenin to Cecil Read,
I notified the leader of the Recording Musicians Advisory Committee
(RMAC) about the TV/Videotape negotiations. As you may remember it
is President Kenin’s letter that actually defines the RMAC and its role in
representing rank and file musicians during Federation recording
negotiations. RMAC President Goodall was advised of these negotiations
as well as Local 47 President VInce Trombetta.
At this point there are far more people attending than anticipated and
it very well may be that we will have to restrict the participants to only
those who qualify to ratify the TV/Videotape agreement in addition to
local officers who under the bylaws are the true representatives of local
rank and file musicians. Please send us whatever proposals you have
and we will prepare them for distribution on Tuesday.
You will be pleased to know that I’ve chosen Local 802 member Tom
Malone to represent the rank and file musicians of the Federation. I’m
sure you will agree that he is well qualified to represent musicians in
this industry and will be a good fit for these negotiations. Incidentally,
I’ve consulted with some Los Angeles musicians who perform on television
and they’ve given their blessing to this appointment.

Announce Union Information Meeting Nov 16
Film Music Magazine - November 6, 2009
The organizing committee of the newly formed Association
of Media Composers and Lyricists (AMCL) in partnership with
Teamsters Local 399 has announced an informational meeting
concerning union representation for composers and lyricists
working in all forms of contemporary media on November 16
in Burbank.
The meeting is open to all composers and members of the
composing community. The group’s organizing committee,
started four years ago, is led by composer Alan Elliott, “The
Simpsons” composer Alf Clausen, ASCAP Board Member
Bruce Broughton and former SCL President Jim DiPasquale.

Since the dissolution of the composers’ union in 1982,
composers are the only major creative entity working in
the film and television industries without any collective
bargaining or industrial representation.
The AMCL notes that the focus of the current unionizing
efforts are to establish working conditions and health
benefits for composers in addition to starting to find basic
minimums.
The AMCL’s efforts to unionize composers represent a
convergence of timing and determination. Four years ago,
the Teamsters unionized a smaller unit of 400 casting directors,
and while the composer industry is made up of thousands of
composers across the country, the AMCL says the Teamsters
alliance represents a blueprint for how to bring members of
the composing community together.
The group points to the success of the Writers Guild of America
in negotiating rates for their members, as opposed industry
rates for composers which have seen major declines over the
last 2 decades.
Composers are urged to attend the November 16 meeting
where detailed information about the unionization efforts will
be discussed and questions from attendees will be addressed.

BRUCE FOWLER — Bruce Fowler is a versatile musician,
having come from a very musical family which boasts a
father and five brothers who are all internationally respected
composers and recording musicians. He has been nominated
for both a Tony Award and a Drama Desk Award for Lion King
on Broadway.
As a trombonist, has played and recorded with such notables
as Frank Zappa, Woody Herman, Buddy Rich, Don VanVliet,
Ella Fitzgerald, Quincy Jones, Michael McDonald, the Akiyoshi-
Tabackin Big Band, Brian Setzer, The Fowler Brothers and
numerous others. He’s also played on countless soundtracks.
In 1989, Bruce began working as an orchestrator. In 1990 he
met Hans Zimmer (through Shirley Walker), and soon became
his head orchestrator. Bruce and his wife, Suzette Moriarty,
formed an orchestration company and have worked on some
150 movies to date.
WALT FOWLER — Walt Fowler started playing piano at age 6,
then took an interest in trumpet at age 8. In 1974, he joined
Frank Zappa and the Mothers and appeared on the live album,
“Live at the Roxy and Elsewhere”.
Walt has performed live, toured and/or recorded with artists
such as; James Brown, Roberta Flack, Stanley Clarke, Yazawa,
The Doors, Manhattan Transfer, Fishbone, Luis Conte, Billy
Childs, and Toto. Walt is also featured on many major motion
picture soundtracks, including Backdraft, Regarding Henry,
Pacific Heights, The Lion King, Broken Arrow, The Thin Red
Line, Black Hawk Down, Ocean’s 12 and Ocean’s 13.
He has orchestrated on many feature films including The Rock,
Con Air, Twister, Enemy of the State, Face-Off, Gladiator, Pearl
Harbor, Chicken Run, Shrek, Shrek 2, Spanglish, The Bourne
Supremacy, X Men 3, The Chronicles of Narnia, The Da Vinci
Code, The Holiday, The Good Shepherd, Pirates of the Caribbean
1, 2 & 3, Transformers, The Simpsons Movie, The Dark Knight

Regarding RMA night last sunday
it looks as though many of the RMA-LA members were at the Canyon
Club for the annual fundraiser/party event masquerading as working
session musicians in Los Angeles……..
I just couldn’t bring myself to go to look at these people who
think that all is well in the LA session community - in other
words while the Titanic is sinking “lets keep the band playing”
…….great.
the work scene in LA for recording sessions is a freakin joke
because of most of these people and their inability to see reality.
The rest of us below them are bearing the results of this.

