I. COMMENT FROM TWENTY-NINE YEAR LOCAL 47 MEMBER
Dear Friends,
As a member of Local 47 for the last 29 years, I have tried
to be a loyal member paying all my work dues and annual
fees in a timely fashion and supportive of a unified stance
for all musicians. It is apparent that the business model of
the music business is completely different than it was when
I joined in 1980.
Since the union still operates under an assumption that the
music business hasn’t changed since 1972 and refuses to
adapt to new business and technological realities of the
present, I am seriously considering the alternative of resigning
and continuing as a freelancer without being a union member.
The benefits of union membership are becoming less and less
apparent and everyone who continues to support it should
ask begin to ask themselves those very serious questions as
to the viability of its future under the same model.
Since the SELA contracts have now been taken away from
freelancers, there is very little reason to continue. Individual
musicians can just continue as as independent contractors,
and creating contracts with each employer that hires them,
negotiating their own wages, paying into their own SEP IRA’s,
buying into their own MSA health insurance. These items can
even be organized into a cooperative that might be able to
negotiate for lower rates collectively without paying the work
dues into the union.
These are just a few ideas to consider. Many of us already do
this because we don’t always qualify for the union’s program
and would allow us to keep vested no matter if it’s a busy year
or a year we would just have to pay into ourselves.
As far as our union pension goes, it has been a pretty successful
and well run retirement program. However, when one looks at
how the benefits have decreased in recent years and the payments
are totally dependent upon the investments that are chosen, I
wonder if many of us wouldn’t do better by putting a steady
amount into an IRA indexed to the total stock market without
all the fees associated with the pension administration costs.
With that, you can also decide what funds you care to put your
funds in and what kind of risk you are willing to take. You would
also be able to will the balance to your heirs upon your passing.
In a pension, it is a bet on how fast you will die before they will
have to stop paying you for retirement.
Also, just look at how our pension was recently invested in GM
bonds that were recently decimated after the GM reorganization.
Our pension had substantial holdings in GM bonds that were
worth 25 cents on the dollar after the federal buyout which our
union supported.
I know this is a little wonky, but for too long we have relied on
other well intentioned musicians to run a union that really needs
to be represented by people who have more experience in law,
investing, accounting and technology than retired freelancers to
represent those of us in the trenches.
I have not decided yet but I would be interested in hearing back
from others who might have some thoughts along these lines
or a good argument against it.

The FMA has gotten dozens of calls from very concerned
members about the suspension of the SELA contract usage.
This action could cause possibly hundreds of rank and file
freelance members their health coverage.
I am intending to be on the agenda of the board meeting
this coming Tuesday to find out details of the reasons for the
trustees’ actions. The FMA will keep you informed on the situation.

I. ANONYMOUS COMMENT FROM AN RMA MEMBER
Local #47 Financial Agenda 101
- When a Member joins Local #47, they also sign a statement
joining the “Musicians Club.”
- The “Musicians Club” owns our building (due to a paranoid
legal move when a past #47 President’s H&W fraud almost had
the AFM take over our Local.)
- The Recording Musicians Assn (RMA) has had a steady decrease
in their income for a decade now.
- RMA wants to sell our building for zillions to recoup our “equity.”
- They want #47 to be almost completely online, with a storefront,
and employees telecommuting, as unfortunately are most other
Locals today.
- Every Local #47 Member would share equally in the building’s sale.
-Therefore, RMA would like very much for those who have not “paid
in enough dues” to resign (or die) and hasten the sale.
-RMA would like to see our Membership decrease from 7,500 to a
few hundred Members, each paying about $2,000 a year in dues,
the way SAG does.
- As long as there is a Referral Service, a Recording Studio, a CD Sales
Dept, HealthPlan, and any other benefit that might encourage Members,
RMA cannot achieve its agenda.
- RMA believes that they, not Big Band Jazz or Symphony, not Jingles or
Touring, financed everything in this Local, and they feel entitled to the
entire pie.
- Only older Members are fully aware that the music scene in the 50’s is
what bought us our building - which had far less to do with Recording
at the time, and far more to do with Live Performance.
RMA has held most of the power in our Local for many years, having
long ago convinced our Officers that it’s RMA money that kept the doors
open.
It wasn’t until the Committee pulled back the curtain in 2005, by using
Bylaws to get Full Financial disclosure showing Members that Recording
only pays in about 17% of Member work dues, and the rest of RMA’s
“Special Payments” income was (until this year) untaxed, that we began
to understand how hollow their air of superiority truly is.
You can hear this financial agenda discussed in the corners at every RMA
meeting, from their President on down. It’s not a fairy tale to them.
They honestly feel it’s a legitimate endeavor.
Now you truly know why we have such a conflict between making our
Local work for its Members and sabotaging Member Services.
They are attempting to close down our Local, and even talk about
joining Teamsters as opposed to AFL-CIO.
Unfortunately for RMA, this fairy tale is not going to happen -
because it’s OUR Local too.
Fight back!
Attend the next General Meeting - stop the move to sell off our Recording
Studio equipment!

