Welcome new Members!
This issue is devoted to addressing our Local #47 announcement
last week: “H&W Fund Suspends Acceptance of Contributions
under SELA”
- Several Members (myself included) did NOT receive this radical
Union notice, so we are including it at the end of this newsletter.
- We requested a place on the agenda for today’s Tuesday
Executive Board meeting. However, we have been told by
both our Secretary and President that our Local has no
jurisdiction over the decisions of the Health & Welfare
Trustees; therefore they have refused to allow us to ask
questions today.
- The Trustees for the H&W plan are: President Vince Trombetta,
Past President Hal Espinosa, and Member Jay Rosen.
- We will find out what our Bylaws - and Federal law - say
regarding protocol for meeting with the Trustees and
informing Members of the facts leading to this radical decision.
- The Trustees’ decision requires all Band Leaders to now
revert to the activities that were in place before the advent
of SELA
-Band Leaders no longer allowed to pay into their own H&W
or Pension funds on behalf of their employers, only those of
their Sidemen. Their remaining options are:
1.) become a Corporation (expensive, complicated to the
point that Band Leaders would spend the same money self-
paying their health ins)
2.) use a payroll service (also expensive and paperwork-intensive)
3.) Somehow convince Employers (event promoters) to write two
additional separate checks covering the Band Leaders’ H&W and
Pension contributions - (rediculously over the top! Of course,
promoters will simply use another, non-Union band rather than
subject themselves to the additional trouble)
4.) stop filing Union contracts. Just as in the past, if there’s
nothing in it for the Leader, they will overwhelmingly choose
not to subject themselves to the paperwork. THIS is the reason
that SELA was created in the first place!

II. FMA UPDATE ON SELA SITUATION
Dear FMA-LA:
Update on the situation with SELAs being suspended as of Oct 1
1.) SELA suspension background information
2.) FMA-LA suggestions for remedy
3.) A call for volunteers

1.) SELA suspension background information
- The SELA was created to allow Band Leaders to pay into their own
Heath & Welfare and Pension funds.
- Before SELA, Band Leaders could pay into the funds for their Sidemen,
but in order to avoid the possibility of fraudulently claiming non-existing
events, were required to designate an employer to pay into their own.
- Band Leaders’ options were:
1.) become a Corporation
2.) use a Payroll Service
3.) Have the Employer (event promoter) write two additional checks
covering the Band Leaders’ H&W and Pension contributions.
4.) Not pay into their own funds, but only into their Sidemens’.
Sadly, many Band Leaders chose not to file a Union contract at all
rather than deal with the added paperwork.
- With SELA, the Band Leader became an “employee designee,” able
to pay into his own fund and thus bypassing the above options.
SELAs have worked well for the past four years, with many more
Band Leaders filing contracts, qualifying for H&W, paying into Pension,
and maintaining records of payment and employment.
- This year, H&W compliance audits revealed complications related
to a couple of Band Leaders paying their Sidemen cash for the year,
which meant no paper trail and no way of proving if listed Sideman
were actually on the show and paid for their services, or only fraudulently
added to the report for H&W qualification purposes.
- The fact that these Band Leaders were not acting as a business,
combined with the increased potential for fraud, was a cause of
great concern to our H&W Trustees. As the Trustees cannot audit
everyone using SELA, it was assumed that though those discovered
are less than 3% of all SELA users, there may be additional breeches.
- Our H&W and Pension funds are regulated by the Federal
government. They are regularly audited. If our Trustees ignored
potential fraud, they would be liable in Federal court.
- Several H&W Trustees meetings ensued, wherein Trustees
created a list of safeguards that could be put into place to
prevent possible future fraud.
- In the end, however Trustees realized there was not time
to guarantee safeguards before the October 1st new SELA
qualifying period.
- The Trustees therefore relutantly made the decision to
suspend the use of SELA until and unless an approved plan
could be put into effect. This was done with short notice in
order to give Band Leaders time to implement another method
(see above.)
- The H&W Trustees then reported their decision to our Local
#47 Executive Board, who agreed.
- The result: as of Oct 1, 2009 Band Leaders must use an
alternative until this problem is fixed.
2.) FMA-LA suggestions for remedy
FMA-LA Members and others would like to see a swift and
favorable conclusion to reinstate our SELA.
Possibilities include:
- In the interum, assistance from Local #47 for all Band
Leaders desiring to use a corporation, payroll service, etc
to continue filing for benefits.
- A required class for SELA education and certification
- A peer mentorship program, overseen by the Trustees,
wherein veteran SELA users would aid and monitor new
users.
3.) A call for volunteers
- FMA-LA would like to hear your constructive ideas.
As we now see, if there is fraud, even one Member doing it can destroy SELA.