You're seeing players who previously would never do church jobs,
casuals, demos or even orchestras now taking as much of it as
they can. They know the score, but they also know if they speak up
whatever they have left will be taken away. This is the problem

Greg fails to mention HOW MANY FAMILY MEMBERS he’s talking about
for the NY plan. Spouse and one child? Two children? Ten children?
When he talks about the Local #47 plan being “only” $900, he’s talking
apples and oranges.
LET’S DO THE MATH:
Local #47’s H&W plan total cost for MEMBER ONLY for one year:
- $900: amount of contributions required through the Oct 1-Sept 30
qualifying period.
- $660: total per year (as $55 monthly premium) for the HMO plan
(not even thinking about the much more expensive PPO plan.)
Total per year JUST FOR THE MEMBER for HMO:
$1,560
Plus: $3,600 per year extra per spouse or child!
Adding only a spouse plus one child:
$8,760.
more than the NY plan!
Greg, please let us know how you arrived at your figures.
[If Mr. Huckin's reads our mailing, perhaps he can explain the
apparent mistake in his protestations at the last membership
meeting that the New York Local members pay more than
we do for the same coverage comparing family to family.]

Resolution #3 interferes with the electoral process in the most obvious
place for union members to gather and express their views. The rehearsal
studios and recording facilities, the auditorium and the parking lot are all
legitimate places to talk about union business and that includes petitioning.
If we must, to placate other viewpoints, then bar petitioning from the hallways,
the union offices and union related offices in the building only. If it gets
passed as is, it will be a small step to outlawing political gatherings altogether
on union property. That is where I think this is headed. It is disrespectful to
the U.S. Constitution, the Bill of Rights, and one should be ashamed to even
consider such a rule.

[SELA decision August 28, sent to members Sept. 11]
In the pres’ email to Local 47 membership about SELA suspension, he said
the Trustees decided to pull the CELA on Aug. 28. Since there are 3 of our
trustees there, at least one of them must have known about it. I understand
a Local 47 board member had to insist that the membership be notified
asap before this email was sent. Says a lot about our board, doesn’t it.

Dear Mr. President and Staff:
I don’t know what is going on or NOT going on over at Local 7, but, if they can’t even aford a dime for a fax, someone please lend it to them.
I was under the impression that this was being handled by Zana at the Foundation. They had promised to pay my October and November premium under a grant from Kaiser. Since you did not make any attempt to reason, witj Zana at the Foundation, or communicate with me on the manner, I presumed it was paid as per my agreement with Zana and the Foundation. She requested that you fax her the bill for November .
Please FAX this bill immediately to Zana at The Foundation (323) 461 5260 The staff at Local 7 are threatening to suspend my health insurance, again. The same thing happened last month when I tried to get Local 7 to collect on Part 1 of the grant. Attn: To Zana: FAX 323-461-5260. I believed there was also some problem last month with responding to the pre agreed plans to pay for my October and November premiums. That was part of the ‘foundation grant awarded me. And now you’re telling me 2 weeks before Xmas that the full amount is now due and payable. As agreed upon the foundation will pay the November premium. As for the December premium I will have to wait until after Xmas to pay that..I had informed you back in September that the foundation had agreed to pay both October and November’s premium’s back then. But evidentally, someone at the the staff didn’t take me at my word. Is it really so difficult to fax over a document to the local 47 foundation? I would presume that my dues are used to handle such expenses, but when it comes to help from the union, on a very important matter re: my health insurance, I have had to call the foundation twice to make sure that they local 7 had made the payment as promised.. Yes, folks, this is your union dollars at work. When it comes to doing what we elected them to do, well, that’s another thing.

This is a quick reminder to let you know that your account with us is past due. We haven’t heard back from you regarding your medical insurance payment for November in the amount of $517.00. Per the voicemail you left, payment was to been received in the Union Office by the end of November. To date we have not received that payment. December’s premium in the amount of $517.00 is now due and payable.
I’ve attached your invoice for the amount due of $1,034.00 for November and December. If other arrangements have been made to make these payments and bring you up to date, please contact us before December 18th and let us know. Otherwise we will be obligated to cancel the coverage and any balance on the account will be immediately due and payable.
Taking care of this matter is greatly appreciated. If you have already sent payment for this invoice, please disregard this letter and accept our thanks for your payment. We appreciate doing business with you and look forward to doing so in the future.