-Defendant AFM’s motion to dismiss the case shall be filed by
September 14th, 2009;
-Plaintiff Rishik’s opposition to the above shall be filed by
October 12th, 2009;
-AFM’s reply to Rishik’s opposition shall be filed by October
26th, 2009; and
-AFM’s motion to dismiss shall be heard on November 9,
2009.
Two more months of our dues money being spent fighting spoiled and
greedy children. (See comments section)

II. IT’S ALIVE!
We ruminated about whether the PMG had faded away into non-
existance a few mailings ago. As it turns out, they’re still around.
At the recent tribute for legendary trumpeter Uan Rasey, he was
presented with several awards including from the Trumpet Guild
and the RMA. Along with the others was a plaque presented by
PMG President Andy Malloy from the PROFESSIONAL MUSICIANS
GUILD (PMG).
So, like the vulture hiding in the shadows, the PMG is laying low,
waiting to see if their partners in the RMA and FAREPLAY can inflict
enough damage to the AFM to give them an opening.

III. STILL NO STUDIO, BUT SPENDING MORE TO UPGRADE THE 2ND FLOOR? NO PROBLEM.
While the board it refusing to fulfill their promise of reopening
Studio 47, even though it’s front and center both in the Local
47 brochures and under member benefits on the website, if you
read the minutes, you know they’re planning on spending your
dues upgrading the 2nd floor of the Local 47 building.

IV. STUDIO 47 COMMENTS
Buddy Childers stood up at a membership meeting about ten years ago.
I had never seen this giant of a bandleader/composer/trumpeter angry.
Buddy was furious at Local 47 officers Chase Craig and Vince Trombetta
who proposed shutting down the recording studio because it was costing
too much. The recording studio (which had just also gotten video gear)
was booked constantly for recordings and videos. The prices were so low
that it couldn’t have been making money, but that wasn’t the point. The purpose
was to help members advance their careers. Anyway, at the meeting, after Buddy
made a fiery speech about the benefits of the studio, he made a motion that the
recording studio will remain open, and if there was ever any thought of closing it,
it would be brought before the membership, not the board of directors, for a vote.
The members voted for Buddy’s motion. And a vote of the membership, whether
it happened ten years ago or yesterday, trumps the board of directors.
Just this once let’s do it right, and honor Buddy’s memory, and let the members
vote on if they want a recording studio.
[Colleagues,
It should be easy enough to request the minutes of the general membership
meetings from ten years ago and verify the motion. If it is true, then a vote by
the membership concerning the Studio should be required.
A formal request for the minutes should be made.]