FMA President Lisa Haley deserves great credit for keeping
the FMA members, and us, up to date on this situation.
Though Mr. Trombetta NOW seems to care, through
a Local 47 email, our sources tell us that those who
fought to keep the SELAs working from Local 47 were
primarily Vice-President John Acosta and Local 47 legal
counsel, Lewis Levy.
Apparently neither Mr. Espinosa, Mr. Trombetta or
Mr. Rosen lifted a finger to keep the SELAs from being
shelved.
No surprise there.

III. COMMENTS AND LETTERS CONCERNING STUDIO 47
Sorry for the spam. But this is relevant and important.
Anyone who wants the continuation of Studio 47 should
read this. Forward this to all member friends and TELL
THEM TO COMPLAIN!!! I NEVER spam, but this needs to
be addressed by us ‘working schlubs’ out there. To my
knowledge, many of you have gone down to Local 47
and recorded to present yourselves or your band to
clients. Still, the Executive Board is closing it down, with
very few complaints. (Only 5 Emails complaining???
Unbelievable. Read on.) Apparently a lot of people are
bitching, but nobody is writing, so it’s no wonder they’re
going ahead and closing it.
I wrote a letter, and here’s is the answer that I got:

Dear Jimmy,
Please be advised that I am responding to you as an
individual officer of Local 47 and not as an official
spokesperson for the Local 47 Executive Board.
(So don’t bust his chops everyone. JS)
Thank you for your interest in Studio 47. The restoration
of the studio was put on hold earlier this year because
of the uncertainty of the economy and the drop in work
dues received by the Local this year vs. last year. The
status of the studio will be reviewed from time to time
as finances and needs may determine. At this time there
are no plans to eliminate the studio.
Your input is important. A union is guided by its members
when determining what services are offered. To date and
to the best of my knowledge only 5 emails have been received
by the Executive Board expressing any interest in Studio 47.
I’m sure that you agree that with a membership for over 8000,
this is not an overwhelming interest in the studio. Nevertheless,
all 5 emails were in support of Studio 47.
Please do not hesitate to contact me on any Local 47 matter.
I will do my best to answer any questions or address any
concerns you may have.

I know that times are tight for a lot of you guys. Ditto for me.
If they close Studio 47 due lack of funds, that’s tough times
and very sad. But if they close it due to a perceived lack of
interest, that’s OUR fault and just plain stupid. Put a shout
out to Local 47.

It has come to my knowledge that the board is thinking of
discontinuing the use of Studio 47 for its members. Although
I do own a studio, I have used Studio 47’s facilities in the past
and has proven to be a great tool for its members to find work
and document their wares. There are many of us who can use
this service and it should be an ongoing facility like the rehearsal
rooms.
With so much going by the wayside (CD/Radio Airplay, Referral
Service & SELA ) there’s very little for the members to be involved
and excited about.
Please keep Studio 47 working for the members who need it most.

To the Board and the Overture,
Studio 47 has served many members well. I myself used
the Studio early on for orchestral demo sessions, only
stopping because there was no back-up generator should
the power go down, considering the large number of
musicians employed.
If you know anything about marketing, the exact number
of responses does not represent the true number of
those who think the studio matters. Politicians know
this, understanding that if one person cares enough
to actually write in it represents a certain additional
number of members.
To the best of my knowledge, which could be faulty,
the board agreed to reopen the studio, that it was
mandated at a general membership meeting. I also
understand that a mobile pro-tools rig could be
obtained for about $20,000 that could serve the
purpose well.
I understand that this Local had the opportunity
to serve as the recording facility for the UCLA
Extension courses, since their studio of choice is
closing. This would continue a great deal of work
for union members, money for the Local from the
fees paid, and probably new members.
Apparently they were told, “It’s not running now”
or something to that effect.
I’ve heard the argument that not enough members
care, but this one use for the studio could do a great
deal to improve our image in the Community, among the
membership and make money for the Local.
From the CD/Radio airplay Department being gutted,
to the gutting and half hearted efforts for the Referral
Service, to the suspension of the SELA contract, you
have again and again shown a distain for the Rank and
File of this local.
Studio 47 matters and can be functional for $20,000.
You spent half a million on the refurbishment of the
auditorium. You’re having no problem spending thousands
more on redoing the 2nd floor. But something that can be
of use to many, many rank and file members you balk at?
I personally expect no better conduct from you as a
board considering past conduct, but many do.