I’ve been a union Musician member since 1974..which
includes the Chicago heights, Il. local, the New York local,
the Chicago, Ill. local and finally the Los Angeles, Ca. local
where I’ve been able to use Local 47’s facilities to make
make dreams come true.
You cannot bloc the use of the local 47 facilities who are
not on your film musician “contractors list.” Why would you
let this happen? Please stop this new local 47 order to let
only let “A” players” use the locals facilities. How can a
musician ( a union musician) make his dreams come true
unless his union supports his/her efforts to get to the “A”
list or at least make a living playin’ music in L.A.. You never
became who you wanted to be so why can’t young musicians
have the opportunity for their dream come true.

Hello!
I am really distressed to hear that the Local intends to dismantle its
own studio facility. I myself did a recording there several years ago.
However, I understand that there is a recording studio on every block these
days and the membership does not have to put up with the oppressive
environment that seems to be surrounding the local. The less general use
of the facility means less scrutiny of any “services” the membership might
expect or think they have. Vince Trombetta doesn’t want the membership
around during his non-union renovations. Gee, somebody might walk up to a
hard hat and ask if they are working under a union contract. By the way,
have you checked out the band leaders that have been suspended from the
rehearsal rooms? Don’t have some sub who is delinquent in their dues in
your band! Don’t try out some singer who belongs to another union, SAG
AFTRA. By the way, it is often the singers who employ musicians and bands.
Don’t for heaven’s sake put up a new chart and make a scratch track for
your professional development in those non soundproof bungalows that were
also built with non-union labor.

Dear Mr. President/Board Members:
I am writing you as a very concerned Member. The status
of Studio 47 has been a concern of mine for some time. I
cannot understand why 47 spent money to refurbish the room
into a studio and then not use it at all for recording purposes.
It has been posted that the current Board has no intention of
completing necessary upgrades or allowing the space to be used
for any recording purposes at all.
It is also been posted that the primary reason for such Board
positions is the undue influence of RMALA against the
interests of freelancers due to percentage of work dues paid.
Regardless if such allegations are true, the Board should be
seen to act in the best interests of all Members, not a select few.
If it is this Board’s decision to keep Studio 47 in a state of limbo
indefinitely, a declaration to all Members should be made and the
reasons for such a decision should be open and available to all
Members. To fail to do so would only confirm the numerous and
rampant allegations that this current Board has been corrupted by
a very small minority of 47 Members who are only out for themselves
and to satiate their rapacious greed.

Sean McNabb, co-chair of the Local 47 Golf Tournament. NON-UNION
MUSICIAN??? He’s not on the AFM roster. Oh but then that doesn’t
matter to Local 47 President Trombetta, who hired a non-union crew to
rebuild the union auditorium and paid them half a million dollars. His
private disdain for working-class musicians is not exactly a secret, but
does he have to publicly undermine the union like this? In the board
minutes published in the Overture it says that Trombetta wants to cut
Local 47 loose from the L.A. County Federation of Labor, and that he
is having meetings with his old friends the Teamsters. Why don’t they
just go ahead and do it? Drop out of the AFM, the AFL-CIO, and the
L.A. County Fed and form their own fat cat club. The PMG is set up and
waiting. Just leave Local 47 to the working-class musicians. We’ll bring
it back to what it was - the best Local in the Federation.

a recent chamber music concert in San Diego featured an
internationally known clarinet soloist and a pickup group of string
players from LA. after their rehearsal the clarinetist, a friend for
35 years, called me to ask if it could possibly be true that the cellist
in the group (Sandy’s first cellist, and a named player in the
Rishik lawsuits) had “recently received a Special Payment check for
$375,000? He was bragging about it during rehearsal, and it kinda
made me sick to think about. I’d have to work three lifetimes to save that
kind of money.”

Dear Committee:
In response to the Member who complained about Members
not showing up to vote at 47 meetings, the solution is very
simple. Use online voting. If online credit card purchases and
bank transfers are secure (”enough”), why can’t 47 use the
same type of website for voting? Can we, as Members petition
by letter for a mail-in vote on this issue?
Attendance at meetings is just an impossibility for many Members.
Perhaps the reason otherwise intelligent people (Board Members)
haven’t already done this is to perpetuate the destructive control
of RMALA?
Maybe on this issue, we can DO something instead of just complain
all the bloody time. If the desire to make 47 work for the majority of
its Members is truly strong, Members should email/write letters
demanding a certified Member poll about using online voting. To do
any less is to be even more guilty (by inaction) that those being
railed against.