“To the best of my knowledge, the UCLA recording session did indeed take
place on Thursday evening, Sept. 10 in rehearsal room #6. Everyone was
pleased with the outcome. We are working on scheduling future dates with
them.

Dear Committee:
I did receive one reply from a Board Member (as an individual)
about my letter on Studio 47. He said they reason work s
topped was due to a decrease in work dues this year as
compared to last year’s. He also said the Board has only
received 5 letters concerning Studio 47 at all. If no one
else is going to get off the duff and do something, how
are we going to better 47? Apathy will kill us faster than
anything RMA can/will do.
If 47 is going to be “saved” every Member needs to speak
up, and do it very soon!

ASMAC WELCOMES
Jazz Pianist, Musical Director, Composer, Mentor
PATRICE RUSHEN
September 23rd - Luncheon @ Catalina’s in Hollywood
A classically trained pianist, Patrice Rushen, has spent a
lifetime honing the skills that make her one of the music
industry’s most versatile and sought after artists. Considered
one of the world’s top jazz pianists, Rushen has performed
with many esteemed artists including Quincy Jones, Kenny
Burrell, Stevie Wonder, Herbie Hancock, Lionel Hampton,
George Benson, Nancy Wilson, Michael Jackson and Dianne
Reeves, to name just a few. As a classical pianist, she has
also performed with many symphony orchestras.
As a Musical Director, Rushen has amassed an impressive
list of “firsts”. She was the first woman to serve as Musical
Director for the 46th, 47th & 48th Annual Grammy Awards;
the first woman in 43 years to serve as Head Composer/
Musical Director for the Emmy Awards and the first woman
Musical Director of the NAACP Image Awards. Among her
many other “firsts”, Rushen has been the only woman Musical
Director / Composer for the Peoples Choice Awards and
HBO’s Comic Relief.
In addition to her success as a recording artist and musical
director, Rushen is also an accomplished composer for film,
television, CD albums, an award-winning symphony as well
as other symphonic works. Rushen’s feature film composing
credits include Men in Black, and Waiting to Exhale. ASCAP
honored her publishing company for the song, “Men in Black,”
as the 1997 ASCAP Most Performed Song from a Motion Picture.
Patrice Rushen has brought her years of extraordinary experience
as a performer, composer and music director to benefit young
aspiring musicians as a jazz educator.
She mentors young musicians through the Thelonious Monk
Institute of Jazz and is a founding member of the Jazz Mentorship
Program. Patrice has hosted music workshops at the Watts Art
Center and art the REDCAT venue in the Walt Disney Concert Hall.
In 2006, she was invited to the Julliard School in New York to teach
a Master Jazz class and in April 2008, accepted a professorship at
the prestigious Berklee College of Music in Boston.
Patrice Rushen has definitely earned the respect she has been awarded
by her peers in the music industry. Bring your questions for what is
bound to be a very interesting lunch.

Canceling SELA is the masterstroke in their endgame. For many
members this will be the last nail in the coffin.
Some Health & Welfare Fund background:
The Health and Welfare Fund is a COMPLETELY separate entity
from Local 47 and the AFM. (Actually the AFM is out of the picture
altogether on this. There is no H&W at the AFM level.) It was
established to collect health insurance benefit contributions
through Local 47. It is controlled by the H&W Fund trustees,
three from the union, three from management. The union trustees
are not the trustees we elect every two years. The H&W trustees
are appointed for an indefinite term. The current union trustees
are Hal Espinosa, Vince Trombetta, and Jay Rosen.
These trustees are legally bound to make decisions that are
best for the fund, whether or not those decisions are in the
best interest of Local 47 members! A huge built-in conflict. For
all we know (because this is a virtually secret organization) they
may have canceled the SELA contract because one or two
bandleaders messed up.
Our current trustees, all three of them, since the inception of the
SELA contract have voiced opposition to its implementation.
And now Trombetta sends out an official email crying about his
concern for the members? …Somewhere there is an envious
crocodile.