Comment:
I have been friends with Ms. Lashinsky for many years
and I must say I am surprised by her apparent greed.
However, since I have not discussed the matter with
her I am not sure what her real motivation is by taking
jobs in addition to receiving her generous salary. If
there is indeed an unethical process involved here I
must say that she is by no means alone. LA Philharmonic
musicians with their hefty salaries are not above taking
free-lance studio work or even playing concerts with
regional orchestras. This of course includes active and
retired Phil players who also have a pretty generous
pension check each month.
What about the guy who bragged about doing six gigs in
less than 24 hours and even documented it in the “Overture”?
Is this ethical?
I don’t necessarily blame Ms. Lashinsky entirely but I do
feel that the board members who allow her to do this are
really the ones at fault here. Ever since I came to LA
many years ago I have perceived the attitude among most
musicians that one should never “turn down” anything no
matter how crazy it makes your schedule. As I matured, I
realized that this was really a short path to the grave
mainly because of the things that could go wrong when
driving to the “next gig” in LA traffic.
If Ms. Lashinksky doesn’t find that her actions are unethical
then I am surprised but I am also amazed that we have not
heard from other Local 47 bassoon players about this issue.
Are they not angry or are they afraid to say anything?
[Editor's comment: Members of the LA Philharmonic are not
titled officers of our Local, making a major portion of their
living directly from the pockets of the members. Secretary
Lashinsky does.
The real question that should be posed to the board is this:
"Who's interests do you put first, the membership in its entirety
or the interests of your political allies."
We find the lack of comment by most bassoonists a mystery
as well, but both of your theories as to why probably come
into play.]

Anniversary of the start of World War II. It will be
held at the Cathedral on 555 Temple St., in Los
Angeles featuring ‘cellist Dr. Janice Foy, with
pianist Szymon Grab plus vocal quartet.
Dr. Foy will perform Frederic Chopin’s Nocturne in
C sharp minor, arranged by Marek Zebrowski, ASCAP;
the ‘Cantique de Jean Racine’, by Gabriel Faure plus
a premiere of a new work for piano and ‘cello by Michal
Connor called, ‘That Heavenly Country’.
There is a fee to park in their structure but the Mass

Ensemble Green is presenting a concert of my chamber music,
including the premier of my Fantasy for Violin and Piano,
written last year for Elizabeth and pianist Robert Thies, who
will both be playing the work!!
Also on the concert, I’ll be conducting my octet, Vineyards,
written about Elizabeth’s and my passion for wine and our
frequent trips to the Santa Ynez Valley!
And my latest chamber work, Dance Sketches, which the
group premiered last March. It’s a 35 minute tour de force
for oboe, harp, and string quintet that explores various
dance forms.
It should be a special evening and is a fund raiser for Ensemble
Green. Please come out and support us—-this is a group
who is dedicated to performing the music of LIVING West
Coast composers. It supplies a voice to those of us who are
writing music.

Beginning in Fall 2009, the Malibu Friends of Music will offer a
wonderful new program for aspiring orchestral musicians ages
18 and under.
The MALIBU COAST YOUTH SYMPHONY will be comprised of
outstanding young instrumentalists. Conducted by Maestro Scott
Hosfeld, the symphony will rehearse Monday evenings for
approximately 9 weeks in the Fall, and again in the Spring,
presenting an exciting final performance at the end of each
term.
In addition to rehearsals and performances led by Maestro
Hosfeld, each instrumental section in the symphony will have
individual coaching from many of the finest musicians in Los
Angeles!

Information and Registration
Tuition for each semester is an affordable $365. Qualified
students will be considered for merit or need-based scholarships.