Let’s set the record straight: “Questionable payroll practices”
have nothing to do with the syntax of SELA’s or the fact that
SELA’s work and are legal. SELA’s are a done deal and have set
a precedent. “Questionable payroll practices” were “discovered”
after a targeted audit, triggered by certain 47 officials from the
previous administration, against a few musicians who were
subsequently exonerated. Legal counsel already reviewed the
SELA’s when they were first created so there is no need to
“review” unless legal counsel erred in which case it should be
on his dime. Either that, or a professional labor contract attorney
should be consulted. In other words, there is absolutely no excuse
for suspending SELA’s and no amount of patronizing and deceitful
lip service will make it okay.
There are a few issues that beg for an answer. Musicians who
have booked SELA’s after October 1st (holidays are upon us) have
to say “Sorry, I can’t honor the union contract that you and I
signed”. In addition, the Trustees can’t justify the suspension of
SELA’s by making some contracts after October 1st okay, and
suspending the rest, especially if there is something “wrong” with
them. If SELA’s are not legal (for the sake of rhetoric), those who
filed SELA’s can be disqualified from their medical and pension as
a result of the now invalid SELA’s. Insurance companies can
pressure H&W to retroactively disqualify musicians who have
already qualified for medical and pension as a result of filing illegal
SELA’s. Will the Trustees or Local 47 be held responsible for the fall
out? Will the unused portion of the H&W generated from SELA’s
be refunded to those who, through no fault of their own, contributed?
Would the Committee kindly publish the names of the Trustees
with contact information?

president of the AFM. [INAPPROPRIATE CONTENT REMOVED],
and so he was assistant to quite a few of them along the
way. and whenever a contract was causing some political pro-
blem at a studio or a symphony, bob would write a sideletter,
a special agreement for the moment.
these sideletter agreements were equally confusing to
management and musicians, grey clouds obfuscating the
real issues, and allowing flagrant violations of contracts.

Cancellation of the SELA contract is a major and very damaging
step taken by Local 47. Thank Goodness for THE COMMITTEE,
the forum they provide, and the questions they raise.
Yes, we all object to fraud…but to cancel the entire SELA
process?
It makes us wonder if there is a hidden agenda in the mix….

A monthly plan.
If local 47 does not offer the monthly plan, I believe the musicians
can join Local 7 and if they have the right zip code, get a health
plan that way.

Richie Hayward - Little Feat drummer - benefit concert.
To let everyone know there is a Benefit Scheduled on October
4th 2009 in Agoura Hills at the Canyon Club to raise money
to assist Richie Hayward in his medical expenses. Richie has
been diagnosed with cancer of the liver, the website
www.richiehaywardbenefit.com has been created to help.
Also, Bruce Barber and Leslie Butts have contacted a number
of companies to get involved with door prizes and other items
for the auction.
Companies that are already involved are, Drum Workshop,
Sabian, Zildjian, Pearl, Gretsch, Yamaha, Tama, Mapex,
DDRum, Guitar Center, Modern Drummer, Drum! Magazine,
LA Weekley, Southland Blues Magazine, and many others
and more to be named.

with the Jim Henson Company this past year.!
This Monday, September 7th, PBS/Kids is premiering a new
Jim Henson show, “Dinosaur Train”.
The show will air on your local PBS station with a two-hour,
eight episode mini-marathon, and then in a regular half-hour
time slot Tuesday-Friday. The following week it’ll be on
Monday-Friday in its half-hour time slot. Check your local listings.
PBS has already had 2.7 million hits on the DinoTrain website
and the reviews so far have been great!

NEW MALIBU COAST YOUTH SYMPHONY AUDITIONS
Beginning in Fall 2009, the Malibu Friends of Music will offer a
wonderful new program for aspiring orchestral musicians ages
18 and under.
The MALIBU COAST YOUTH SYMPHONY will be comprised of
outstanding young instrumentalists. Conducted by Maestro Scott
Hosfeld, the symphony will rehearse Monday evenings for
approximately 9 weeks in the Fall, and again in the Spring,
presenting an exciting final performance at the end of each
term.
In addition to rehearsals and performances led by Maestro
Hosfeld, each instrumental section in the symphony will have
individual coaching from many of the finest musicians in Los
Angeles!
